HomeMy WebLinkAboutR-2023-161 Automated Infrastructure Meter SystemREsoLUrroN *o. rorr- i\01 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING A DRINKING WATER STATE REVOLVING Ftn{D PLANNING LOAN AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION FOR THE DESIGN OF AN ADVANCED WATER METER READING SYSTEM (AMR) AND AUTOMATED METER INFRASTRUCTURE SYSTEM (AMI); PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on September 13,2023, the City Commission of the City of Dania Beach adopted a resolution declaring its intent to apply for s State Revolving Fund loan for the planning and design of an Advanced Water Meter Reading System (AMR) and an Automated Meter Infrastructure System (AMI); and WHEREAS, Florida Statutes provide for loans to local govemment agencies to finance the construction of wastewater treatment facilities; and WHEREAS, Florida Administrative Code rules require authorization to apply for loans, to establish pledged revenues, to designate an authorized representative; to provide assurances of compliance with loan program requirements; and to enter into a loan agreement; and WHEREAS, the State Revolving Fund loan priority list designates Project No. DW061240 as eligible for available funding in the amount of One Hundred Thousand Dollars ($100,000.00); and WHEREAS; the City intends to enter into a loan agreement with the Department of Environmental Protection under the State Revolving Fund for project financing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF'THE CITY OF'DANIA BEACH, FLORIDA: Section l. That the above "Whereas" clauses are ratified and confirmed as being true and correct, and they are made a part ofand incorporated into this Resolution by this reference. Section 2. The revenues pledged for the repayment of the loan are net water and sewer system revenues. Section 3. The City Manager is hereby designated as the authorized reprcsentative to provide the assurances and commitments required by the loan application. Section 4. The Mayor and City Manager are designated as the authorized representatives to execute the loan agreement which will become a binding obligation in accordance with its tems when signed by both parties. The City Manager is authorized to represent the City in carrying out the City's responsibilities under the loan agreement. The City Manager is authorized to delegate responsibility to appropriate City staff to carry out technical, financial, and administrative activities associated with the loan agreement. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6 That this Resolution shall become effective within ten (10) days of its passage and adoption.
