HomeMy WebLinkAboutO-2002-002ORDINANCE NO. 2002- 002 AN ORDINANCE OF THE CITY OF DANIA BEACH APPROVING THE REZONING REQUEST FOR PROPERTY LOCATED 803 NW 1ST STREET WITHIN THE CITY OF DANIA BEACH, FLORIDA, AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; CHANGING THE CURRENT ZONING CLASSIFICATION OF THE PROPERTY FROM RD-8000 (DUPLEX) TO THE CLASSIFICATION OF OS (OPEN SPACE AND LOCAL GOVERNMENT), SUBJECT TO CERTAIN RESTRICTIONS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the rezoning request for property legally described in Exhibit "A", a copy of which is attached to this ordinance and which is located within the City of Dania Beach, Florida, is granted and the property is rezoned from its present zoning classification of RD-8000 (Duplex) to the OS (Open Space and Local Government) zoning classification. Section 2. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with this ordinance are repealed to the extent of such conflict. Section 3. That if any section, clause, sentence or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Section 4. That this ordinance shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on first reading on December 11, 2001. Leeds, AICP, Director Date December 27, 2001 Growth Management Department City Manager s Date CITY OF DANIA BEACH GROWTH MANAGEMENT DEPARTMENT STAFF REPORT TO: Ivan Pato, City Manager FROM: Laurence Leeds, AICP, Director Growth Management Department DATE: January 8, 2001 SUBJECT: Rezoning (including Modification of Landscape Plan) to Expand and Convert an Existing Apartment Building into a Public Safety/Community Center (803 NW 1st Street) APPLICANT: City of Dania Beach Rezoning from RD 8000 (Duplex) to OS (Open Space and Local Government). The zoning change is required to allow the conversion of the apartment building to local government use. Both City Hall and the Fire Station are currently zoned OS. Landscape Plan: The site plan has been revised to show additional landscaping, including: a) Four foxtail palms (12' high) at the main building entrance on NW 1st Street. The installation of the palms at this location requires the abutting parking spaces to be converted into "compact" (8' wide) spaces. b) Three foxtail palms (12' high) near the intersection of NW 8th Avenue and NW 1st Street. c) Green Buttonwood Tree alongside the building on NW 8th Avenue. Three black olive trees in the NW 8th Avenue swale will remain. d) Cocoplum perimeter hedge along east (NW 8th Avenue) and west lot lines, on the inside of the fence (The City Commission may substitute "Crown of Thorns" for the Cocoplum).
