A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, COMPLYING WITH SECTION 166.0451, FLORIDA
STATUTES BY HOLDING A PUBLIC HEARING AND CREATING A LIST
OF PROPERTIES OWNED BY THE CITY AND THE CRA, WHICH
PROPERTIES MAY BE AVAILABLE FOR AFFORDABLE HOUSING
PURPOSES (30 % TO 120% AMI); AND BY PROVIDING FOR BEST
PRACTICES IN UTILIZING THE LISTED PROPERTIES FOR AFFORDABLE
HOUSING PURPOSES; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Florida Legislature approved Senate Bill 102, and the Governor
executed Senate Bill 102, also known as the "Live Local" statute, now codified at Florida Statute
Section 420.50872; and
WHEREAS, the Live Local statute at Florida Statutes Section 166.0451, entitled"
Disposition of municipal property for affordable housing" to prepare and every three (3) years
thereafter, prepare an inventory list of all real property within its jurisdiction to which the City or
any dependent special district within its boundaries holds fee simple title which that is
appropriate for use as affordable housing; and
WHEREAS, the inventory list must include the address and legal description of each
such property and specify whether the property is vacant or improved; and
WHEREAS, the City is to hold a public hearing regarding the list of available properties
that can be sold or subject to a long-term lease for affordable housing purposes (30% to 140%
AMI); and
WHEREAS, following the public hearing, the governing body of the City shall adopt a
resolution that includes an inventory list of such property, and the City shall make the inventory
list publicly available on its website to encourage potential development; and
WHEREAS, the City is encouraged by the State of Florida to adopt best practices for
surplus land programs, including, but not limited to: (a) Establishing eligibility criteria for the
receipt or purchase of surplus land by developers; (b) Making the process for requesting surplus
lands publicly available; and (c) Ensuring long-term affordability through ground leases by
retaining the right of first refusal to purchase property that would be sold or offered at market
rate and by requiring reversion of property not used for affordable housing within a certain
timeframe; and
WHEREAS, adoption of this Resolution is in the best interest of the residents of the City
of Dania Beach, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. Recitals. That the above recitals are true and correct and are incorporated
by this reference.
Section 2. List of Properties Available for Affordable Housing. The City of Dania
Beach lists its properties that may be available for long term lease or sale for affordable housing
purposes are found at Exhibit A, attached to and incorporated by reference into this Resolution.
Section 3. Best Practices. The City adopts the State of Florida recognized best
practices for its surplus land programs, including, but not limited to:
(a) Establishing eligibility criteria for the receipt or purchase of surplus land by
developers:
(i) Developer to have experience in providing any of the following types of
affordable housing:
• Extremely low income — earning up to 30% AMI (at or below $ 23,500);
• Very low income — earning from 30.01 to 50% AMI ($23,501 to $39,150);
• Low income — earning from 50.01 to 80% AMI ($39,151 to $62,650); and
• Moderate income — earning from 80.01 to 120% of AMI ($62,651 to $94,000).
(ii) That the Developer have connections for home ownership funding or rental
subsidy;
(b) Making the process for requesting surplus lands publicly available by issuing public
procurement, whether a request for proposal, or other mechanism, with a covenant
running with the land requiring the affordable housing component be complied with
or the property would be reverted to the City; and
(c) Ensuring long-term affordability through ground leases by retaining the right of first
refusal to purchase property that would be sold or offered at market rate and by
requiring reversion of property not used for affordable housing within a certain
timeframe (18 months).
Section 4. Effective Date. That this Resolution shall become effective 10 days after
adoption.

ORDINANCE NO. 2023-
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, AUTHORIZING THE EXPENDITURE OF CITY FUNDS
EXCEEDING ONE MILLION DOLLARS ($1,000,000.00), WHICH
EXPENDITURE IS NOT TO EXCEED THE PROJECT ESTIMATE OF
SIXTEEN MILLION EIGHT HUNDRED FIFTEEN THOUSAND EIGHT
HUNDRED FIVE DOLLARS AND TWENTY-FOUR CENTS ($16,815,805.24)
AS APPROVED BY THE CITY COMMISSION, TO FUND THE SOUTHEAST
DRAINAGE RETROFIT PROJECT, PHASE I; PROVIDING FOR
CODIFICATION, PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Section 2, "Certain Expenditures" of Article 3, "Powers of the
City", of the City Code of Ordinances, the City Commission must, by ordinance approve any
expenditures of City funds that exceed One Million Dollars ($1,000,000.00) after two (2)
advertised public hearings of the ordinance; and
WHEREAS, the City -issued Invitation to Bid ("ITB") No. 23-014 for the "Southeast
Drainage Retrofit Project, Phase I" exceeds the monetary threshold of $1,000,000.00; and
WHEREAS, the project expenditure shall not exceed the bid amount of Sixteen Million
Eight Hundred Fifteen Thousand Eight Hundred Five Dollars and Twenty -Four Cents
($16,815,805.24) for the Southeast Drainage Retrofit Project, Phase I.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the above "WHEREAS" clauses are ratified and confirmed as being
true and correct, and they are made a part of and incorporated into this Ordinance by this reference.
Section 2. That the proper City officials are authorized to expend more than One
Million Dollars ($1,000,000.00) in funding the Southeast Drainage Retrofit Project, Phase I.
Section 3. That the Florida Department of Environmental Protection Grant Program
funds in the amount of $3,480,000.00, and the Broward County Transportation Surtax funds in
the amount of $7,212,000.00 be appropriated to account number 402-35-28-535-63-10. In
addition, the balance of funds, in the amount of $6,123,805.24 to equal $16,815.805.24 to fund the
Southeast Drainage Retrofit Project, Phase 1, will come from the City's American Rescue Plan
Act funds, reserves, and potentially new debt financing.

Section 4. That all ordinances or part of ordinances in conflict with the provisions of
the Ordinance are repealed.
Section 5. That this Ordinance shall be effective immediately at adoption on second
reading.
