RESOLUTION NO. 2023- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN (SP-034-22MOD) AND VARIANCE (VA-68-23), SUBMITTED BY FIRST DANIA BEACH LLC, FOR PROPERTY LOCATED AT 101-117 SW 1 STREET, 105, 111, 119, 125-127 SW 1 COURT, 110, 118, 124, 126 PARK AVENUE EAST IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Legislature of the State of Florida has, in Chapter 166, Florida Statutes, conferred upon local governments the authority to adopt regulations designed to promote the public health, safety, and general welfare of its citizenry; and, WHEREAS, pursuant to Chapter 28, the "Land Development Code" (the "LDC"), Part 6, entitled "Development Review Procedures and Requirements," Article 635, entitled "Site Plans" of the City Code of Ordinances (the "City Code") provides that site plan approval is required as a condition to the issuance of a building permit; and WHEREAS, First Dania Beach, LLC (the "Applicant') is requesting approval of a site plan modification for the currently approved site plan (SP-034-22) residential development which was approved for a new 278-unit residential development. The modification under site plan (SP- 034-22Mod) will add an additional 99 spaces for tenant parking for the future phase II. The property is located at 101-117 SW 1 STREET, 105, 111, 119, 125-127 SW 1 COURT, 110, 118, 124,126 PARK AVENUE EAST IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A" in the City of Dania Beach; and WHEREAS, the City of Dania Beach ("City") Code of Ordinances, Chapter 28, entitled "Land Development Code" ("LDC"), of Part 6, entitled "Development Review Procedures and Requirements," Article 625 "Variances," Section 625-40, entitled "Variance Review Criteria; City Action," states that the City Commission may grant a Variance based on its determination that the Applicant has demonstrated that the necessary criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a Variance (VA-068-23) from Sec. 265-140(C) to modify the allow the column spacing in the structured parking facility to encroach within the three (3) foot entrance of the parking space as required by Code; and WHEREAS, the requested Variance maintain the basic intent and purpose of the subject regulations, particularly as it affects the stability and appearance of the City; and WHEREAS, the requested Variance is otherwise compatible with the surrounding land uses and would not be detrimental to the community; and WHEREAS, the requested Variance ais consistent with, and in furtherance of, the goals, objectives and policies of the adopted Comprehensive Plan, as amended from time to time, and all other similar plans adopted by the City; and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the City Commission finds that the approval of the Site Plan (SP-034- 22MOD) and Variance (VA-68-23) will protect the public health, safety, and welfare of the residents of the City, and furthers the purpose, goals, objectives, and policies of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "Whereas" clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That pursuant to Chapter 28 "Land Development Regulations," Part 6 "Development Review Procedures and Requirements," Article 635 "Site Plans," the following Site Plan (SP-025-22), attached as Exhibit `B," Section 3. That pursuant to Chapter 28 "Land Development Code," Part 6 "Development Review Procedures and Requirements," Article 625 "Variances," the following Variance Application (VA-019-23) is approved consistent with the Site Plan provided in Exhibit `B". Section 4. That the approvals granted by this Resolution are subject to the Applicant's compliance with the following conditions: 1. Sheet A105- Provide a note stating that the hydrants won't be blocked by a metal fence. NFPA 1:18:5.7 2018 ED (FIRE). 2. Sheet C1- There are two hydrants provided on SW 1 Ave. Need to provide two FDC's per NFPA 14:7.12.2 2016 ED. Note: There is an FDC shown on the west side of the project that has no hydrant within a hundred feet; a note is shown stating the existing hydrant is being removed. No proposed hydrant is shown NFPA 14:6.4.5.4 2016 ED (FIRE). 2 RESOLUTION #2023- 5 3. Sheet Cl- All FDC's needs to be within 100 feet of the hydrants. Provide distance between hydrant and FDC. NFPA 14:6.4.5.4 2016 ED (FIRE). 4. Sheet C3- Provide a note stating the hydrant on the adjacent property shown to the North, will not be used as part of your project. NFPA 1:4.5.1 2018 ED (FIRE). 5. Sheet A100 and C3- Proposed hydrant as stated on sheet A100 not shown only a note stating existing hydrant to be removed. Sheet C3- No proposed hydrant location shown either as stated on sheet A100. NFPA 1:18.5 2018 ED Sheet C3- Clarify all watermain sizes, in passed meetings it was discussed that a 12" and 10" water main where being installed to provide sufficient water. Sheet C3- shows 6" mains. Demonstrate how the transition is taking place. Which lines being abandon and new lines installed? (FIRE). 6. Note: Provide a waterflow test after the new mains and hydrants have been installed. NFPA 1:4.5.1 2018 ED (FIRE). 7. Payment of Recreation and Open Space Impact Fee to be paid at the time the building permit. The impact fee is $1,364 for each multifamily units, which results in the Park Impact fee of $379,192.00 (Planning). 8. The developer is required to participate in the City's Public Art program by payment into the City's Public Art fund or through payment and instillation of public art. The amount of the Public Art Fund contribution is dependent on the value of the construction which will be established at time of building permit submittal (Planning). 9. The KBP Consulting Traffic Impact Analysis signed and dated April 6, 2022, identifies 75 PM Peak Hour Trips for the 101 Dania Apartments site plan. Therefore, $1,594.50 (75 trips X $21.26) is due prior to issuance of a building permit (Planning). 10. Updated narrative not provided as noted in response comments (Planning). 11. Provide previously requested clouding on cover sheet to denote which sheets are modified in index (Planning). 12. As previously requested - Provide copy of previously approved plan sheets, followed by proposed plan sheet. Label sheets "approved" and "proposed". Cloud changes on proposed plan sheets (Planning). 13. Based on plan sets available in CAP — dated April 2022 and uploaded 8/8/22, numerous other changes on various floors not captured in subject application. For example, second and third floor. Confirm if this is the approved plan set and update application as necessary (Planning). 