HomeMy WebLinkAboutR-2023-154 Retroactive Approval of Mutual Aid Agreement with City of Miami BeachREsoLUrroN No. 2ox--l 5Ll A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A RETROACTIVE AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND THE CITY OF DANIA BEACH, PROVIDING FOR MUTUAL AID EMERGENCY SERVICES; PROVIDING FOR CONFLICTS; FTIRTHER. PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, The Emergency Management Act, Chapter 252, Florida Statutes provides each local govemment of the state the authority to develop and enter into mutual aid agreement within the state for reciprocal emergency aid in case of emergencies too extensive to deal with unassisted and to concenhate available resources where needed; and WHEREAS, on April12,2023,the City of Dania Beach was severely affected by flooding, leading to significant damage across the city, and a number of areas in Dania Beach were submerged in several feet of water, which persisted for many days; and WIIEREAS' in response to the crisis, the City of Miami Beach offered assistance to the City of Dania Beach, which was accepted by the City; and WHEREAS, the City of Miami Beach has requested reimbursement for the expenses incurred in providing this assistance, which complies with FEMA labor regulations and equipment rates, and FEMA has agreed to reimburse the costs incurred, provided a mutual aid agreement between the two cities is retroactively approved; and WHEREAS, the City Administration requests that the City Commission retroactively approve the mutual aid agreement and authorize payment to the City of Miami Beach for services rendered in times of need. NOW, THERET'ORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF'DANIA BEACH, FLORIDA: Section 1. That the above "whereas" clauses are true and correct, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. section 3. That the mutual aid agreement between the city of Miami Beach and the city of Dania Beach be retroactively approved to March 1,2023, and payment in the amount of Thirty-Five Thousand Four Hundred Four Dollars and Eight cents ($35,404.08) may be issued to the City of Miami Beach for services provided during the April flood. section 4.
