AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, ADOPTING AN AMENDMENT TO THE CITY OF
DANIA BEACH COMPREHENSIVE PLAN RELATING TO THE
LOCATION OF SCHOOL FACILITIES WITHIN THE CITY OF DANIA
BEACH; PROVIDING FOR CONFLICTS; PROVIDING A SEVERANCE
CLAUSE; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA THAT:
Section 1. The comprehensive plan amendment attached as Exhibit "A" is
incorporated by this reference and is adopted as an ordinance by the City, as
prescribed by Section 163.3184(15)(a), Florida Statutes.
Section 2. The Director of Growth Management is authorized to take the necessary
steps to transmit the Plan to the State Land Planning Agency, the Florida Department of
Community Affairs, the South Florida Regional Planning Council, the South Florida
Water Management District, the Florida Department of Transportation, the Broward
County Planning Council, the Florida Department of Environmental Protection and to all
such other regulatory agencies as are deemed appropriate by the Director of Growth
Management.
Section 3. If any section, clause, sentence of phrase of this Ordinance is for any
• reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this Ordinance.
Section 4. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are repealed.
Section 5. This ordinance shall take effect immediately at the time of its passage and
adoption.

AMENDMENT - SCHOOL FACILITIES
• Section 163.3177(6)(a), Florida Statutes was amended in 1995 to require that local
government Comprehensive Plans include provisions addressing land use issues related to
future public school facilities needs. Section 163.3177(6)(a), Florida Statutes was
amended further in 1998 to require that local governments amend their Comprehensive
Plan to include the following:
• Identification of those future land use map designations that allow public school
facilities;
• Criteria that encourage the location of schools in close proximity to residential areas
and,
• Policies related to collocation of schools with other public facilities such as parks,
libraries and community centers.
The City transmitted the proposed school amendment in August, 1999. The City received
the attached letter from the Florida Department of Community Affairs dated September
29, 1999 which indicates no objections to the proposed amendment. The Department
asked that the City consider the Broward County School Board's concerns regarding
expanding the permissibility of schools and additional future land use categories. Terry L.
Virta, AICP, former Director, Growth Management Department; and Leigh R. Kerr,
AICP, Planning Consultant met with the School Board staff to outline the concerns of the

City Commission as it regards expanding the future land use categories. The school board
staff understood the City's position and has no further objection.
Staff recommendation: We recommend adoption of the attached additional goals,
policies and objectives to be included in the City's Comprehensive Plan.

AMENDMENT TO THE
FUTURE LAND USE ELEMENT
CITY OF DANIA BEACH COMPREHENSIVE PLAN
• Policy 2. 1
Facilities and services will meet the levels of services outlined in the Comprehensive
Plan Elements.
Policy 2.2
All facilities will be available and consistent with concurrency requirements as per
Section 163.3180 Florida Statutes (1993) and Rule 9J-5.055 Florida Administrative
Code (1989).
Objective III
Available land suitable for the provision of community facilities to support the
existing/projected population has been identified.
Policy 3. 1
New development shall provide for utility and community facility sites in accordance
with the level of service standards of the Comprehensive Plan.
Policy 3.2
New park and recreational facilities shall be supplied and timed with new growth in
accordance with the level of service standards of the Comprehensive Plan.
Policy 3.3
Dania Beach shall provide for a minimum of three (3) acres of Community level
parks for every 1,000 existing and projected permanent residents. The acreage that
may be used to meet this requirement is listed in the "Community and Regional
Parks" subsection of the Plan Implementation Requirements section of the Broward
County Land Use Plan.

Policy 3.4
Dania Beach shall adopt and implement those procedures and practices necessary to
meet or exceed the minimum parks and open space standards contained with the
Broward County Land Use Plan
(B.C.P. 905.02.03)
Policy 3.5
Dania Beach shall address, within its development codes and regulations, the
protection of existing and designated parks, recreation and open space lands to
ensure such lands are protected from future development.
(B.C.P. 405.02.04)
Policy 3.6
Dania Beach shall continue to permit public schools (defined for the purpose of
the land use element to mean public schools K through 12), which are classified
by this Plan as a type of community facility, in the following land use
categories.
a. Residential
b. Community Facilities

Policy 3.7
Dania Beach will utilize the following Broward County School Board land area
guidelines for individual school facilities.
a. elementary school: 12 acres
b. middle school: 20 acres
c. high school: 45 acres
Policy 3.8
Collocation of public schools with other community facilities will be considered
when:
a. New or replacement schools are funded in the School Board's Capital
Budget and are adjacent to other existing public facilites.
b. New facilities are funded in the City's Capital Improvement Element and
can be located adjacent to public schools and/or
c. Joint use projects are created and implemented.
Policy 3.9
Dania Beach will encourage the collocation of public facilities such as libraries,
parks and community centers with public schools to the extent practical and
financially feasible. The following criteria shall be considered for collocating
public scholls and public facilities.
a. Availability of vacant land of suitable size and dimensions for the collocated
public uses;
b. Compatibility of the collocated public uses with the adjacent land uses (ex:
noise, odors, glare, debris, dust, traffic, high voltage transmission lines, etc.)
and the compatibility of the collocated public uses' future land use
designation(s) with the future land use designations of adjacent uses;
c. Availability of infrastructure, public services, (ie: roadways, public transit,
potable water, sanitary sewer, drainage, and aquifer recharge) and utilities
(electricity, gas, etc.);
d. Environmental limitations (ie: wetlands, uplands, soil conditions,
contaminated sites, potential brownfield sites, etc.);
e. Access approaches, inlcuding roadways, public transit, bikeways,
recreational trails and pedestrianways;
f. Proximity to residential areas, particularly urban residential areas, and
areas of very low, low and moderate housing; and
g. Demographic base for purposes of encouraging diversity.
Policy 3.10
Dania Beach shall incorporate provisions in the Land Development Code
requiring new nonresidential, located adjacent to an existing or planned public
school site, to incorporate features such as walls, solid hedges or increased
setbacks where such use would be incompatible with the public school.
Policy 3.11
Dania Beach shall incorporate provisions in the Land Development Code
which provided for safe pedestrian and bicycle access to schools.
Policy 3.12
Dania Beach shall utilize the Technical Advisory Committee meetings as the
mechanism for coordinating the school collocation planning process with the
Broward County School Board.

