HomeMy WebLinkAboutO-2000-044 ORDINANCE NO. 2000-044 AN ORDINANCE OF THE CITY OF DANIA BEACH APPROVING THE REZONING REQUEST FOR PROPERTY LOCATED WITHIN THE CITY OF DANIA BEACH, FLORIDA, AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; CHANGING THE CURRENT ZONING CLASSIFICATION OF THE PROPERTY FROM RM(2) (MEDIUM-HIGH DENSITY RESIDENTIAL) TO THE CLASSIFICATION OF RM(3) (HIGH DENSITY RESIDENTIAL), SUBJECT TO CERTAIN RESTRICTIONS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, i FLORIDA: Section 1. That the rezoning request for property legally described in Exhibit "A", a copy of which is attached to this ordinance and which is located within the City of Dania Beach, Florida, is granted and the property is rezoned from its present zoning classification of RM(2) (Medium Hight Denisty Residential) to RM(3) (High Density Residential) zoning classification. Section 2. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with this ordinance are repealed to the extent of such conflict. Section 3. That if any section, clause, sentence or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Section 4. That this ordinance shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED on first reading on the 241" day of October, 2000. REQUEST: "Corrective Zoning Change" from RM-2 (16 Units/Acre) to RM-3 (25 Units/Acre) to Change the Zoning Designation Consistent with and Pursuant to the Adopted Land Use Plan Designation LOCATION: 400 East Sheridan Street FUTURE LAND USE: Residential 25 (Site Limit: 24.2 Units Per Acre, not to exceed a total of 240 flexibility units) . PROPERTY SIZE: 9.913 ACRES The subject site Is situated on Sheridan Street, directly west of Publix. In February 1999, the City Commission approved a land use plan amendment to Residential 25. The Residential 25 land use category allows a "site specific density" of 24.2 units per acre (for a total of 240 units) as approved by the City Commission for this property. In May 1999, the City Commission approved a zoning change from C-2 to RM-2 and a site plan for 240 multi-family units. Building permits were subsequently approved consistent with the approved site plan. Because RM-2 zoning allows no more than 16 units per acre, RM-2 zoning is actually inconsistent with the adopted Residential 25 land use designation and approved site plan. To correct this inconsistency, staff recommends that the property be rezoned to RM-3, which like Residential 25, permits up to 25 units per acre. Please note that the change from RM-2 to RM-3 is a corrective action only, and will not increase the approved City Commission density of 24.2 units per acre, or a maximum of 240 units. STAFF RECOMMENDATIONS: In order for the zoning designation to be consistent with the adopted Residential land use plan designation, staff recommends approval.
