AN ORDINANCE OF THE CITY OF DANIA BEACH APPROVING THE
REZONING REQUEST FOR PROPERTY LOCATED WITHIN THE CITY OF
DANIA BEACH, FLORIDA, AND LEGALLY DESCRIBED IN EXHIBIT "A", A
COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; CHANGING THE
CURRENT ZONING CLASSIFICATION OF THE PROPERTY FROM C-2
(COMMERCIAL) TO THE CLASSIFICATION OF RM(3) (HIGH DENSITY
RESIDENTIAL), SUBJECT TO CERTAIN RESTRICTIONS; PROVIDING FOR
SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,
FLORIDA:
Section 1. That the rezoning request for property legally described in Exhibit "A", a
copy of which is attached to this ordinance and which is located within the City of Dania Beach,
Florida, is granted and the property is rezoned from its present zoning classification of C-2
(Commercial) to RM(3) (High Density Residential) zoning classification.
Section 2. That all ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict with this ordinance are repealed to the extent of such conflict.
Section 3. That if any section, clause, sentence or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
• affect the validity of the remaining portions of this ordinance.
Section 4. That this ordinance shall be in force and take effect immediately upon its
passage and adoption.

REQUEST: "Corrective Zoning Change" from C-2 (Commercial) to RM-3 (25
Units/Acre) to Change the Zoning Designation Consistent with and

LOCATION: 600 East Sheridan Street
FUTURE LAND USE: Residential 25 (Site Limit: 21.3 Units Per Acre, not to exceed a total
of 44 flexibility units)
• PROPERTY SIZE: 2.06 ACRES
The subject site is situated on Sheridan Street, east of SE 5t" Avenue and west and south of
the Sheridan Ocean Club. In January 2000, the City Commission approved a land use plan
amendment to Residential 25. The Residential 25 land use category allows a "site specific
density" of 21.3 units per acre (for a total of 44 units) as approved by the City Commission for
this property.
At the same time as the land use change, the City Commission rezoned the property to RM-
25. There is no RM-25 zoning category in the Dania Beach Zoning Code. As such, the
attempt to rezone the property to the non-existing RM-25 category fails, and the property
retains its original C-2 zoning.
To correct this inconsistency, staff recommends that the property be rezoned to RM-3, which
like Residential 25 land use, permits up to 25 units per acre. Please note that the change
from C-2 to RM-3 is a corrective action only, and will not increase the approved City
Commission density of a total of 44 units.
STAFF RECOMMENDATION: In order for the zoning designation to be consistent with the
adopted Residential land use plan designation, staff recommends approval.
