HomeMy WebLinkAboutO-2020-010 Repealing Obsolete Cemetery Ordinances No. 293 and No. 102ORDINANCE 2020-010 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, REPEALING ORDINANCE 293 DATED OCTOBER 30, 1952, RELATING TO THE RULES AND REGULATIONS FOR CITY OWNED CEMETERIES AND ORDINANCE 102 DATED AUGUST 24, 1976, RELATING TO AN OBSOLETE FEE SCHEDULE AS WELL AS RULES FOR INSTALLATION AND DISPLAY OF MARKERS FOR CEMETERIES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach adopted Ordinance 293, on October 30, 1952, which ordinance established rules and regulations for the City's cemeteries; and WHEREAS, the City also adopted Ordinance 102, on August 24, 1976, which provided a fee schedule and rules for installation and display of gravesite markers for the City's public cemeteries; and WHEREAS, these ordinances are obsolete in application; and WHEREAS, the City is seeking to update its rules and regulations relating to the operation of City cemeteries, and update its rules relating to individual plots but seeks to do so via resolution rather than by ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Ordinance 293, dated October 30, 1952, relating to the rules and regulations for City cemeteries, and Ordinance 102, dated August 24, 1976, relating to an obsolete fee schedule and displays of markers for cemeteries are repealed. Section 2. That if any section, clause, sentence or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this Ordinance are repealed. Section 4. That this Ordinance shall be effective immediately at adoption on second reading. PASSED on first reading on June 23, 2020. PASSED and ADOPTED on second reading on July 28, 2020.
