HomeMy WebLinkAboutO-2005-025 Empty Garbage Carts (Ch 13)ORDINANCE NO. 2005-025 AN ORDINANCE AMENDING CHAPTER 13, "HEALTH AND SANITATION", ARTICLE IV, "GARBAGE AND TRASH", SECTION 13-74, "GARBAGE COLLECTION BY PRIVATE HAULERS, PERMITS REQUIRED", OF THE CODE OF ORDINANCES OF THE CITY OF DANIA BEACH, FLORIDA, TO REQUIRE EMPTY GARBAGE CARTS AND OTHER RECEPTACLES TO BE REMOVED FROM ROAD RIGHTS -OF -WAY AND THE FRONT YARDS OF RESIDENTIAL PROPERTY BY DUSK ON THE DAY OF GARBAGE AND TRASH PICK-UP; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Chapter 13, "Health and Sanitation", Article IV, "Garbage and Trash", Section 13-74, "Garbage collection by private haulers, permits required", of the City Code of Ordinances, is amended to read as follows: ARTICLE IV. GARBAGE AND TRASH 0 0 0 Sec. 13-74. Garbage collection by private haulers, permits required. 0 (c) Prior placement and removal of items. No garbage, trash5�r recyclables or- bulk tr-ash items to be collected by a private hauler, or the city's hauler, shall be placed on the right-of-way for a period longer than twenty-four (24) hours prior to collection. In addition. all aarbai2e carts and all other receDtacles shall be removed from the road ri6t- of-wav and from the front vard of anv residential Dror)ertv no later than dusk of the day of collection. 0 Section 2. That, except as amended above, all other provisions of Chapter 28 of the Code of Ordinances of the City of Dania Beach, Florida, as amended, shall remain in full force and effect. Section 3. That all ordinances or parts of ordinances and all resolutions or parts of 0 resolutions in conflict with the provisions of this Ordinance are repealed. 0 0 0 Section 4. That if any section, clause, sentence or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance.
