Agreement for Design Services for Mullin Park Park Improvements (RFQ 23-005) and Authorization to Bid Construction ServicesRESOLUTION NO. 2023- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO ENTER INTO AN AGREEMENT WITH KIMLEY-HORN AND ASSOCIATES INC. FOR DESIGN SERVICES RELATED TO THE CITY REQUEST FOR QUALIFICATIONS ("RFQ") NO. 23-005, FOR "DESIGN SERVICES FOR MULLIKIN PARK IMPROVEMENTS, " IN THE AMOUNT OF FIFTY-NINE THOUSAND EIGHT HUNDRED SIXTY-FIVE DOLLARS ($59,865.00), AND TO PROVIDE AUTHORIZATION TO SOLICIT THROUGH FORMAL BIDDING CONSTRUCTION SERVICES FOR THE IMPROVEMENTS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Resolution No. 2023-060, adopted June 27, 2023, the City Commission authorized City Administration to begin contract negotiations with the top -ranked firm, Kimley-Horn and Associates, Inc., of RFQ No. 23-005 entitled "Design Services for Mullikin Park Improvements"; and WHEREAS, the City of Dania Beach was awarded Two Hundred Thousand Dollars ($200,000.00) in grant funding through the Florida Recreation Development Assistance Program (FRDAP) with a Two Hundred Thousand Dollar ($200,000.00) match in August 2022 for Mullikin Park improvements; and WHEREAS, the City Administration recommends approval of the agreement, which is attached as "Exhibit A," and is made a part of and incorporated into this Resolution by this reference, in the amount of Fifty -Nine Thousand Eight Hundred and Sixty -Five Dollars ($59,865.00); and WHEREAS, the Department of Parks and Recreation is seeking authorization from the City Commission to solicit through formal bidding construction services for the park improvements at Mullikin Park upon completion of the design. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "Whereas" clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City of Dania Beach, Florida shall award an agreement related to RFQ No. 25-003, "Design Services for Mullikin Park Improvements," to Kimley-Horn and Associates, Inc, in the amount of Fifty -Nine Thousand Eight Hundred and Sixty -Five Dollars ($59,865.00). That the funding for design services is appropriated for in Grants Fund Account number 103-72-10-572-31-10. Section 3. That the proper City Officials will solicit, through formal bidding, the construction services for Mullikin Park upon completion of the design, and that funding for this project shall exceed Fifty Thousand Dollars ($50,000.00) and is available and appropriated in the FY 2022-2023 budget as follows: Revenue: City Funding 103-00-00-381-00-01 +$250,000.00 FRDAP Grant: 103-00-00-334-70-01 +$200,000.00 Expenditures: Design/Professional Services 103-72-10-572-31-10 +$59,865.00 Construction/Improvements 103-72-10-572-63-10 +$390,135.00 Section 4. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 5. The park is bounded by SW 131 Avenue on the east side, SW 16t Court on the west side, and residential single-family houses on the north and south sides. The park's current amenities consist of the following: 1. Basketball court 2. Fencing 3. Playground and swing set 4. Park signage 5. Litter receptacles 6. Picnic table shelter and benches 7. Fire hydrant 8. Sidewalk on the east and west perimeter boundaries 9. Sod The proposed improvements are to occur In the +/- 0.6-acre area and will include the following: 1. Renovated playground and play structures 2. Renovated basketball court 3. Sitting areas, exercise stations, and pedestrian connectivity throughout the park 4. One (1) small pavilion with picnic table 5. Perimeter fencing 6. Landscaping improvements 7. Lighting and security camera improvements Scope of Services The following scope of services details the site survey, site civil, and landscape architectural services required for the park improvements. TASK 1 — SITE SURVEY Kimley-Horn will engage a sub -consultant, Stoner & Associates, Inc. (licensed surveyor) to prepare a topographic survey of the subject site to State of Florida standards. Survey will show improvements and visible utilities on the site and elevations will be taken throughout the site and the adjacent streets. The survey shall include the following: • Prepare a boundary and topographic survey of the property known as Mullikin Park, located at 230 SW 1st Court, Dania Beach, F133004. • Recover property corners. When a property corner is not found a 5/8" x 18" iron rod with an identifying surveyor's cap or a nail and stamped disk will be set. r ley>Morn Mrs. Cassi Waren July 14, 2023, Page 2 • Order a search for ownership and easements from Paramount Title Services, review and plot Items listed therein. • The topographic survey will cover the parcel and a portion of SW 1st Court and SW 1st Street lying adjacent to the Park. • Establish horizontal and vertical control points to support the survey efforts. • Vertical control (elevations) will be based on National American Vertical Datum of 1988. • Horizontal control will be based on the Florida State Plane Coordinates System, East Zone, North American Datum of 83111, • Measure spot elevation every 50 feet and on the corners of hard scape surfaces. • Elevations will be measured every 50 feet along the adjacent roadways, at the centerline and edges of pavement and swales. • Provide an approximate outline of playground equipment. • Locate surface features within the survey limits as follows: buildings, basketball court, pavement, driveways, paved swales, sidewalks, slabs, curbs, wails, fences, and signage. • Locate visible surface evidence of utilities as follows: utility