FLORIDA. AUTHORIZING THE PROPER CITY OFFICIALS TO APPROVE TWO CHANGE ORDERS TO MODIFY THE SCOPE OF THE AGREEMENT WITH INDUSTRIAL MAINTENANCE SERVICES, TNC. FOR CONCRETE CRACK REPAIRS AND ELECTRICAL PANEL REWIRING AND IMPROVEMENTS FOR THE DANIA BEACH PIER REPAIR PROJECT; AUTHORIZING THE USE OF PREVIOUSLY AUTHORIZED FLTNDS IN THE AMOUNT OF FIFTY THOUSAND TWO HTJNDRED ELEVEN DOLLARS AND TWENTY-SIX CENTS ($50,21I.26) THAT IS WITHIN THE APPROVED CONTINGENCY FOR THE LTNDERLYING CONTRACTI PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach Pier Repair Project has been active for over one year and is nearing completion, and; WHEREAS, during the project's work, significant concrete cracks in the pier undercarriage were discovered which required immediate repair to ensure structural integrity and public safety; and WHEREAS, it was also found that the electrical wiring near the restaurant entering the pier required re-configuring and better protection from water intrusion and it's potentially harmful effects, including short circuiting that severely impacts restaurant operations; and WHEREAS, the Project's contractor, Industrial Maintenance Services, Inc. (lMS) was already on-site, familiar with the pier, and fully capable of performing the required repairs and installations: and WHEREAS, due to the structural integrity concems the work was performed, even though the scope of work was not part of the original project; and WHEREAS, the Public Services Department recommends approval of two Change Orders totaling $50,211.26, which exceeds the City Manager's authority if it was a new project, and which funding can be paid from the $100,000 in authorized contingency funds (authorized pursuiult to City Resolution No. 2021-193, dated December 14,2021, but as the scope of work was not contemplated in the original agreement, the City Commission must authorize the modified the scope of work to include the work identified in the Change Orders. NOW. THEREFORE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH. FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct, and they are made a specific part of and incorporated into this Resolution by this reference. Section 2. That the proper City officials are authorized to approve two Change Orders for concrete crack repairs and electrical rewiring and new conduit installation for the Dania Beach Pier Repair Project, contmcted by Industrial Maintenance Services, Inc. (IMS), in the amount of Fifty Thousand Two Hundred Eleven Dollars and Twenty-Six Cents ($50,211.26), a copy of which is attached as Exhibit "A". Section 3. That the firnds for these Change Orders will be sourced from the approved contract amount allocated from the Pier Infrastructure other than Bldgs. Account No. 415-72-15- 572-63-10, for the Dania Beach Pier Repair Project. No outside funding will be required. Section 4. That all resolutions or parts of resolutions in conflict with this Resolution shall be repealed to the extent of such conflict. Section 5.
