AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA APPROVING
THE REZONING REQUEST BY DAVID S. PEARL SR., OWNER OF
"UNIWELD PRODUCTS, INC", FOR PROPERTY LOCATED AT 2850
RAVENSWOOD ROAD, WITHIN THE CITY OF DANIA BEACH, FLORIDA,
AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS
ATTACHED TO THIS ORDINANCE; CHANGING THE CURRENT ZONING
CLASSIFICATION OF THE PROPERTY FROM BROWARD COUNTY M-2
INDUSTRIALTO THE CLASSIFICATION OF CITY OF DANIA BEACH I-G
(INDUSTRIAL GENERAL) SUBJECT TO CERTAIN RESTRICTIONS;
PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,
FLORIDA:
Section 1. That the rezoning request filed by David S. Pearl Sr., owner of "Uniweld
Products, Inc.", for property legally described in Exhibit "A", a copy of which is attached to this
ordinance and which is located within the City of Dania Beach, Florida, is granted and the
property is rezoned from its present zoning classification of Broward County M-2 (Industrial) to
City of Dania Beach I-G (Industrial General);
• Section 2. That all ordinances or parts of ordinances in conflict with the
provisions of this ordinance are repealed.
Section 3. That this ordinance.shall take effect upon the recording and filing of the
document identified above in the Broward County Pubilc Records.
PASSED and ADOPTED on first reading on the 25th of July, 2000.

Legally described: The south 242 feet of Tract 4, and Tracts 5 & 6, less the East 50 feet
thereof SEABOARD FARMS, according to the plat thereof recorded in Plat Book 18, Page 22,
of the public records of Broward County, Florida, less that part of Tract 5, according to the plat
of SEA-BOARD FARMS, as recorded in Plat Book 18, Page 22, of the public records of
Broward County, Florida, described as follows: Beginning at the Northwest corner of said Tract
5, run North 78 degrees 43 minutes 40 seconds East, a distance of 230.35 feet to a point, said
point being on a line 50 feet west of and parallel to the West line of the Seaboard Airline
Railway right-of-way; thence southerly along said, parallel line, a distance of 86.18 feet; thence
on a curve to the right whose chord bears South 78 degrees 50 minutes 05 seconds West, with

Per my conversation with my staff. it is my understanding that the moratorium for anv rezoning
:n the Zoning Distncts with the pretix designation of"M" will be lifted simultaneously with the
rezoning to the IROM Classification and that my property is mandated to be rezoned to [ROM.
On November 17. 1999 my staff attended the hearing at the Adiustments Board meeting and was
told by Terry Vitre. Growth Management Director that the IG Classification was more suitable
due to our history and use of the property for heavy manufacturing.
• Please Find attached our application for rezoning and our reasons why Uniweld Products. Inc. is
unique and how Uniweld will suffer a hardship if the [ROM zoning category is forced on our
property.

Uniweid has over fifty (50) containers in shipping each vear and receives raw materials from
_hroughout the United States. This unique business processes raw material into finish product.

countries around the world.

The Cniweid operation has been active in excess of fifty (_�()) years and is a tamtiv operated
nusiness in the same location. We are involved in many aspects of heavy manufacturing that are
not allowed under the [ROM zoning even as an exception.
The tollowing operations are prohibited uses under the proposed 27.=0.
1. Stamping, shearing. punching of metal exceeding one-eight inch in
Thickness.
Drop Forging
3. Automatic Screw Machines
4. Oil compounding or barreling
tinder the proposed IROM zoning section 27.40 Uniweld would have to have an exception
approved by the planning and zoning board and the city commission to stay
Operational to keep the current facility in compliance with the proposed zoninz classification.
'mweid is unique. t'niweid is not rental warehouses or tlex-space warehouses: .ve are not
renting out space. We operate in the buildings we designed and built for the puroose of heavy_
nianutacturin2 that is not allowed in the IROM zoning.
Uniweld is not a manna and we are not on the waterfront. we are not a trailer park or a car lot.
We are not multi-tenants; Uniweld is a heavy manufacture of welding supplies and accessories
• per the catalog included in this package of information.
We respectfully request the zoning classification IG from M-2. There are too many operations
we must maintain at our location to continue to employ our 300+ employees. 'Y'lany are
��rohibited in the IRONI classifications more would require exceptions controlled by appointed
and elected board that could change. We are in our third veneration and we feel the proposed
test Riahts" document will not offer the protection ror the business that %vas created. t niweid

• NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Commission on
Tuesday, August 8, 2000 at 7:30 p.m. in the City Commission Room, Administrative Center,
100 West Dania Beach Blvd., Dania Beach, Florida 33004, for the purpose of hearing any
objections which might be made to the requests. as follows:

Friday. Interested parties may appear at the public hearing and be heard with respect to the proposed
ordinance. ,
Any person who decides to appeal any decision made by the City Commission with regard to any matter
considered at this meeting or hearing will need a record of the proceedings, and for such purpose may need to
ensure that a verbatim record of the proceedings is made which includes the testimony and evidence upon
which the appeal is to be based.

REQUEST: Steve Cissel, on behalf of Uniweld, Inc. requests a zoning change
from Broward County M-2 (Medium Industrial) to City of Dania
Beach IG (General Industrial)
LOCATION: Property located on the southeast corner of Ravenswood Road and
State Road 84 (Tracts 4, 5, and 6 of the Seaboard Farms
Subdivision)
EXISTING ZONING
• The subject parcel has a current zoning designation of Broward County M-2 ("Medium
Intensity Industrial"). Current operations include:
1) Stamping, Punching, etc. of Sheet Metal exceeding one-eight inch in thickness.
2) Automatic Screw Machines.
3) Drop Forging.
4) Oil Compounding or Barreling.
Items 1 and 2 are permitted under the applicant's current County M-2 Zoning. Items 3
and 4, however, are not permitted under County M-2 Zoning, and as such, are non-
conforming uses. Items 3 and 4 are also not permitted under the IROM Zoning.
Non-conforming uses may continue operating indefinitely and may be sold to others.
However, non-conforming uses cannot be continued or rebuilt if one of the following
occurs.
a) 75% o'r more of the operation is destroyed through fire, storm, or other calamity.
b) The use is abandoned for one year or more.

PROPOSED ZONING
The applicant has requested Dania Beach IG (Industrial General) zoning. IG zoning
allows fabrication, assembly, and manufacturing. Transportation terminals and waste
collection/treatment facilities are allowed as "special exception" uses in IG.
Dania Beach IG is a "generic" zoning category and places no restriction on the intensity
of the manufacturing uses. As such, the current Uniweld Operations would be
permitted under IG zoning.
The Uniweld property is located within the Moratorium Area. The moratorium ordinance
states that "staff cannot to accept or process a rezoning change which would allow a
use not permitted by the moratorium ordinance". As such, staff could not process
Uniweld's zoning application for IG zoning since IG allows uses not permitted by the
Moratorium.
The applicant successfully appealed (4-0) staffs refusal to process the zoning change,
thus allowing the applicant to proceed with the rezoning. The City Commission, when
discussing the appeal, supported a change in zoning to IG, citing the large number of
persons employed at Uniweld, the unique location and configuration of the property,
and circumstances relating to the.partial destruction of the facility by fire.
STAFF RECOMMENDATION
® Based on the action taken by the City Commission on the appeal, and the support of
the zoning change articulated by the City Commission during the appeal, staff does not
object to approval.
