HomeMy WebLinkAboutO-2004-032 Street numbers on alley buildings0 ORDINANCE NO. 2004-032 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING SECTION 22-1 OF THE CITY CODE OF ORDINANCES TO REQUIRE OWNERS OF BUILDINGS LOCATED WITHIN THE CITY, WHICH BUILDINGS ABUT ALLEYS, TO PLACE STREET NUMBERS VISIBLE FROM THE ALLEY TO ALLOW FOR THE IDENTIFICATION OF THE PROPERTY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 22-1 of the City Code of Ordinances vests the City fire marshal with authority to require owners of buildings within the City to display the correct street number upon such buildings; and WHEREAS, a number of buildings located within the City abut alleys, which alleys provide access to City fire, fire rescue and police vehicles, as well as utility service and waste disposal vehicles; and WHEREAS, the City Commission has determined that buildings abutting alleys should be required to display the correct street numbers so that buildings are identifiable by drivers of vehicles who may need to render a service to the properties or their inhabitants, such as fire suppression,. medical rescue, police response, utility and trash removal services; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Section 22-1 of the City Code of Ordinances, entitled "Buildings to be numbered", shall be amended to read as follows: Sec. 22-1. Buildings to be numbered. The city fire marshal is vested with authority to require the owner of any building in the City to display the correct street number upon such building. In addition, if a building abuts an alleyway, the owner of each building shall display the correct street number of the building so that the address is visible to the operator of a motor vehicle from the traveled portion of the alleMay. 1�1 1 ORDINANCE NO. 2004-032 Section 2. That if any section, clause, sentence or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are repealed. Section 4. That this ordinance shall take effect immediately at the time of passage and adoption. PASSED AND ADOPTED on first reading on September 28, 2004. Ansbro, City Attorney DATE: September 17, 2004 RE: Proposed Amendment to Section 22-1 to Require Building Numbers to be Posted and Visible From Alleyways The Mayor has proposed an ordinance which would amend the existing City ordinance pertaining to the display of street address numbers. From a public safety standpoint (police, fire, medical rescue response), as well as for the benefit of utility work and trash removal, the display of street address numbers, so that they are visible for persons operating vehicles in alleyways, will assist responders and service workers in the prompt identification of a property when access to a property via an alleyway is necessary or desirable. A copy of the proposed ordinance is attached and is ready for Commission consideration and adoption. 566.028 TJA:slw Attachment 0 0 NOTICE OF HEARING BEFORE CITY COMMISSION CITY OF DANIA BEACH, FLORIDA, REGARDING ADOPTION OF THE FOLLOWING PROPOSED ORDINANCE: NOTICE IS HEREBY GIVEN that the City Commission of the City of Dania Beach, Florida, on October 12, 2004, at 7:00 p.m. or as soon thereafter as the matter may be heard, will conduct a public hearing in the City Commission Chambers of the Dania Beach City Hall, 100 West Dania Beach Boulevard, Dania Beach, Florida to consider the proposed adoption of the following Ordinance entitled: AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING SECTION 22-1 OF THE CITY CODE OF ORDINANCES TO REQUIRE OWNERS OF BUILDINGS LOCATED WITHIN THE CITY, WHICH BUILDINGS ABUT ALLEYS, TO PLACE STREET NUMBERS VISIBLE FROM THE ALLEY TO ALLOW FOR THE IDENTIFICATION OF THE PROPERTY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. Copies of the proposed Ordinance are on file in the Office of the City Clerk, City Hall, 100 West Dania Beach Boulevard, Dania Beach, Florida, and may be inspected by the public during normal working hours. Interested parties may appear at the aforesaid meeting and be heard with respect to the proposed. Any person who decides to appeal any decision made by the City Commission with respect to any matter considered at this hearing will need a record of the proceedings and for such purpose may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
