HomeMy WebLinkAboutO-2000-033 ORDINANCE NO. 2000-033 i AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, APPROVING THE "BRYAN ROAD WAREHOUSE" PLAT, SUCH PROPERTY BEING LOCATED IN THE CITY OF DANIA AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; ACCEPTING THE DEDICATION FOR PUBLIC USE OF ALL STREETS, HIGHWAYS AND ALLEYS AS SHOWN ON SUCH PLAT OF "BRYAN ROAD WAREHOUSE"; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the plat of "Bryan Road Warehouse", an Ordinance of the City Of Dania Beach, Florida, approving "Bryan Road Warehouse" plat, such property being located in the City Of Dania Beach and legally described in exhibit "A", a copy of which is attached to this ordinance; is hereby accepted and approved. The City of Dania Beach consents and agrees that such plat may be recorded in the Public Records of Broward County, Florida, upon further approval of all agencies of Broward County, Florida, having jurisdiction in the matter. Section 2. That the dedication for public use of all streets, highways and alleys, as shown on the plat of "Bryan Road Warehouse" Plat, is accepted by the City of Dania Beach, Florida. Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. That this ordinance shall take effect immediately at its time of passage. The Public Works/Utilities Director has indicated no objection to the proposed plat. Broward County Trafficways Plan The Broward County Trafficways Plan ("BCTP") is the official "right-of-way preservation map" for primary, secondary, and collector roads in Broward County. When a road is shown for right-of-way preservation on the BCTP, the developer is required to set aside sufficient land for future road construction. The set-aside is required regardless of the availability of funds to construct the road, or the timetable for doing so. The County will not approve a plat unless the plat conforms to the Trafficways Plan. As such, a developer is required to dedicate future right-of-way wherever a trafficway affects any property within the plat. In this case, the subject plat is impacted by two trafficways, Bryan Road and Dania Beach Boulevard. The Trafficways Plan requires dedication of 40 feet from the centerline of both roads (Both roads are designated as 80 foot collectors and property owners are generally responsible for their "half' of the is road). Brya nRoadWarehousePlatl.DOC 1 of 2 Most of the Bryan Road right-of-way has already been dedicated, so the applicant is required to dedicate 10 feet. The plat reflects this dedication. Dania Beach Boulevard has not been constructed west of the C-10 canal. As such, there is no existing right-of-way. In the absence of any right-of-way, Broward County Traffic Engineering staff indicate the applicant is required to dedicate 40 feet, or his "full half' of the road. The plat reflects this dedication Other less extensive dedications may be required by Broward County Traffic Engineering as part of their plat review. Broward County must also approve the entrance driveway location. The applicant was advised during the initial meeting with City staff to contact Broward County regarding platting requirements. Zoning This property is scheduled to be rezoned IROM .August 8, 2000 (Second Reading) As such, this property will be reviewed under the "IROM" regulations. Site Plan Preliminary review of the most recently revised site plan (July 5, 2000) indicates • insufficient parking, insufficient pervious area, and front yard loading zones. These and other zoning issues will be addressed during site plan review. The applicant has been advised of these issues.
