HomeMy WebLinkAboutO-2000-032 ORDINANCE NO. 2000-032 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA APPROVING THE REZONING REQUEST BY HENRY GRAHAM, DIRECTOR, LIBERIA ECONOMIC & SOCIAL DEVELOPMENT, INC., (LES) FOR PROPERTY LOCATED AT THE CORNER OF SHERIDAN STREET AND SW 12T" AVENUE, WITHIN THE CITY OF DANIA BEACH, FLORIDA, AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; CHANGING THE CURRENT ZONING CLASSIFICATION FROM RM-2 (RESIDENTIAL) TO C-2 (COMMERCIAL) USING THE 5% COMMERCIAL FLEXIBILITY RULE, SUBJECT TO CERTAIN RESTRICTIONS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the rezoning request by Henry Graham, Director of the Liberia Economic & Social Development, Inc. (LES), for property located at the corner of Sheridan Street and SW 121h Avenue, legally described in Exhibit "A", a copy of which is attached to this ordinance and .which is located within the City of Dania. Beach, Florida, changing the current zoning classification from RM-2 (Residential) to C-2 (Commercial) using the 5% commercial flexibility rule is granted. Section 2. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are repealed. Section 3. That this ordinance shall take effect upon the recording and filing of the document identified above in the Broward County Public Records. Section 4. R-M 2 zoning permits 3 story buildings at 16 units per acre The Future Land Use Plan designation is Residential 16, permitting 16 units per gross acre. The subject site abuts multi-family residential to the north, vacant property to the east (occupied by billboard), and commercial development to both the south (Hollywood) and west (Hollywood). The applicant has requested C-2 Commercial, the second most restrictive business zoning district in the City. The requested zoning is: a) Consistent with the Future Land Use Plan designation of the subject parcel (Residential 16) when approved in conjunction with of assignment of commercial flex acreage under the 5% Residential-to-Commercial Flexibility Rule. b) Consistent with the existing zoning and development of properties to the west, (Commercial) , south (Commercial) and east (Billboard/FEC railroad). c) A preferable alternative to R—M 2 given the location on Sheridan Street and the narrow depth of the lot (approx. 90 feet deep). This property is less than 90 feet deep and has less 180 feet of frontage along Sheridan Street. At roughly 1/3 of an acre, commercial development will be very limited. Applicant has been advised this parcel is within the "study area" of the proposed Sheridan Street widening from four to six lanes of moving traffic. LESsheridanC-2.doc Page 2 Depending on the chosen road alignment, FDOT could require between 23 and 46 feet ® of the parcel depth. This would have a significant impact upon whatever development may ultimately be approved at this location. Staff recommends the applicant inform the potential leaseholder or purchaser of the ` following additional issues: a) This is a small site with very narrow depth, and as such, the development potential of this site will be extremely limited due to landscape and parking requirements. b) Zoning requirements include: 1. A 10 foot wide landscape buffer and a six foot masonry wall is required along the north (rear) lot line. 2. Five wood wide landscape buffers are required adjacent to all other lot lines. 3. One parking space shall is required for each 250 sq. ft. of floor area. There does not appear to be sufficient on-site parking to accommodate the following types of uses: restaurant, house-of-worship, day-care center, school, or meeting or lodge hall. • 4. Vehicles are not permitted to "back out of" or "into" the parking lot. 5. C-2 is an extremely limited commercial zoning district and does not permit warehouse or storage as principal use. c) 25% or more of the site may be acquired by the State of Florida if FDOT proceeds with the street widening. It is also possible that FDOT may not permit a curb cut (driveway) onto Sheridan Street. d) Broward County Department of Planning and Environmental Protection ("DPEP") may require the property to be "replatted" or may require the dedication of additional right-of-way. The applicant has been formally informed of the above issues. STAFF RECOMMENDATION: Approval.
