AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA,
AMENDING CHAPTER 6, "BEACHES, PARKS AND RECREATION", OF
THE CITY CODE OF ORDINANCES BY AMENDING SECTION 6-33,
"SCHEDULE OF CHARGES", TO INCREASE THE FINES FOR PARKING
VIOLATIONS; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA:
Section 1. That Chapter 6 "Beaches, Parks and Recreation" of the Code of Ordinances of the
City of Dania Beach, Florida, Section 6-33 "Schedule of Charges", is amended to read as
follows:
Sec. 6-33. Schedule of charges.
(e) Any person who violates the provisions of subsection (a) hereinabove shall be issued
a parking violation citation and be subject to a fine of Thirty-F4ve—Seven Dollars and Fifty Cents
($-35-.00L7.50) for each such violation. For any disabled parking violation, the penalty is Two
Hundred Fifty-Ttue Two Dollars and Fifty Cents ($253.00225�2�.5O . A late fee of Twelve Dollars
($12.00) will be imposed after ten (10) days of issuance of any ticket that is not paid within that
time period.
Section 2. That except as amended above, all other provisions of Chapter 6 of the
Code of Ordinances of the City of Dania Beach, Florida, shall remain in full force and effect.
Section 3. That all ordinances or parts of ordinances and all resolutions or parts of
resolutions in conflict with this ordinance are repealed to the extent of such conflict.

Section 4. That if any section, clause, sentence or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this ordinance.
Section 5. That this Ordinance shall be in force and take effect immediately upon its
passage and adoption.

RE: Parking Fines; Ordinance Amendment
Attached is a copy of the proposed amending ordinance. Please note that the current
fines are $35.00 for "general" citations and $253.00 for disabled parking violations. The
school crossing guard $5.00 surcharge per citation was established by City ordinance 2003-
041, which created a new Code Section 6.33.1. That section expressly provides that the
surcharge is "in addition to the fines provided for in Section 6-33"; consequently, the attached
amending ordinance does not "include" the surcharge for each violation in the subject section
(i.e., sec. 6-33).
Also attached is an amending ordinance for corresponding "Chapter 25" parking fines.

Re: New Legislative Fees
Municipal and County Parking Violations
Dear Sir/Madam:
The Florida State Legislature has enacted a number of new fees relating to municipal and
county parking violations. These new fees are effective as of 7/01/04, and as a result
your citations will need to be amended as follows.
All violations of the disabled parking violations should delete the current $3.00 Teen
Court Fee, that is currently included in your total fine amount. This fee has been deleted
effective 7/01/04.
Additionally, a Criminal Justice Education Fee of S2.50, must be added to all parking
violations, written on a municipal or county citation, including the disabled parking
violations.
This means a total change of $0.50, less than the current amount due on your present
citations for the disabled parking violations and a total increase of $2.50 for all general
violations on municipal or county parking violations.
Your parking citations will need to have these changes made on your next order. Please
make sure that your printer contacts me directly to ensure all changes have been included
prior to printing. Until such time as you order new citations your officers may change the
current amount due on the citations to reflect these new fees.
In addition to the above changes, the Request for Dismissal of a disabled parking citation,
for permit owners, must include a $7.50 Dismissal Fee instead of the current $5.00 fee.

CITY OF DANIA BEACH, FLORIDA, REGARDING
ADOPTION OF THE FOLLOWING PROPOSED ORDINANCES:
NOTICE IS HEREBY GIVEN that the City Commission of the City of Dania
Beach ' Florida, on August 24, 2004, at 7-00 p.m. or as soon thereafter as the
matter may be heard, will conduct a public hearing in the City Commission
Chambers of the Dania Beach City Hall, 100 West Dania Beach Boulevard,
Dania Beach, Florida to consider the proposed adoption of the following
Ordinances entitled:

ORDINANCES BY AMENDING SECTION 25-79, "FINES", TO
INCREASE THE SUCH FINES FOR VIOLATIONS PURSUANT TO
SECTION 25-79; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
Copies of the proposed Ordinances are on file in the Office of the City Clerk, City
Hall, 100 West Dania Beach Boulevard, Dania Beach, Florida, and may be
inspected by the public during normal working hours.
Interested parties may appear at the aforesaid meeting and be heard with
respect to the proposed. Any person who decides to appeal any decision made
by the City Commission with respect to any matter considered at this hearing will
need a record of the proceedings and for such purpose may need to ensure that
a verbatim record of the proceedings is made, which record includes the
testimony and evidence upon which the appeal is to be based.
In accordance with the American with Disabilities Act, persons needing
assistance to participate in any of the proceedings should contact Louise Stilson,
City Clerk, 100 West Dania Beach Boulevard, Dania Beach, Florida 33004, (954)
