HomeMy WebLinkAboutO-2005-024 Parking Code Modification off-street parkingORDINANCE NO. 2005-024 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA PERTAINING TO ZONING; AMENDING CHAPTER 28, "ZONING", OF THE CITY CODE OF ORDINANCES BY AMENDING ARTICLE 6, "SUPPLEMENTARY USE REGULATIONS", AMENDING SECTION 6.21, "OFF-STREET PARKING," TO REVISE THE PARKING REQUIREMENTS APPLICABLE TO CERTAIN RESIDENTIAL HOUSING, INCLUDING SINGLE-FAMILY AND TWO-FAMILY (DUPLEX) UNITS, MULTI -FAMILY HOUSING (INCLUDING LOFTS, EFFICIENCIES AND STUDIO APARTMENTS), TOWNHOUSES AND ROW HOUSES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Dania Beach has determined that revisions are needed to the City Zoning Code; and WHEREAS, the City's Planning and Zoning Advisory Board, at its May 18, 2005 meeting, sitting as the local planning agency, has reviewed this Ordinance and recommended its approval to the City Commission; and WHEREAS, the City Commission finds that this Ordinance is consistent with the City's adopted Comprehensive Plan and necessary for the preservation of the public health, safety and welfare of the City's residents; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Chapter 28, "Zoning", Article 6, "Supplementary Use Regulations", Section 6.2 1, "Off -Street Parking" of the Code of Ordinances of the City of Dania Beach, Florida is amended to read as follows: ARTICLE 6. That, except as amended above, all other provisions of Chapter 28 of the Code of Ordinances of the City of Dania Beach, Florida, as amended, shall remain in full force and effect. Section 3. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with the provisions of this Ordinance are repealed. Section 4. That if any section, clause, sentence or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. While most new single family homes provide 3 - 4 parking spaces, older homes usually provide only 1 or 2 spaces. This ordinance would not allow the conversion of a carport or garage space to living space unless the parking space was replaced elsewhere on the property. Staff was directed to bring back information regarding pervious paving materials for replacement parking spaces. This information is not currently available. If available by -7une 28, it will be distributed at the city commission meeting. 2) Single Family (Planned or Gated Communities on Private Roads): Parking for single family homes shall be 3 spaces (a garage can count as one parking space) plus 0.25 guest spaces per dwelling unit. Most new gated single family communities meet or exceed this requirement. The only change is a minimal 5% increase in guest parking. 3) Two family/Three Family: Three spaces per unit; no change. 4) Apartments, Row House, Townhouse: Parking to be based on the size of the unit or number of bedrooms. Optional parking requirements are offered to (a) encourage including garages in townhouse units, and (b) encourage shared parking among residents in apartment and condominium buildings. Please note this ordinance does not allow shared parking between commercial and residential uses occupying the same building. On May 18, 2005 the Planning and Zoning Board recommended approval of the proposed text amendment.
