HomeMy WebLinkAboutO-2024-005 Academy Bus and FDOT FLUM AmendmentORDINANCE NO. 2024-Ci.:5 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, SPECIFICALLY AMENDING A PORTION OF THE CITY OF DANIA BEACH FUTURE LAND USE MAP AS A SMALL-SCALE AMENDMENT; CHANGING THE FUTURE LAND USE DESIGNATION ON PROPERTY LOCATED BETWEEN RAVENSWOOD ROAD AND SW 22ND AVENUE NORTH OF SW 42ND STREET, AS LEGALLY DESCRIBED IN EXIDBIT "A", WHICH CONSISTS OF APPROXIMATELY 0.51 ACRES, CHANGING THE CURRENT FUTURE LAND USE DESIGNATION FROM (BROW ARD COUNTY) COMMERCE CATEGORY TO (CITY) INDUSTRIAL CATEGORY; AND CHANGING THE FUTURE LAND USE DESIGNATION FROM (CITY OF HOLLYWOOD) RECREATION AND OPEN SPACE CATEGORY TO (CITY) PARKS AND RECREATION CATEGORY ON PROPERTY AS LEGALLY DESCRIBED IN EXIDBIT "B", WHICH CONSISTS OF APPROXIMATELY 0.204 ACRES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, an application was filed by City of Danfa Beach (Appli cant) in which the city seeks small scale Future Land Use Map amendment of the two properties identified below, both of which prop erties were annexed into the C ity of Dania Beach in 2023; and WHEREAS, the City of Dania Beach seeks to designate a Future Land Use Designation for the property annexed into the City in September 15 , 2023 , pursuant to Broward Legislative Delegation, which is located between Ravenswood Road and SW 22nd A venue n01th of SW 42nd Street, as legally described in Exhibit "A" which consists of approximate ly 0.51 acres, by changing the current Future Land Use (FLUM) Designation from (Broward County) Commerce Category to (C ity) Industrial FLUM Category; and WHEREAS, the City seeks to designate a Future Land use Designation for the property annexed into the C ity on April 25, 2023 , pursuant to City Ordinance 2023-003, from City of Hollywood FLUM designation "Recreation And Open Space" Category to the City of Dania Beach's FLUM "Parks And Recreation" FLUM Category, for the property le gally described in Exhibit "B", which consists of approximately 0.204 acres; and WHEREAS, the small sca le FLUM des ignation application was heard and considered before th e City Commission of the City of Dania Beach and at a duly scheduled public hearing all objections, if any, were heard. ORDINANCE #2024-J:CS' NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing recitals are confirmed, adopted and incorporated herein and made a part hereof by this reference. Section 2. This application coming before the City Commission pursuant to an application filed by City of Dania Beach, and in accordance with the Florida Statutes, a Public Hearing having been held by the Planning & Zoning Board, as the Land Planning Agency, on December 20th, 2024; and the City Commission shall hold two public hearings on the FLUM amendment; and the City Commission hereby acknowledges and approves the application submitted by City of Dania Beach, the Dania Beach Future Land Use Map is hereby amended to change the Future Land Use designation from current Broward County Commerce category the City's Industrial FLUM category, and from current City of Hollywood Recreation and Open Space category to the City's Parks and Recreation category on property legally described as follows: See attached Exhibit "A " and "B. " Section 3. That if any section, clause, sentence, or phrase of this Ordinance is fOT any reason held invalid or unconstitutional by a comt of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 4. That all ordinances or pa1t of ordinances in conflict with the provisions of the Ordinance are repealed. Section 5. reading.
