HomeMy WebLinkAboutO-2019-019 Amending Sec. 2-231 Lobbyist Registration - Increasing Fee and Amending Reporting RequirementsORDINANCE NO.2019-019 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 2, ENTITLED "ADMINISTRATION", ARTICLE XI, ENTITLED "LOBBYIST REGULATIONS", SECTION 2-231, ENTITLED "LOBBYIST REGISTRATION" AND SECTION 2-232, ENTITLED "REPORTING OF LOBBYING ACTIVITIES" OF THE CITY CODE OF ORDINANCES, PERTAINING TO AN INCREASE OF LOBBYIST REGISTRATION FEES AND PERTAINING TO REPORTING REQUIREMENTS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach lobbyist registration fee was established pursuant to Ordinance No. 2004-003 adopted January 13, 2004; and WHEREAS, in keeping with current fees charged by other local municipalities, the City desires to increase the annual lobbyist registration fee from one hundred dollars ($100.00) per client to two hundred fifty dollars ($250.00) per client; also, due to changes in Broward County lobbying regulations that affect Broward cities, some City lobbyist regulations need to be revised and updated; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Article XI, entitled "Lobbyist Regulations" of Chapter 2, entitled "Administration", Section 2-231, "Lobbyist Registration", of the City Code of Ordinances, is amended to read as follows: Sec. 2-231. — Lobbyist Registration. (2) Pay to the City Qerk's Offlee Finance Department an annual One 14undr-ed Two Hundred Fiftv Dollars ($1-00. $250.00) as the registration fee for each principal or employer, identified on an annual or amended registration statement, on whose behalf he or she intends to lobby, whether he or she was retained directly by the principal or employer or by another Lobbyist retained by the principal or employer. The registration fees required by this Section shall be expended by the City Clerk's Office solely for the purpose of defraying the administrative costs of implementing, monitoring, and otherwise ensuring compliance with this Section. A lobbyist, who is lobbying as a volunteer for a non-profit organization, without any compensation, is not required to pay a registration fee in connection with those uncompensated lobbying activities, but shall be required to register. Section 2. The name of the person or entityby which the lobbyist is employed; The name of the person or entity for whom or for which the lobbyist lobbying; 2 ORDINANCE #2019-019 The name of each City Commissioner lobbied by the lobbyist; The name of each person attending or participatingin n M portion of the meeting or communication during which the lobbyingactivity occurred; The date and time of the meeting or other communication during which the lobbyingactivity occurred; The location of the meeting and mode of communication, as applicable (e.g., in person, by telephone, by email exchange; The specific subject matter discussed in such meeting or communication. lobbyists, their- prineipals or- empleyer-s otAside of the City premises. That if any section, clause, sentence or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 4. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with this Ordinance, are repealed to the extent of such conflict.
