HomeMy WebLinkAboutO-2005-013 Monetary threshold establishmentORDINANCE NO. 2005-013 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA ESTABLISHING MONETARY THRESHOLDS FOR CERTAIN PURCHASES MADE ON BEHALF OF THE CITY AS AUTHORIZED BY THE CITY COMMISSION, CITY MANAGER OR BOTH AND FOR CHECK SIGNATURE AUTHORIZATIONS; CREATING SECTION 2-10 OF THE CITY CODE OF ORDINANCES TO BE ENTITLED "MONETARY THRESHOLDS AND CHECK AUTHORIZATION FOR CERTAIN PURCHASES AND CHECK AUTHORIZATION"; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to amendments to the City Charter approved by the City electorate at the March 8, 2005 City election, certain Charter provisions were enacted which pertain to monetary limitations or thresholds for purchases made by the City Commission, the City Manager or both; and WHEREAS, it is necessary to enact enabling legislation to comply with the requirements of the new Charter provisions, specifically, Section 4, "Powers and duties", subsections 0) and (1) of Article 3, "City Manager", of Part 111, "Administrative offices and Departments" of the City Charter; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Section 2-10 of the City Code of Ordinances is created to read as follows: See. 2-10. Monetary Thresholds for Certain Purchases and Check Authorizations. Pursuant to the provisions of the City Charter (Part 111, Article 3, Section 4, subsections 0) and (1), monetary thresholds are required to be established by ordinance for certain purchases made by the City Commission, the City Manager or both. In addition, monetary thresholds are able to be established for authorizations for City officials to sign checks, warrants and bonds dependent upon the amounts involved. Therefore, the following monetary thresholds are established: (a) for the purchase by the City Manager of supplies, services, material and equipment, the monetary threshold or limitation is fifteen thousand dollars ($15,000.00). For purchases exceeding that amount, City Commission 0 authorization is required, as provided by the Section 40) of Article 3 of Part III of the City Charter; (b) for any purchases exceeding one hundred thousand dollars ($100,000.00), a four -fifths vote of the City Commission shall be required; and (c) for any check, warrant or bond to be issued on behalf of the City which exceeds two thousand five hundred dollars ($2,500.00), two (2) manual signatures by authorized City officials shall be required. Authorized City officials include the City Manager, City Finance Director, City Clerk, or in an emergency the Mayor, or in the absence of the Mayor, the Vice -Mayor. Any such instrument which involves a dollar amount less than the threshold amount identified in this subparagraph shall require the manual signature of one of the foregoing official and a facsimile signature of any other authorized official. Section 2. That if any section, clause, sentence or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this Ordinance are repealed. Section 4. That this Ordinance shall be effective immediately at adoption on second reading. PASSED and ADOPTED on first reading on April 26, 2005. The City Manager's purchasing authority (i.e., purchases which do not require City Commission approval) was increased in 2003 to $ 15,000.00 (formerly it was $7,500.00). it is proposed that the $15,000.00 limitation be retained, untess the Commission wishes to consider increasing it. In addition, the City Commission must establish a limitation for purchase that the Commission must approve pursuant to one of the new Charter provisions. A four -fifths City Commission vote is required for any purchase above a threshold as established by ordinance from time to time by the City Commission. A threshold of $100,000.00 is suggested. Lastly, a monetary threshold must be established for issuance of checks, warrants and bonds, which, require two manual signatures of designated City officials (the City Manager, Finance Director, City Clerk or in the event of emergency, the Mayor (or in the Mayor's absence the Vice -Mayor)). Instruments that fall below the monetary threshold will only require one official's manual signature and a facsimile signature of any other authorized official. The threshold of $ 2,500.00 has been recommended.
