BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Chapter 23, "Taxation", Article VI, "Service charges for processing lien information", Section 23-67 is amended to read as follows: Sec. 23-67. Charges for preparing and recording liens and lien satisfactions. The following charges are imposed in connection with liens and lien satisfactions: Lien preparation and recording ... $55-00 $40-00 processing fee plus actual cost of recording charged by the County. Lien satisfaction preparation (recording by city) ... 45.00 $30.00 processing fee plus actual cost of recording charged by the Count Reeer-ding by part), other than eity . . . 10. 00 Section 2. That if any section, clause, sentence or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this Ordinance are repealed. Section 4. This ordinance was last amended December 10, 1991. Since then, the Board of the County Commissioners has made numerous increase of fees of which the current amount stated in the ordinance does not cover the cost incurred by the City. The Board of the County Commissioners charges $10.00 for the first page and $8.50 per subsequent pages for each recording and release. Under Code violations, the City usually has to file around 9 pages, Unsafe Structure will usually require 3 pages, and other liens such as lot mowing etc. will require one to two pages. Finance is recommending a processing fee of $40.00 for recording (which will include certified postage and staff time) plus the actual cost of recording the pages by the County. As for release of lien, the processing is less time consuming, and staff is recommending a processing fee of $30.00 plus the actual cost charged by the County. 0 NOTICE OF HEARING BEFORE CITY COMN41SSION CITY OF DANIA BEACH, FLORIDA, REGARDING ADOPTION OF THE FOLLOIA71NG PROPOSED ORDINANCES: NOTICE IS GIVEN that on June 28, 2005, at 7:00 p.m. or as soon thereafter as the matter maybe heard, the City Commission of the City of Dania Beach.
