HomeMy WebLinkAboutR-2023-088 Beach Parking Amended Fee ScheduleRESOLUTION NO.2023- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, PURSUANT TO SECTION 6-33 OF THE CITY'S CODE OF ORDINANCES THAT THE CITY ADOPT AN AMENDED BEACH PARKING FEE SCHEDULE; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Community Development Department (the "Department") staff has evaluated existing parking fees to determine whether revisions to the fee schedule should be recommended to the City Commission; and WHEREAS, through its analysis, the Department has determined that updates should be made to the current parking fee schedule in order to remain consistent with the fees charged by surrounding municipalities with comparable facilities and services; and WHEREAS, pursuant to Section 6-33 of the City's Code of Ordinances, the City may adopt parking meter fees by resolution; and WHEREAS, the proposed Amended Fee Schedule (the "Fee Schedule") will ensure that the beach parking operation is financially sustainable and sufficient to provide for all operating and capital improvement expenditures; and WHEREAS, the proposed Fee Schedule is reasonable and is attached as Exhibit "A" and is incorporated into this Resolution by this reference and the City Commission deems it to be in the best interest of the City to adopt the Fee Schedule. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the City Commission adopts the Fee Schedule contained in Exhibit "A", which exhibit is attached and made a part of this Resolution by this reference. Section 3. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 4. That this Resolution shall become effective on October 1, 2023. Beach parking permits are issued annually to correspond with the City's fiscal year and shall not be prorated for any fraction of a year. (b) Resident: A "resident" is defined to mean a person who lives in the City and who submits the following documentation: 1. A current Florida motor vehicle registration or copy of current existing fully executed lease agreement for a vehicle registered in Florida to verify the applicant's name. If the vehicle is registered to a business name, proof of ownership must be submitted to verify the applicant's name as directly related to the business; 2. A current utility bill or voter's registration card in the same name of applicant as the vehicle registration or lease agreement showing a Dania Beach address; 3.
