AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, APPROVING
THE "SCHOONER RIDGE PLAT', SUCH PROPERTY BEING LOCATED
AT NORTH OF SW 45T" STREET, WEST OF SW 30TH AVENUE, AND
EAST OF SW 30TH WAY IN THE CITY OF DANIA AND LEGALLY
DESCRIBED IN EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO
THIS ORDINANCE; ACCEPTING THE DEDICATION FOR PUBLIC USE
OF ALL STREETS, HIGHWAYS AND ALLEYS AS SHOWN ON SUCH
PLAT OF "SCHOONER RIDGE PLAT'; PROVIDING FOR
SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,
FLORIDA:
Section 1. That the plat of "Schooner Ridge Plat", an Ordinance of the City Of Dania
Beach, Florida, approving "Schooner Ridge Plat", such property being located in the City Of
Dania Beach and legally described in exhibit "A", a copy of which is attached to this ordinance;
is hereby accepted and approved. The City of Dania Beach consents and agrees that such
plat may be recorded in the Public Records of Broward County, Florida, upon further approval
of all agencies of Broward County, Florida, having jurisdiction in the matter.
Section 2. That the dedication for public use of all streets, highways and alleys, as
shown on the plat of "Schooner Ridge Plat", is accepted by the City of Dania Beach, Florida,
with the understanding that the petitioner would bring back a full site plan for the wall and
landscaping for the entire project to be approved by the City Commission prior to issuance of
any building permits, that the interior roads shall remain private, and subject to the following
conditions identified as a,b,c, e, and f:
a) Minimum 50 foot right-of-way on SW 45 Street from the south east corner of the
Plat to the west side of SW 30th Way. Pavement cross-section in this area to be 24 feet wide
or as determined by the Public Works/Utilities Director. The Public Works/Utilities Director
shall attempt to obtain additional right-of-way to widen SW 45 Street to 50 feet wide between
the plat and SW 30th Avenue.
b) Minimum 25 foot wide right-of-way on SW 45 Street (west of SW 30th Way) to
the south west corner of the plat.

c) SW 45th Street improvements shall be completed concurrently with the

installation of new subdivision streets.
d) Waived
e) Pending the Public Works/Utilities Director obtaining additional right-of-way to
widen SW 45th Street to 50 feet wide between the plat and SW 30th Avenue, the applicant
shall install additional paving and sidewalks to maintain continually between the new plat and
SW 30 Avenue.
f) Applicant shall obtain written approval from the Public Works/Utilities Director
before submitting the plat to Broward County.
Section 3. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
Section 4. That this ordinance shall take effect immediately at its time of passage.

SUBJECT: Schooner Ridge Subdivision Plat
(SECOND READING — PUBLIC HEARING)
LOCATION: Propert� located west of SW 30th Avenue, north of
SW 45t Street, and east of SW 30th Way
EXISTING ZONING: Broward County R-1 C (Minimum 6000 sq. ft lots.)
LAND USE PLAN: 5 Dwelling Units per Acre
PROPERTY SIZE: Approximately 5.13 Gross Acres
APPLICANT: John Ligotti
The applicant has proposed a single-family "subdivision plat" containing 20
single-family lots. The plat abuts single-family homes to the west (unplatted
parcels) and south (Avon Park Subdivision), vacant land to the east (adjacent
to SW 30th Avenue) and the Dania Cut-off Canal to the north.
Access to the plat will be via SW 45th Street (The applicant has indicated the
project will be a private community with restricted access). The developed
property to the west currently has access via a narrow 14-foot wide extension
of SW 45th Street. Staff has requested the Fire Marshall to determine if this
14-foot wide "easement" provides sufficient emergency vehicle access to the
homes located on the unplatted parcels.
R-1 C Zoninq: All home lots in the new plat exceed the minimum width (60
feet) and size requirements (6,000 sq. ft.) of current R1-C Zoning. Lot 21 is
to be restricted to "boat access" for the residents of the subdivision.
Low 5 Residential Future Land Use Plan ("LUP") Designation: The Future
LUP Designation allows up to 26 dwelling units. Applicant proposes 20
single-family lots. As such, the plat is consistent with the Future Land Use
Plan.

0 PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION
Approval, subject to the following:
1) Sufficient right-of-way shall be dedicated to assure SW 45th Street is a
50 foot wide right-of-way from the southeast corner of the plat to the
west side of SW 30th Way (The Public Works/Utilities Director is
attempting to obtain additional right-of-way to widen SW 45th Street to
50 feet wide between the plat and SW 30th Avenue).
2) Applicant to widen SW 45th Street (west of SW 30th Way) to a
minimum 25 foot right-of-way or as determined sufficient *by Fire
Rescue. This includes extending the proposed 11-foot easement west
through Lots 1 and 2.
3) Fire Marshall to confirm that adequate maneuvering space is provided
within the plat and adequate vehicle access has been provided to the
abutting property to the west.
4) Public Works/Utilities Director to determine compliance with street
pavement specifications.
® 5) Sidewalks to be installed on all streets within the plat, and on the north
side of SW 45th Street on the perimeter of the plat.
6) Use of Lot 21 as a home lot to be specifically prohibited.
STAFF RECOMMENDATION
Applicant has complied with Condition 6 (Applicant need not comply with
Condition 4 until prior to construction).
The Fire Department indicates approval of the current plat arrangement (see
attached memo dated January 8, 2002).
The Public Works Director recommends:
a) Minimum 50 foot right-of-way on SW 45th Street from the south
east corner of the Plat to the west side of SW 30th Way.
Pavement cross-section in this area to be 24 feet wide or as
determined by the Public Works/Utilities Director.
The Public Works/Utilities Director shall attempt to obtain
additional right-of-way to widen SW 45t" Street to 50 feet wide

b) Minimum 25 foot wide right-of-way on SW 451h Street (west of
SW 30th Way) to the south west corner of the Plat.
c) SW 45th Street improvements shall be completed concurrently
with the installation of new subdivision streets.
d) Proposed subdivision roads shall dedicated as public streets to
provide access to adjoining properties to the east (vacant) and
west (existing single family).
e) Pending the Public Works/Utilities Director obtaining additional
right-of-way to widen SW 45th Street to 50 feet wide between
the plat and SW 30th Avenue, the applicant shall install
additional paving and sidewalks to maintain continuity between
the new plat and SW 30th Avenue.
f) Applicant shall obtain written approval from the Public
Works/Utilities Director before submitting the plat to Broward
County.
® Applicant is advised to contact Health Department regarding sanitary
facilities.
