A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, RETROACTIVELY APPROVING THE WAIVER OF
THE COMPETITIVE BIDDING REQUIREMENT FOR CITYWIDE
EMERGENCY PUMPING SERVICES WITH KAILAS CORP. IN AN
AMOUNT OF SEVENTY-FIVE THOUSAND THREE HUNDRED THIRTY-
SIX DOLLARS ($75,336.00); PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4,
Subsection 0), authorizes the City Manager to purchase supplies, services, equipment and
materials for the City government in amounts in excess of the established monetary threshold
without competitive bidding and without advertising for bids if he/she is authorized to do so in
advance by a resolution adopted by the City Commission; and
WHEREAS, the Dania Beach Code of Ordinances, Chapter 2, Article 1, Section 2-10,
"Monetary thresholds for certain purchases and payment disbursement authorizations",
Subsection (a), sets the monetary threshold at $50,000.00 for a vendor each fiscal year; and
WHEREAS, the City experienced an unforeseen heavy rainstorm on October 1st, 2023
which caused flooding citywide; and
WHEREAS, Kailas Corp. was contacted for additional vac -con trucks and pumps to
assist with pumping out rainwater from flooded streets; and
WHEREAS, having received these services, the Public Services Department is requesting
City Commission approval to retroactively waive the competitive bidding requirement for
citywide pumping services and to approve such services with Kailas Corp. in the amount of
$75.336.00; and
WHEREAS, to assure the expeditious provision of these services in the future and avoid
the waiver of competitive bidding, PSD is currently in the process of awarding ITB BID No.
2023-007- "Storm Sewer and Sewer Main Cleaning and Repair Services" for future cleaning and
repair services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the above "Whereas" clauses are ratified and confirmed, and they are
made a part of and incorporated into this Resolution by this reference.
Section 2. That the City Commission authorizes waiver of competitive quotes for
emergency pumping services provided by Kailas Corp. in an amount $75,336.00, which exceeds
the City annual threshold purchasing policy in the amount of Fifty Thousand Dollars ($50,000.00)
for a single vendor.
Section 3. That funds will be appropriated from the Stormwater Contractual Account
No. 403-3 8-01-53 8-34-10.
Section 4. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 5. That this Resolution shall be effective 10 days after passage.
