A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH. FLORIDA. AUTHORIZING THE PROPER CITY OFFICIALS TO
AMEND THE AGREEMENTBETWEEN THE CITY OF DANIA BEACHAND
BURKHARDT CONSTRUCTION. INC.. INCREASING THE TIME PERIOD
FOR PRECONSTRUCTION SERVICES BY UP TO 120 DAYS, UNDER THE
CONSTRUCTION MANAGER AT RISK AGREEMENT FOR C.W. THOMAS
PARK IMPROVEMENTS; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FORAN EFFECTIVE DATE.
WHEREAS, on September 14,2022 the City Commission approved Resolution No 2022-
144 afihorizing the Agreement with Burkhardt Construction Inc., to provide Construction
Management at Risk Services for the C.W. Thomas Park improvements; and
WHEREAS, the project architect, Bermello Ajamil & Partners, Inc., are completing the
90-100 percent construction documents; and
WHEREAS, Burkhardt is currently conducting the preconstruction services portion of
their agreement, and the preparation of the Guaranteed Maximum Price (GMP) is to be provided
to the City within 90 days of receiving the 90 percent construction documents, and within270 days
of the start of the preconstruction services; and
WHEREAS, Burkhardt is at 240 days and has not received the final construction
documents which are needed to prepare the GMP; and
WHEREAS, Burkhardt and Bermello Ajamil agree to continue working together and are
seeking up to a 120 day extension of the preconstruction services deadline to prepare and submit
the GMP proposal to the City and to negotiate the final cost.
NOW, THEREFORE, BE IT RESOLVED BY TITE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the above "Whereas" clauses are ratified and confirmed, and they are
made a part ofand incorporated into this Resolution by this reference.
Section 2, That the proper City officials are authorized to amend the underlying
Agreement to provide an additional 120 days for the Burkhardt Construction, Inc. for
preconstruction services, allowing time to prepare and submit the GMP proposal to the City and
negotiate the final project cost.
Section 3. That the City Manager and City Attomey are authorized to make minor
revisions to the Amended Agreement which are deemed necessary and proper and in the best
interest ofthe City and to execute extensions that do not alter costs or scope of the agreement.
Section 4. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 6. That this Resolution shall become effective within ten (10) days of its
passage and adoption.
