HomeMy WebLinkAboutR-2024-041 Approval of Plat (PL-086-23) ABC RentalsRESOLUTION NO. 2024-illl A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE "ABC RENTALS PLAT" (PL-086-23) SUBMITTED BY THE OWNER, ABC RENTALS, INC FOR A PROPERTY LOCATED AT 2849 RAVENSWOOD ROAD IN THE CITY OF DANIA BEACH, PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 28, the Land Development Code (the "LDC") Part 6 "Development Review Procedures And Requirements," Article 640, "Plats" of the City Code of Ordinances (the "City Code"), the property owner, ABC RENTALS, INC (the "App licant"), applied to the City of Dania Beach (the "City") for approval of a Plat (PL-086-23) for property located at 2849 Ravenswood Road, legally described on Exhibit "A" and incorporated by this reference; and WHEREAS, LDC Section 640 -50 states that the City Co mmi ss ion may approve a Plat based on its determination that the Applicant has demonstrated that the criteria identified in the City Code have been satisfied; and WHEREAS, the Applicant proposes to plat the parcels of real property within the pla t boundary; and WHEREAS, the Applicant has provided sufficient justification demonstrating compliance with the approval criteria to meet the requirements of the Code; and WHEREAS, the C ity Commission conducted a duly noticed public hearing in accordance with Article 610 of the LDC; and WHEREAS, the App licant is proposing to build a Office/Warehou se on Property in the City of Dania Beach, located on 2849 Ravenswoo d Road, said Property being located within the plat limits of The ABC RENTALS PLAT; and WHEREAS, the City Commission finds that the Plat (PL-086-23) request is consistent with the City's Comprehensive Plan and Land Development Regulations. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That this certain application (PL-086-23) for plat approval is approved. Section 3. That the associated Planning & Zoning Division Staff Report prepared for the above application( s) is/are incorporated into this resolution as findings of fact. Section 4. That the issuance of a development permit by a municipality does not in any way create any right on the part of an applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the municipality for issuance of the permit if the applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. Section 5. That pursuant to Section 640-80 "Expiration of Plats," of the Land Development Code, the Plat (PL-086-23) the City Commission approval of the plat shall be deemed to have expired when the plat has expired under the Broward County Land Deve lopment Code. Section 6. That the approvals granted by this Resolution are subject to the Applicants' compliance with the following conditions: 1. Broward County approval of the Plat is required prior to issuance of a Building and Right-of-Way permit. (Engineering) Section 7. That a ll resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 8.
