AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, APPROVING
THE "EASTSIDE FIVE" PLAT, SUCH PROPERTY BEING LOCATED IN
THE CITY OF DANIA AND LEGALLY DESCRIBED IN EXHIBIT "A", A
COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; ACCEPTING
THE DEDICATION FOR PUBLIC USE OF ALL STREETS, HIGHWAYS
AND ALLEYS AS SHOWN ON SUCH PLAT OF "EASTSIDE FIVE";
PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,
FLORIDA:
Section 1. That the plat of "Eastside Five", an Ordinance of the City Of Dania
Beach, Florida, approving "Eastside Five" plat, such property being located in the City Of
Dania Beach and legally described in exhibit "A", a copy of which is attached to this
ordinance; is hereby accepted and approved. The City of Dania Beach consents and agrees
that such plat may be recorded in the Public Records of Broward County, Florida, upon
further approval of all agencies of Broward County, Florida, having jurisdiction in the matter.
Section 2. That the dedication for public use of all streets, highways and alleys, as
shown on the plat of "Eastside Five" Plat, is accepted by the City of Dania Beach, Florida.
• Section 3. That all ordinances or parts of ordinances in conflict with the provisions
of this ordinance are hereby repealed.
Section 4. That this ordinance shall take effect immediately at its time of passage.
PASSED and ADOPTED on first reading on the 23rd day of May, 2000.

LEGAL DESCRIPTION
The west half of the northeast quarter of northwest quarter of southwest quarter of Section 35,
Township 50 south, Range 42 East, Less the north 30 feet thereof, lying and being in Broward County
Florida, being particularly described as follows: Commence at the southeast corner of Lot 8, Block 3,
Royal Palm Vista, as recorded in Plat Book 41, page 12, public records Broward County, Florida;
thence south 01 degrees 28 minutes 09 seconds east, along the southerly prolongation of the
easterly line of said lot, for 25.00 feet to the north line of the northeast quarter (1/4 ) of the of the
northwest quarter (1/4) of the southwest quarter (1/4) of said section 35; Thence continue south 01

Rezoning Analysis
• The property is currently zoned R-M Multi-family. R-M zoning permits 3 story buildings
at 12 units per acre (The City Commission has the discretion to permit up to 5 stories
in the R-M zoning district, based on a reduction in building coverage). The Future Land
Use Plan designation is Residential 16, permitting 16 units per gross acre.
The subject site is surrounded by multi-family residential to the west (4 story
condominium/25 dwelling units per acre), multi-family to the south (3 story
condominium/16 dwelling units per acre), and multi-family to the east (2 story
townhouse/10-12 units per acre). Single family residential zoning (5 units per acre) is
located across 2"d Street to the north.
The applicant has requested R-M (2) Multi-Family. R-M (2) zoning permits up to a 5
story building at 16 units per gross acre. The requested zoning is:
a) consistent with the Future Land Use Plan designation of the subject parcel
(Residential 16).
b) consistent with the Future Land Use Plan designations of properties to the west (25
units/acre), south (16 units/acre) and east (16 units/ acre).
c) consistent with the zoning and development of properties to the west (Danian's) and
® to the south (Sea Oaks).

The subject parcel abuts townhouses to the east and single family homes across 2'd
• Street to the north. The townhouses are developed at approximately 10-12 units per
acre and the single family homes at approximately 5 units per acre. Both the
townhouse and single family homes currently abut development that is similar to what is
being proposed (The townhouses abut the Sea Oaks Condo. The single family homes
abut the Danian's condo across 2nd Street).
There is in excess of 525 (existing and permitted by zoning) dwelling units in the
general vicinity of the proposed rezoning. The zoning change, if approved, will increase
the total number of dwelling units in this area by less than 4%.
If the rezoning is approved, the applicant will be required to submit a site plan for review
by the Planning and Zoning Advisory Board and the City Commission.
Plat Analysis
The applicant has proposed a perimeter plat containing approximately 4.91 gross acres.
The Public Works/Utilities Director has indicated that he has no objection to the
proposed plat, and that designation of utility easements will be required at the time of
site plan review.
• The applicant is required to dedicate land for parks, open space, and recreational areas
(or pay a fee in lieu of dedication) pursuant to the formula provided in Article VI of the
Dania City Code. Due to the proximity of Frost Park, the small size of the development
parcel, and the small size of the required park dedication (estimated less than '/2 acre),
staff recommends payment of the local park impact fee in lieu of park dedication.
The amount of such fee to be based upon the fair market value of the land which would
otherwise be required to be dedicated, as determined by the city commission based
upon current appraisals, or if the developer objects to such amount of evaluation he
may, at his own expense, obtain an appraisal of the property by a qualified real estate
appraiser, which appraisal may be accepted by the city commission if found
reasonable, or the city and developer may agree as to the fair market value.
The park dedication area is roughly ten {10) percent of the plat. The Zoning Code
allows, subject to various conditions, the Commission to waive all or part of that portion
of the fee over and above six (6) percent of the plat.