poles, guy wires, street lighting, storm sewer structures, sanitary sewer structures, wire pull boxes, cable enclosures, utility cabinets, valves, valve boxes, meter boxes, backflow preventers, fire hydrants, and overhead utilities. • Measure the rim and invert elevation of sanitary and storm sewer structures that are accessible. Determine pipe types, size, and flow direction, when possible. Structures located within active roadways will be as -built at the field crews discretion, based on safety considerations. • Locate trees three caliper inches in diameter or larger. • Draft a boundary, topographic and tree survey at a standard engineering scale. TASK 2 - PROJECT KICK-OFF AND CONCEPTUAL DESIGN Kimley-Horn will attend one (1) preliminary site visit to observe existing conditions and assess potential design integration with surrounding spaces. After the site visit, Kimley-Horn will attend one (1) kick-off meeting with the Client to discuss the project, desired design elements, and to review the project schedule. Kimley-Horn will contact utility owners and request any available information depicting the locations and configuration of existing utilities within and around the park property. The utility information obtained will be incorporated into the survey provided in Task 1. Klmley-Horn will provide one (1) conceptual design for the project based on input provided by the City as a result of the kickoff meeting referenced above. The Conceptual Design Deliverables will include the following.• • Plan view rendering presented with a color aerial background to provide site context. • Plant palette showing photographs of proposed plant materials. • Hardscape palette showing photographs of pavement selections, fencing, site furnishings, lighting and other proposed above -ground design elements necessary to convey the design. This task includes one (1) meeting with the City after the conceptual design deliverables have been submitted for review. Upon receiving Client input, Kimley-Horn will revise the conceptual drawings to produce a design development plan and selections for the Items listed above that will be used as a basis for the permit/construction documents. �c5ml....�ttor �?. @25�3 S'tcrfioac uu t r22p'0 P�anlat�9t� t*L a3 �'> N = �- ,�,.3 Kimley>Morn Mrs. Cassi Waren July 14, 2023, Page 3 TASK 3 — 75% SITE CIVIL & LANDSCAPING CONSTRUCTION DOCUMENTS Kimley-Horn will prepare 75% design plans and details at a scale suitable for bidding purposes, to include site layout, park features, site lighting, landscape, and schematic irrigation. During this task, the Consultant will perform the following: • Attend one coordination meeting with each regulatory agency having jurisdiction over the project to discuss permitting requirements. • Prepare 76% construction documents typically consisting of the following: Site Plan to delineate the proposed park improvements that will include the following: playground, basketball court, sitting areas, exercise stations, proposed sidewalks, one (1) small pavilion with picnic table, and perimeter fencing. Paving and Drainage Plans to show proposed site paving and drainage for the park Improvements. These plans will also Include paving details. Lighting/Electrical Plans to show proposed site lighting and security equipment plans, including electrical service detail with riser diagrams (as needed), lighting layouts, electrical equipment space requirements, distribution panels, and equipment schedules. Photometric Plans to show proposed footcandles for the lighting improvements Utility Plans to show water service for the one (1) drinking fountain and one (1) potential irrigation service. It is assumed the existing water main adjacent to the subject property is sufficient in size and will not require any off -site water main extensions. Planting plans for proposed improvement areas will delineate plant material, plant quantities; plant schedules, specifications and project -specific planting details, including code required planting calculations. Irrigation plans designed to provide irrigation coverage for all exterior proposed landscaped areas. Kimley-Horn will provide the following irrigation design services, after Client approval of conceptual plans: ■ Calculation of irrigation system requirements based on water application per week and water window availability as determined by local municipality and Water Management District. • Water source(s) evaluation for irrigation system and integration options with existing campus Irrigation system. • Irrigation mainline and sub -mainline sizing with recommended routing. • Coordination with project civil engineer for sleeve and mainline routing, as applicable. • Master central control evaluation and recommendation, including analysis of system operation. A conceptual irrigation operation schedule for the project will be included, • Irrigation controller locations with power supply drop locations. (Electrical design and permitting for controllers to be provided by contractor) — As necessary. Kimley>Morn Mrs. Csssi Waren July 14, 2023, Page 4 • Material legend of all components. • Ancillary notes, calculations, and labels required to develop a master irrigation system. Hardscape plans based on Client design input gathered during the Conceptual Development phase. Kimley-Horn will prepare the following construction documents: • Site furnishings — specification and layout locations • Prepare drainage calculations and report for submittal to Broward County Surface