14. Additional information required to mitigate discrepancies throughout plan set and reconcile apparent conflicts between plan sheets and data (Planning). 15. Tabular data shows 13 stories were approved and 13 stories are proposed. However, project is intended to add a level. Approved plan set section cut and other plan sheets show 12 levels approved. Provide additional clarification. a. Defer to city regarding required modifications to incentive approvals for additional height (Planning) 16. Building height is shown as being reduced between "approved" and "proposed". This does not correlate to an addition of one level. a. "approved" height shown at 150'. This does not correlate to plan set noted above. Provide copies of approved sheets ahead of proposed sheets as previously requested (Planning). 17. Tabular data on 4 floor should depict approved and proposed parking conditions. Changes appear to be made to two ADA spaces and to include the bridge. Ensure this is included in the narrative (Planning). 3 RESOLUTION #2023- 18. Elevations show changes to the upper story. Not reflected in first iteration of narrative. Describe changes in narrative (Planning). 19. Roof changes acknowledged. Update narrative to reflect scope (Planning). 20. Parking tabular data should show approved and proposed conditions. Confirm if shared parking analysis is also updated (Planning). 21. Demonstrate continued compliance with Sec. 303-40.P (Planning). 22. Additional dimensions required to demonstrate compliance with Sec. 265-140 (Planning). 23. Confirm if drive aisle width reduction was approved via variance as part of previous approval (Planning). 24. Wholesale elevation modifications noted between 8/22 plan set and current plan set. Address and update narrative as necessary. a. Confirm if changes are proposed to balcony design. b. Confirm no changes are proposed to setbacks (Planning). 25. Elevations do not show proposed bridge connection. Show bridge and label as Phase II improvement (Planning). 26. If the adjacent project undergoing the permitting process, City Place, does not proceed, then the Developer is required to construct all proposed watermain improvements to support this project (Engineering). 27. The Developer is required to design, permit, construct, and certify a new 12-inch watermain from the intersection of SW 1 Street and SW 1 Avenue to the existing 12-inch watermain to the north (Engineering). 28. Connection to the gravity sanitary sewer system is not permitted. An onsite lift station will be required (Engineering). 29. The Developer is required to design, permit, construct, and certify a force main that connects to the existing City's 10-inch force main on Dania Beach Boulevard (Engineering). 30. The installation of a 12-inch watermain may be necessary from the intersection of SW 1 Street and SW I Avenue to the 12-inch watermain on Stirling Road (Engineering). 31. A root barrier shall be installed adjacent to the exfiltration trench to deter the roots from the trees located in the planters entering the trench and perforated pipe along SW 1 Street (Engineering). 32. Demolition Plan and Erosion Control Plan and details are required at building permitting (Engineering). 33. Additional comments may apply and will need to be addressed prior to Building Permit approval (Engineering). 34. The Site Plan approval shall be concurrent with variance approval(s). 10. In accordance with City Code of Ordinances in Article 415. SIDEWALKS AND SWALES, Owner is responsible for the construction of sidewalks / swales within the road ROW when buildings are constructed or substantially improved (Engineering). 35. Provide BC standard details for pavement marking and signage. All traffic control signs shall conform to Broward County Traffic Engineering (BCTED) and MUTCD standards. BCTED signs specifications consist of Type XI retroreflective sheeting materials except for school zone and pedestrian signs which shall be comprised of retroreflective fluorescent yellow -green sheeting certified type IV (Engineering). 36. All pavement markings shall be alkyd -based thermoplastic and fully retroreflectorized, per BCTED specifications with the exception of parking stall striping (Engineering). 4 RESOLUTION #2023- 37. Provide Maintenance of Traffic (MOT) Plan by a licensed General Contractor/Professional Engineer in the State of Florida (if applicable) (Engineering). 38. Detail and complete engineering plans will be required prior to Building and R/W permit approval (Engineering). 39. Provide utility piping conflict details plan, along with documentation to demonstrate acceptability of the separation between water, sanitary, storm -water service lines, etc. (Engineering). 40. Show also all existing and proposed utilities on the landscaping plans for potential conflicts (Engineering). 41. Provide ADA parking, access / driveway, and sidewalks /ramps including dimensions in accordance with Chapter 553 of the Florida Statutes. "Accessibility of Handicapped Persons" and latest edition of "Accessibility Requirements Manual" by Department of Community Affairs, Florida Board Building Codes and Standards, and'in accordance with Americans with Disability Act (ADA) (Engineering). 42. Provide drawing file (dwg or dgn) disk of the approved site plan in Florida State Plane Coordinate (NAD 83). This should be addressed as part of the final submittal (Engineering). 43. Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable) as part of the final submittal, prior to issuance of the Building Permit (South Florida Water Management District (SFWMD), Broward County Surface Water License, Broward County EPGMD Wastewater Permit / BC Water and Wastewater Approval, Florida Department of Environmental Protection, FDOT, BC Environmental, BC Aviation, BCTED etc.). Also, include Utility / Right of Way Permits from City, Broward County, and State Roads as applicable (Engineering). Section 5. That pursuant to Section 635-100 "Expiration of Site Plans" of the Land Development Code, Site Plan (SP-025-22) and Variance (VA-019-23) approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings for the improvements shown on the Site Plan, within eighteen (18) months from the date of this Resolution. Section 6. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 7. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 8.
