HomeMy WebLinkAboutO-2004-020 Scriveners error re Article 28-Signs v2ORDINANCE NO. 2004-020 AN ORDINANCE AMENDING CHAPTER 28 "ZONING" OF THE CODE OF ORDINANCES OF THE CITY OF DANIA BEACH, FLORIDA, BY AMENDING ARTICLE 28 "SIGNS," TO CORRECT A SCRIVENER'S ERROR IN THE CITY'S TEMPORARY POLITICAL SIGN REGULATIONS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Dania Beach updated and revised its sign regulations with the adoption of Ordinance No. 2003-044 on December 8,2003;and WHEREAS, a scrivener's error resulted in the inadvertent removal of the stated size limit for temporary political signs (eight (8) square feet) from Section 28.220 "Temporary Signs," at Article 28 "Signs" of Chapter 28 "Zoning" of the City's Code of Ordinances; and WHEREAS, pursuant to law, notice has been given by publication in a newspaper of general circulation in the City, notifying the public of this proposed ordinance and of a public hearing; and 0 WHEREAS, a public hearing before the City Commission was held pursuant to the published notice described above, at which the parties in interest and all other citizens so desiring had an opportunity to be heard; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing WHEREAS clauses are ratified and incorporated as the legislative intent of this Ordinance. Section 2. That Section 28.220 "Temporary Signs," at Article 28 "Signs" of Chapter 28 "Zoning" of the City's Code of Ordinances is amended to read as follows: CHAPTER 28. ZONING ARTICLE 28. SIGNS 28.220. Temporary signs. The following temporary signs shall be permitted in any zoning district and shall be subject to the provisions set forth below: 0 0 I ORDINANCE NO. 2004-020 (7) Temporary Political Signs, Political signs (temporary), subject to the removal requirements of subsection (2) above, of eight (8) square feet in area or less. Section 3. That, except as amended above, all other provisions of Chapter 28 of the Code of Ordinances of the City of Dania Beach, Florida, as amended, shall remain in full force and effect. Section 4. That if any section, clause, sentence or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Section 5. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are repealed. Section 6. That this ordinance shall be in force and take effect immediately upon adoption. PASSED on first reading on June 8, 2004. PASSED AND ADOPTED on second reading on June 22, 2004. Ansbro, City Attorney DATE: May 27, 2004 RE: Sign Limitation for Temporary Signs Attached is an ordinance which is intended to correct a "scrivener's error" in connection with the sign limitation for temporary political signs. When the sign ordinance was substantially revised late last year, the eight square foot maximum sign limitation for such signs was inadvertently deleted. The ordinance simply restores the maximum sign limitation to the sign code.