Water Management Division. • Coordinate with FPL for new electrical service. • Submit the construction drawings to the City for review. Once comments are received, Kimley- Horn will meet with the City one (1) time to discuss. After meeting with the City, Kimley-Horn will address reasonable review comments as part of the final construction drawings. • Provide a preliminary opinion of probable construction cost at the76% submittals for proposed Improvements. The Task 3 Design Deliverables will include the following,• ■ 75% construction drawings in 24" x 36" PDF format • 75% opinion of preliminary probable construction cost TASK 4 — PERMITTING The Consultant will prepare and submit applications, calculations, supporting documents and plans for review by the following agencies: • Broward County Environmental Engineering and Permitting Division - Surface Water Management Program • City Building Department - As part of this permit, Kimley-Horn will assist the City and the selected Contractor in completing the necessary applications and plans for the City of Dania Beach building permit submittal. No other agency approvals are anticipated or included In this scope of services other than those identified above. All permitting fees will be paid directly by the City. As a part of this task, Kimley-Ham will: • Response to comments with tabulated technical memo and revised plans, up to two rounds. TASK 5 — FINAL PLAN PREPARATION Once the 75% construction drawings have been approved by the City, these will be used as the basis for preparing the final construction drawings. Technical specifications will not be completed as part of this scope of services. Design requirements will be reflected on the construction plans as notes and details according to City of Dania Beach requirements. Contract or "Front End" documents will be provided by the City and reviewed by the Consultant for conformance with the specifications and design plans. o �n P # R atl 1 250 Fi t s+ �Z - Kimley>Morn Mrs. Cassi Waren July 14, 2023, Page 5 During this task, the Consultant will perform the following: • Revise the drawings listed in Task 3 per the City and permitting agency comments • Tabulate anticipated construction Items, quantities and pay Item notes • Determine anticipated construction time for contract purposes • Update the engineer's opinion of probable construction cost • Provide the City with a project description to be included in the City's front-end documents The Task 5 Design Deliverables will include the followina • Final construction drawings In 24" x 36" PDF format • Updated engineer's opinion of probable construction cost for the proposed improvements • Bid form, estimated construction timeline, and project description • AutoCAD files of construction plans It is our understanding that the City will use a competitive bidding process to award the contract to a qualified contractor to construct the improvements. Kimley-Horn shall consult with and advise the City for the proposed improvements during the bidding process. This task is limited to attendance of one (1) pre -bid meeting and issuance of addenda in response to Interested contractor questions or requests for information during the bid process. All responses by the Consultant will be approved by the City prior to issuance. Once bids are received, the Consultant shall review the bids and provide a recommendation to the City of the apparent low bidder's price proposal. The City will be responsible in making the award. TASK 7 — LIMITED CONSTRUCTION PHASE SERVICES The following are requirements for the performance of Task 7: Meetings: This task is limited to a total of five (5) on -site meetings The Consultant shall attend a pre -construction meeting. The meeting will be at a location to be determined by the City's Project Manager. The purpose of the meeting will be to review the overall Project, Scope of Services of the Consultant and the Contractor. The Consultant shall also attend up to four (4) construction progress meetings for the successful administration, management, and technical execution of the Scope of Services. The agenda for each progress meeting, shall be determined jointly by the Project Manager and Consultant. When requested by the City, the Consultant shall prepare and distribute an agenda specific to each progress or other meeting. The agenda shall be distributed at least two (2) working days prior to the meeting, whenever possible. The Consultant shall be responsible for keeping and distributing notes from the meetings for which they develop the agenda. Notes from the progress meetings shall be distributed to all attendees within three (3) working days after the meetings. • Shop Drawing Review: Kimiey-Horn will review Shop Drawings and Samples and other data which Contractor is required to submit, but only for general conformance with the Contract Documents. Any action in response to a shop drawing will not constitute a change in the Contract Documents, which can be changed only through the Change Orders. • Contract Clarifications: Kimley-Hom will respond to reasonable and appropriate Contractor requests for information made in accordance with the Contract Documents and issue necessary clarifications and interpretations. Any orders authorizing variations from the Contract Documents will be made only by the City. • Site Visits and Construction Observation: Consultant will make up to five (6) site visits to observe the progress of the work, Observations will not be exhaustive or extend to every aspect of Contractor's work, but will be limited to spot checking, and similar methods of general observation. Based on the site visits, Consultant will evaluate whether Contractor's work is generally proceeding in accordance with the Contract Document and keep Client informed of the general progress of the work. Consultant will not supervise, direct, or control Contractor's work, and will not have authority to stop the Work or responsibility for the means, methods, techniques, equipment choice and use, schedules, or procedures of construction selected by Contractor, for safety programs Incident to Contractor's work, or for failure of Contractor to comply with laws. Consultant does not guarantee Contractor's performance and has no responsibility for Contractor's failure to perform in accordance with the Contract Documents. Consultant Is not responsible for any duties assigned to It in the construction contract that are not expressly provided for In this Agreement. • Review of Pay Application: Based on Kimley-Horn's on -site observations and upon review of applications for payment and the accompanying data and schedules, Kimley-Horn shall work with the City to determine the amounts owing to Contractor(s) and recommend in writing payments to Contractor(s) in such amounts. Such recommendations of payment shall constitute a representation to the City based on such observations and review that the work has progressed to the point indicated and that, to the best of Kimley-Horn's knowledge, information, and belief, the quality of work is in accordance with the Contract Documents (subject to any qualifications stated in Kimley-Horn's recommendations), and that payment of the amount recommended is due to Contractor(s). By recommending any payment, Kimley-Horn shall not thereby be deemed to have represented that observations made by Kimley-Horn to check Contractor's work as it is performed and furnished have been exhaustive, extended to every aspect of Contractor's work in progress, or involved detailed inspections of the Work beyond the responsibilities specifically assigned to Kimley-Horn in this Agreement. Neither Kimley-Horn's review of Contractors work for the purposes of recommending payments nor Kimley-Horn's recommendation of any payment including final payment will impose on Kimley-Horn responsibility to supervise, direct, or control Contractor's work in progress or for the means, methods, techniques, equipment choice and usage, sequences, or procedures of construction of safety precautions or programs incident thereto, nor Contractor's compliance with Laws and Regulations applicable to Contractor's furnishing and performing the Work. • Project Close Out: Kimley-Horn shall review the project with the City to determine if the project is substantially complete and conduct a final review to determine if the work has been completed In x -r- . ... �E'+�C�ts��oac"��t�e,��l�s�t�i�n3a EXHIBIT "B" ley)))r Mrs. Cassi Waren July 14, 2023, Page 7 accordance with the Contract Documents, if the Contractor has fulfilled all of his or her obligations thereunder, Klmley-Horn will recommend, in writing, final payment and'give written notice to the City and the Contractor(s) that the work is acceptable (subject to any conditions therein expressed). Kimley-Hom will review project record drawings prepared, provided, and certified by the Contractor. Kimley-Horn shall not be responsible for the acts or omissions of any Contractor or subcontractor, any of the Contractor(s)' or subcontractor(s)' agents or employees, or any other persons (except the Kimley- Horn's own employees and agents) at the site or otherwise performing any of the Contractor(s)' work. The following assumptions are made: 1. City reviews of submittals will be provided in a timely manner. 2. The City shall be responsible for the distribution of advertisement, RFIs and addendums. 3. Individual public information meetings or hearings are not required. 4. City shall be responsible for all permit fees. Additional Services Any services not specifically provided for in the above scope will be considered additional services and can be performed at our then current hourly rates or for a pre -negotiated fee. Additional services we can provide include, but are not limited to, the following: • Meetings and coordination beyond that specifically outlined above. • Major redesign effort due to changes in the overall project scope, budget, or programming after the conceptual design phase. • Development Review Committee submittals. • Preparation of Contract Documents for the improvements. • Preparation of technical specifications. • Additional permitting beyond that specifically outlined above. • Geotechnical engineering. • Environmental engineering (Phase I/Phase 11) • Traffic Studies or traffic engineering services • Dewatering permitting • Services not specifically mentioned in the "Scope of Services" We will provide our services within a reasonable length of time to meet a mutually agreed upon schedule. The Client shall provide us with access to the property. Billings will be monthly based on the progress of the Task. All provisions are in accordance with the terms and conditions of the continuing services agreement per Request for Qualifications for "Mullikin Park Improvements; RFQ No 23-005" between the City of Dania Beach and Kimsey -Horn and shall govern this agreement as applicable. Fees and times stated in the agreement are valid for sixty (60) days after the date of this letter.
