AN ORDINANCE OF THE CITY OF DANIA, FLORIDA,
APPROVING THE "DANIA PLACE PLAT", SUCH PROPERTY
BEING GENERALLY LOCATED EAST OF THE DANIANS
CONDOMINIUM ON EAST DANIA BEACH BOULEVARD, IN THE
CITY OF DANIA BEACH AND LEGALLY DESCRIBED IN EXHIBIT
"A", A COPY OF WHICH IS ATTACHED TO THIS ORDINANCE;
ACCEPTING THE DEDICATION FOR PUBLIC USE OF ALL
STREETS, HIGHWAYS AND ALLEYS AS SHOWN ON SUCH
PLAT OF THE "DANIA PLACE PLAT"; PROVIDING FOR
SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,
FLORIDA:
Section 1. That the plat of the "Dania Place Plat" (PL-94-03), an Ordinance of the
City Of Dania Beach, Florida, approving the "Dania Place Plat", such property being generally
located east of the Danians Condominium on East Dania Beach Boulevard, in the City Of
is Dania Beach and legally described in Exhibit "A", a copy of which is attached to this

Ordinance, is hereby accepted and approved, subject to the following:
1) The applicant is required to provide an updated appraisal that is no more than
60 days old; and
2) The updated appraisal must be provided prior to the submittal of the site plan to
the Planning & Zoning Advisory Board.
The City of Dania Beach consents and agrees that such plat may be recorded in the Public
Records of Broward County, Florida, upon further approval of all agencies of Broward County,
Florida, having jurisdiction in the matter.
Section 2. That the dedication for public use of all streets, highways and alleys, as
shown on the plat of the "Dania Place Plat", is accepted by the City of Dania Beach, Florida.

Section 3. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
Section 4. That this ordinance shall take effect immediately at its time of passage.

SUBJECT: PL-94-03: Request by Mikki Ulrich/Deni Land
Surveyors on behalf of Scaltex USA. Inc. & Dania
Homes, for a perimeter plat. Property located east of
the Danians Condominium Clubhouse fronting Dania
Beach Boulevard (SECOND READING).
To develop the subject property, developer is required to file a "perimeter
plat" of the property. The subject property is located immediately east of the
Danians condominium entrance.
The property is zoned multiple family (RM-2). The property is located within
the pending Local Activity Center land use designation, and as such, will be
required to pay a school impact fee of approximately $1,800.00 per dwelling
unit prior to issuance of building permits. Applicant's proposal is
consistent with the pending LAC land use plan designation.
The City of Dania Beach, as part of its plat review, requires a person
platting land for residential purposes to dedicate public land for parks to
meet the needs created by their development. The fee shall be based upon
the formula identified in Chapter 19 (Article IV) of the City Code.
The park dedication formula identified in the Zoning Code requires three
acres of park land for every 1,000 residents, multiplied by the number of
proposed residential units (in this case 10), multiplied by the number of
persons per unit, the Zoning Code stipulates two persons per unit.
In this instance, the formula requires the applicant to dedicate 0.06 (2,600
s.f.) acres of public open space. Due to the small size of the required
dedication, staff recommends the applicant pay a local park impact fee
equal in value to the 0.06 acre park dedication. 0.06 acres equals 10.5 % of
the land area of the subject property.
The City Code provides three alternative methods for determining "fair
market value":
a) The City Commission may hire an appraiser to determine the fair
market value of the dedicated parcel.
b) The developer obtains his own appraisal, which appraisal may be
accepted by the city commission if found reasonable.
c) The City Commission and developer may agree as to the fair market
value.
The applicant has provided an appraisal indicating the property is worth
$260,000.00. If the City Commission agrees with this figure, applicant is
required to dedicate 10.5 % of the appraisal price (or $27,300.00) in local
park impact fees prior to issuance of building permits. This is in addition to
local water, sewer, and public safety impact fees. The developer must also
be able to demonstrate, prior to site plan approval, emergency vehicle
ingress/egress and required turning area.
In addition, the applicant must receive approval from FDOT for the
proposed curb cut location on Dania Beach Boulevard prior to site plan
approval.
