AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA APPROVING THE
REZONING REQUEST BY SHELLEY EICHNER OF CALVIN GIORDANO AND
ASSOCIATES REPRESENTING NAC INVESTORS, LLC, FOR PROPERTY LOCATED
AT 3064 GRIFFIN RD., DANIA BEACH, FLORIDA, AND LEGALLY DESCRIBED IN
EXHIBIT "A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE; CHANGING
THE CURRENT ZONING CLASSIFICATION OF THE PROPERTY FROM T-1
(TRAILER PARK) AND C-2 (COMMERCIAL) TO RM-2 (RESIDENTIAL) TO ALLOW 55
TOWN HOMES, PLUS THE ALLOCATION OF TWO RESERVE UNITS, TO ALLOW A

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA:
Section 1. That the rezoning request filed by Shelley Eichner of Calvin
Giordano and Associates representing NAC Investors, LLC, for property located at
3064 Griffin Road, Dania Beach, Florida, is granted and the parcels are rezoned as
described in Exhibit "A", a copy of which is attached to this ordinance;
Section 2. That this rezoning request includes the allocation of two (2)
flexibility units as permitted and regulated by the City of Dania Beach Comprehensive
Plan and the Broward County Land use Plan.
Section 3. That all ordinances or parts of ordinances in conflict with the
provisions of this ordinance are repealed.
Section 3. That this ordinance shall take effect upon the recording and filing of
the document identified above in the Broward County Public Records.

SUBJECT: Request by Shelly Eichner, Calvin, Giordano & Associates,
Inc., representing NAC Investors, LLC, for a rezoning from
Trailer Park (T-1) and Commercial (C-2) to Residential
(RIB-2), located at 3064 Griffin Road (South of Griffin
Road, east of SW 31"' Avenue).
RZ-06-03: Rezoning request is from Trailer Park (T-1) and
Commercial (C-2) to Residential (RIB-2) to allow 55 town
homes, plus the allocation of two reserve units, to allow a
total of 57 town homes.

ZONING CHANGE REQUEST
The requested RM-2 zoning designation allows 12 townhouse units or 16 multifamily
units per gross acre. The applicant is requesting rezoning to allow townhouses at 10.3
units per gross acre for a maximum of 57 units. The occupational license for the
Thunderbird Mobil Home Park indicates 56 mobile homes and trailers.

Townhouse development at 10.3 units per acre is generally compatible with adjacent
uses to the west (Oak Bridge Town Homes, Publix Supermarket), to the east (Proposed
• Leto townhouse/retail development), and to the south (Existing single family home and
lake). Staff has requested that the applicant address relocation of current mobile home
park residents.
The RM-2 zoning allows multifamily dwelling units at 16 units per gross acre, up to 55
feet in height. As such, further measures are suggested to assure the property is
developed as proposed, that is, for an ownership-type townhouse community not to
exceed 10.3 units per acre.
Staff recommends the zoning petition be amended from RM-2 to RM. The RM zoning
district allows townhouses and multifamily development at 12 units per acre. Approval
of RM zoning designation would prevent additional density from being granted for
multifamily development.
The applicant has volunteered to deed restrict the property to construct two-story
townhouse units (sold in fee-simple, homeowner association, or condominium) at a
maximum of 10.3 units per acre or 57 units.
ASSIGNMENT OF TWO RESERVE UNITS
The subject parcel has a Future Land Use Plan designation of Low Medium Residential.
® Low Medium Residential permits 10 dwelling units per gross acre or a total of 55
dwelling units. Applicant has requested two reserve units to allow 57 dwelling units, or
a net increase of two units.
The subject property is located within Flexibility Zone 81. Flexibility Zone 81 includes
that portion of the City west of Ravenswood Road and south of the Dania Cut-Off Canal.
Assignment of two reserve units to this parcel would leave a balance of 43 units
available in Flex Zone 81.
The assignment of two reserve units from Flex Zone 81 is generally consistent with both
the Comprehensive Plan and the recommended ""RM"zoning district.
PLANNING AND ZONING ADVISORY BARD RECOMMENDATION
The Planning and Zoning Advisory Board, at their February 19, 2003 meeting,
recommended approval of the zoning change to RM and the assignment of two reserve
units to allow a total of 57 town house units.
