Home My WebLink AboutR-2023-072 Mid Year Budget Amendment - Purchase Emergency VehiclesRESOLUTION NO.2023- O 1 2- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, REQUESTING THE APPROVAL OF A MID -YEAR BUDGET AMENDMENT; WAIVING COMPETITIVE BIDDING AND AUTHORIZING THE PURCHASE OF THREE HIGH CLEARANCE VEHICLES FROM BOZARD FORD UTILIZING FLORIDA SHERIFFS ASSOCIATION CONTRACT BID AWARD #FSA22-VEL30.0 AND TO EXCEED THE CITY'S ANNUAL VENDOR THRESHOLD TOTAL AMOUNT OF FIFTY THOUSAND DOLLARS ($50,000.00); PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and materials for the City government in amounts in excess of the established monetary threshold without competitive bidding and without advertisement for bids, if authorized to do so in advance by a resolution adopted by the City Commission, if such purchases are made pursuant to a competitive bid obtained within the last eighteen (18) months by other governmental agencies such as the federal government, State of Florida or a Florida county or municipality; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10, "Monetary thresholds for certain purchases and payment disbursement authorizations", Subsection (a), sets the monetary threshold at Fifty Thousand Dollars ($50,000.00) for a vendor each fiscal year; and WHEREAS, the impact of the major rainstorm event on April 12, 2023 required an unprecedented level of effort and resources by the City to adequately address; and WHEREAS, while the heavy flooding across various areas of the city was well managed overall, post -storm recovery operations exposed the need for one additional vacuum pump truck and portable pumps and most of this equipment was to be included in the budget request for fiscal year 2024; and WHEREAS, the City Administration has determined that the prudent course of action is to order equipment prior to the start of Fiscal Year 2024 to be better prepared for future major rain events as well as the coming hurricane season; and WHEREAS, the purchase of the high clearance vehicles shall not exceed Two Hundred Thirty Thousand One Hundred Fifty One Dollars ($230,151.00), and a mid -year budget amendment is required to provide the necessary funding; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMNHSSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "Whereas" clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission authorizes the City Manager to execute the necessary documents for the purchase of a Three High Clearance vehicles in accordance with the proposal contained in `Exhibit A', which is attached to and incorporated into this Resolution by this reference. Section 3. That the total authorized purchase shall not exceed Two Hundred Thirty Thousand One Hundred Fifty One Dollars ($230,151.00), which includes the proposed purchase amount of Two Hundred Nine Thousand Two Hundred Twenty Nine Dollars ($209,229.00) plus a ten (10) percent contingency for dealer price adjustments. Section 4. That the City Commission authorizes a funding appropriation and mid -year budget amendment in the same amount from the Stormwater Fund Contingency Account 403-38- 01-538-99-10 to M&E Vehicles Account 403-38-01-538-64-20. Section 5. That all such purchases authorized by this Resolution are hereby authorized to exceed the annual purchase threshold of Fifty Thousand Dollars ($50,000.00) for Bozard Ford for fiscal years 2022-23 and 2023-24. Section 6. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 7.
