AN ORDINANCE AMENDING THE FUTURE LAND USE PLAN
ELEMENT OF THE LOCAL COMPREHENSIVE PLAN OF THE CITY
OF DANIA BEACH, FLORIDA, TO REDESIGNATE FROM
COMMERCIAL TO RESIDENTIAL MEDIUM HIGH (25) A PARCEL OF
LAND CONTAINING 2.0674 ACRES MORE OR LESS LOCATED ON
THE NORTH SIDE OF SHERIDAN STREET APPROXIMATELY 1
BLOCK EAST OF S.E. 5T" AVENUE IN THE CITY OF DANIA BEACH
AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS
ATTACHED TO THIS ORDINANCE; IN ORDER TO ALLOCATE 44
FLEX UNITS FROM FLEX ZONE 84; PROVIDING THAT ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH
THIS ORDINANCE ARE REPEALED TO THE EXTENT OF SUCH
CONFLICT; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Trafalgar Associates has made an application to amend the
local future land use plan and has requested that Dania Beach allocate 44 flex
units for the proposed development; and
WHEREAS, the City Commission desires to approve said application;
• NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF DANIA BEACH, FLORIDA:
Section 1. That the Future Land Use Element and Map is amended as
described below:
THE FUTURE LAND USE PLAN ELEMENT OF THE LOCAL
COMPREHENSIVE PLAN OF THE CITY OF DANIA BEACH, FLORIDA, IS
AMENDED TO REDESIGNATE FROM COMMERCIAL TO RESIDENTIAL
MEDIUM HIGH (25) A PARCEL OF LAND CONTAINING 2.0751 ACRES
MORE OR LESS LOCATED ON THE NORTH SIDE OF SHERIDAN
STREET APPROXIMATELY 1 BLOCK EAST OF S.E. 5T" AVENUE IN
THE CITY OF DANIA BEACH AND LEGALLY DESCRIBED IN EXHIBIT
"A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; IN
APPROVING THIS LOCAL PLAN AMENDMENT, DANIA BEACH
ALLOCATES 44 RESIDENTIAL FLEXIBILITY UNITS TO THIS
DEVELOPMENT.
Section 2. If any section, clause, sentence or phrase of this ordinance is
for any reason held invalid or unconstitutional by a court of competent

jurisdiction, the holding shall not affect the validity of the remaining portions of
this ordinance.
Section 3. All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 4. The staff shall submit this amendment to the Broward
County Planning Council for re-certification.
Section 5. This ordinance shall take effect immediately at the time of its
passage. However, this plan amendment shall not become effective until the
conclusion of the process and time frames set out in Section 163.3187(3)(a) of
the Florida Statutes and re-certification by the Broward County Planning Council.

The subject site is situated on Sheridan Street, east of Fifth Avenue and
immediately west and south of the Sheridan Ocean Club which is a multi-family
residential development. Previously the City Commission approved a small
scale amendment immediately to the east which was developed as an addition to
the Sheridan Ocean Club and provided for multi-family residential use as an infill
project . The applicant has the same intent for the subject site and is requesting
the land use amendment to enable the construction of 48 multi-family residential
units on the subject site.
The parcel is bound on the north and the east by residential development with
commercial to the west and south of the subject site across Sheridan Street.
The parcel consists of approximately 2.1 acres gross which is the basis of the
land use calculation which would result in a total of 53 units. The application
states an intention to build 48 residential units on the site.
This property is located within flexibility zone 84 which represents the portion of _.
the City east of the FEC Railroad tracks and south of the Dania Cut Off Canal.
Previously, the City Commission has approved the allocation of flexibility units
for parcels further west on Sheridan Street. Presently, there are 231 Flex Units
available within Flex Zone 84. This application would assign a total of 53 units
which would result in a balance of 178 flexibility units available for assignment to
other properties within the City.
• The use of flexibility units enables the amendment to be considered a local land
use plan amendment and not a Broward County Land Use Amendment.
However, the City's local land use plan would have to be re-certified by the
Broward County Planning Council to make the land use effective.
The applicant has analyzed the impacts on facilities and services within the
community based upon the potential commercial development that could
presently occur on the site in contrast to the proposed residential development.
The applicant has based their analysis upon 48 multi-family residential units.
There is an increase in demand on sanitary sewer; potable water, and
recreation. There has been a reduction on the impact on traffic and solid waste
demand. In addition, the residential development should provide a greater
degree of pervious area which should improve the impact on the drainage
system.
The increases on water and sewer can be accommodated by existing capacities
within the City of Dania Beach. The recreation and open space impact is
approximately a .33 acres of increased park land needed within the Community.
However, the City does meet the level of service standards identified in its
Comprehensive Plan for park and recreational lands. The impact to the school
system would result in the generation of seven (7) additional students based
® upon the generation standards established by the Broward County School

Board. This is broken down into three (3) elementary, two (2) middle and two (2)
high school level students. The schools currently servicing the site are Dania
Elementary which is approximately 200 students under enrollment; Olsen Middle
School which is approximately 300 over enrolled; and South Broward High
School which is approximately 250 students under enrolled. The impact to
Olsen Middle School is of most concern due to the fact that the school is already
over enrolled. There are no improvements planned for Olsen Middle in the
immediate future.
The proposed residential use is consistent with the goals, objectives, and
policies of the Comprehensive Plan in that it would support in-fill development
within the eastern portion of the City. The current commercial designation on
the site is adequately addressed by other commercial parcels already existing
within the area such as the northeast corner of Fifth Avenue and Sheridan
Street.
STAFF RECOMMENDATION: Approval of the land use amendment to the
Medium High (25) designation and the companion re-zoning to RM-2.
Planning and Zoning Board Recommendation:
Land Use (LUF-78-99): motion to approve failed on a tie vote (2-2).
Rezoning (RZ-79-99): motion to approved passed (3-1).

The City of Dania Beach proposes to adopt or discuss proposed changes to the City s Future Land Use Plan Map and Element and the
Szoning designations, and zoning regulations for the property_ located in the City of Dania Beach as shown on the map and further
described in the following paragraph. A discussion on these matters will be held on the following dates:
