HomeMy WebLinkAboutO-2005-004 Capital Improvements ElementORDINANCE NO. 2005-004 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING THE CAPITAL IMPROVEMENTS ELEMENT OF THE CITY OF DANIA BEACH COMPREHENSIVE PLAN TO CREATE NEW POLICIES APPLICABLE TO THE USE OF LOCAL OPTION FUEL TAX REVENUE IN CONNECTION WITH AN OBJECTIVE OF THE PLAN WHICH ADDRESSES CONSTRUCTION OF CAPITAL FACILITIES; PROVIDING FOR ADOPTION PURSUANT TO SECTION 163.3184, FLORIDA STATUTES; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City desires to amend its Comprehensive Plan Capital Improvements Element to create new policies applicable to use of local option fuel tax revenue in connection with an objective of the Plan which addresses construction of capital facilities; and WHEREAS, the City of Dania Beach Planning and Zoning Board, sitting as the Local Planning Agency, held a duly advertised public hearing on February 16, 2005, and determined that the proposed amendment is consistent with the goals and objectives of the City of Dania Beach Comprehensive Plan and, therefore, recommended approval of the proposed amendment; and WHEREAS, the City Commission of the City of Dania Beach held a duly noticed public hearing on March 9, 2005, regarding the proposed amendment and determined that the amendment is in the best interest of the City's public health, safety and welfare and should be adopted for transmittal to the Florida Department of Community Affairs for its review pursuant to Chapter 163, Florida Statutes; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: E 0 Section 1. That the amendments to the Capital Improvements Element of the City of Dania Beach Comprehensive Plan are adopted on first reading to create new policies applicable 0 to the use of local option fuel tax revenue in connection with an objective of the plan which addresses construction of capital facilities, as follows: 0 0 0 IV. REQUIREMENTS FOR CAPITAL IMPROVEMENTS GOALS, OBJECTIVES AND POLICIES 0 0 Objective 11 The capital improvements element will be utilized as a vehicle for the construction of capital facilities to address the existing deficiencies, to accommodate future growth and to replace obsolete facilities. 0 0 0 Poligy 2.7 Local option fuel tax shall be used for transportation expenditures needed to meet the requirements of the capital improvements element. Poligy 2.8 Local option fuel tax shall be used for expenditures needed to meet immediate local transportation needs and for other transportation related expenditures that are critical to building a comprehensive roadway network. Polia 2.9 Local option fuel tax can be used for the construction of new roads, the reconstruction or resurfacing of existing paved roads, or the paving of existing graded roads for pulposes of increasing roadway capacity or improving traffic safety. Expenditures for puKposes o 40 this paragraph shall not include routine maintenance of roads. 2 ORDINANCE #2005-004 0 Policy 2. 10 Local option fuel tax can be used for the construction of new sidewalks or bike paths or the reconstruction or resurfacing of existing sidewalks or bike paths for puEposes of improving pedestrian/bike accessibility or safety or for complying with the Americans with Disabilities Act ("ADA"). Expenditures for puEposes of this paragraph shall not include routine maintenance of sidewalks or bikeDaths. Policy 2.11 Local option fuel tax can be used to fund traffic -related improvements necessary to improve traffic and pedestrian safety. Traffic related improvements shall include but not be limited to, driveway relocation/modification, traffic control devices, intersection improvements, and traffic calming related improvements, improved lighting (replacement or modification lighting), median improvements (including landscaping and irrigation)� and seawall improvements relating to road stabilization near waterways. 0 0 0 Section 2. That the City Commission authorizes the City Manager to transmit the Capital Improvements Element amendment to the state agencies as required by Section 163.3184, Florida Statutes. Section 3. That the effective date of this Capital Improvements Element amendment shall be after the completion of the comprehensive plan amendment review process under Chapter 163, Florida Statutes, including the second reading and adoption of the amendment by the City Commission and, subsequently, the date a final order is issued by the Florida Department of Community Affairs finding the amendment to be in compliance in accordance with Chapter 163, Florida Statutes; or the date a final order is issued by the Administration Commission finding the amendment to be in compliance in accordance with Chapter 163, Florida Statutes. 3 ORDINANCE #2005-004 PASSED AND ADOPTED on first reading on March 9, 2005 (Transmittal stage) (4/ A�& C.K. APPLICANT: Community Development Department On February 22, 2005 the City Commission passed on first reading the proposed amendment to the Capital Improvements Element of the Comprehensive Plan. Since then the South Florida Regional Planning Council and the Florida Department of Community Affairs approved the proposed amendment. This ordinance was requested by the Finance Director to allow gas tax funds (collected by the State and distributed to the cities) to be used for road and sidewalk expenditures needed to meet local transportation needs. This includes safety and capacity related roadway improvement, driveway relocation/modification, traffic control devices, intersection improvements, traffic calming, improved lighting (replacement or modification lighting), median improvements (including landscaping and irrigation), and the construction of new sidewalks or bike paths for purposes of improving pedestrian/bike accessibility or safety or for complying with the Americans with Disabilities Act ("ADA"). Please note State Law does not allow gas tax funds to be used for routine maintenance of roads or sidewalks.