The Department has completed its review of the proposed Comprehensive Plan
Amendment for the City of Dania Beach (DCA No. 99PS 1), which was received on August 12,
1999. Copies of the proposed amendment have been distributed to appropriate state, regional and
® local agencies for their review and their comments are enclosed.
The Department has reviewed the proposed amendment for consistency with Rule 9J-5,
Florida Administrative Code (FAC), Chapter 163, Part II, Florida Statutes (F.S.), and the adopted
County Comprehensive Plan. The Department raises no objections to the proposed amendment,
and this letter serves as the Department's Objections, Recommendations and Comments Report.
Comments from the Broward County School Board encourage the City to modify policy language
to allow schools in additional Future Land Use categories. The Department suggests the Citv_
coordinate with the School Board to resolve its concerns with this amendment.
This letter and the enclosed external agency comments are being issued pursuant to Rule
9J-11.010, FAC. Upon receipt of this letter, the City has 60 days in which to adopt, adopt
with changes, or determine that it will not adopt the proposed amendment. The process for
adoption of local comprehensive plan amendments is outlined in s. 163.3184, F.S., and Rule
9J-1 I.011, FAC. The City must ensure that all ordinances adopting comprehensive plan
amendments are consistent with the effective date provisions of Chapter 163, F.S.
Within ten working days of the date of adoption, the City_ of Dania Beach must submit the
following to the Department:

® School Board staff has reviewed the City of Dania Beach proposed policies on school
siting and does not have any objections to the policies. However, in addition to the
two proposed land use categories where public schools will be permitted uses
(Residential and Community Facilities), staff requests that the City consider permitting
public schools in the following land use categories: Commercial. Office, Employment
Center and Light Industrial. Permitting public schools in the suggested land use
categories saves the District time and efforts and provides the flexibility in acquiring
urgently needed sites to address school overcrowding in Broward County.

Dear Mr. Eubanks:
According to this agency's responsibilities under sections 163.3177 and 163.3178, Florida Statutes,and
Chapter 9J-5, Florida Administrative Code,we have reviewed the above document to decide if data
regarding historic resources have been given sufficient consideration in the request to amend the Dania
Beach Comprehensive Plan.
The proposed text amendment to the Future Land Use Element regarding school siting was reviewed to
consider the potential effects of this action on historic resources. While our cursory review suggests that
the proposed changes may have no adverse effects on historic resources, it is the city's responsibility to
ensure that the proposed revisions will not have an adverse effect on significant archaeological or historic
resources in Dania Beach.
In sum, it is our opinion that the amended comprehensive plan meets (although known and potential historic
resources need to be carefully considered in the planning phases of proposed land use changes)the state of
Florida's requirements as promulgated in sections 163.3177 and 163.3178, F.S., and Chapter 9J-5, F.A.C.,
regarding the identification of known historical resources within their specified area of jurisdiction, and for
the establishment of policies, goals and objectives for addressing known and potentially significant
historical resources in Dania Beach.

Introduction
On August 13, 1999 staff received proposed amendment #99-PS1 to~ the City of Dania Beach
Comprehensive.Plan for review of consistency with the Strategic Regional Policy Plan for South Florida (SRPP) ,Staff review is•undertaken pursuant_to the Local"Government Comprehensive
Planning and Land Development Regulation Act,Chapter 163,Part II,.Florida Statutes,and Rules
9J-5 and 9J-11,'Florida Administrative Code(F.A.C.).
Community Profile
In 1905, the City of Dania Beach became the first municipality incorporated in what is now
Broward County (the County was not established until 1915). The settlement, originally
called ModelIo, was centered on agriculture and the railroad. The Dania Cut-off Canal,
dredged in 1918, gave the area access to the Atlantic Ocean. Through various annexations
and deannexations in its history, Dania Beach now consists of four discontiguous areas of
approximately 6.25 square miles, a 1996 estimated population of 17,320, and a population
density of 2,771 persons per square mile. The City is approximately 80% built out, with the
majority of the vacant land having an Industrial land use designation. Dania Beach has been
proactive in reducing residential densities in its Coastal High Hazard Area and providing
housing to low and moderate income residents.
Proximity to Port Everglades, Fort Lauderdale/Hollywood International Airport, two
railroads and two interstate highways gives Dania Beach a considerable competitive
advantage in attracting transportation intensive businesses. The City also contains the Dania
Jai-Alai and Vegas Express gaming attractions, the Design Center of the Americas,
downtown's many antique stores, the Graves Museum of Natural History, Outdoor World
and the International Game Fishing Association (IGFA) Center. Dania Beach intends to
attract additional marine-oriented industry along its canals and ecotourism to attractions
such as Dania Beach and Pier, Whiskey Creek Campground,John U. Lloyd State Park, West
Lake Park, and the Anne Kolb and Secret Woods Nature Centers. The majority of the City
lies within the Eastward Ho! Corridor, and urban infill and redevelopment are objectives
shared by the City and the South Florida Regional Planning Council.
