AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA
PERTAINING TO SITE PLAN APPROVAL; AMENDING SECTION 8-4 OF
CHAPTER 8 OF THE CITY CODE OF ORDINANCES TO CHANGE THE
EXPIRATION TIME OF SUCH APPROVALS FROM 18 MONTHS TO 12
MONTHS AFTER CITY COMMISSION APPROVAL; PROVIDING THAT
SUCH APPROVAL WILL AUTOMATICALLY EXPIRE UPON SALE OF THE
PROPERTY UNLESS REVIVED BY APPROVAL OF THE CITY
COMMISSION; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. .
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, THAT:
Section 1. That Section 8-4, "Site plan as condition to building permit" of Chapter 8,
"Buildings", of the City Code of Ordinances is amended to read as follows:
A site plan shall be required as a condition to the issuance of a building permit. The
application for site plan approval shall be accompanied by a survey and land use plan depicting
site utilization. The site plan shall be drawn to scale and shall indicate the following sufficiently
for consideration of visual, safety and economic factors:

(p) That in addition to the site plan specifications stated hefei above, the elevations of
all sides of all structures located ther-eon the plan must be shown with enough specificity to give the
reviewing parties a clear illustration of all structures and landscaping appearing dwefeon the pla .
Any substantial changes or deviations of said the plans must be approved by the city commission.
All site plan approvals shall automatically expire and become null and void unless building pen -nits
are obtained on or before 4S 12 months from the dat� of approvals of the plan by the city
commission. Any request for extension of site plan gpproval before its expiration date will be
treated and processed as a site plan amendment. Apy request to review a site plan approval which
has expired ill be treated and processed as an appeal to the Cily Commission. Furthermore, an
such approval shall automatically expire if the affected propegy is sold and may only be revived if
approved by the Cijy Commission;

Section 2. That all ordinances or parts of ordinances in conflict with the provisions of
this Ordinance are repealed.
Section 3. That this ordinance shall be effective immediately at adoption on second
reading.

RE: Amendment to Site Plan Approval Ordinance
As recently discussed at the last CRA meeting, the City ordinance pertaining to site
plan approvals can be amended to provide that any such approval will automatically expire if
the subject property is'sold. Additionally it has been recommended that the "life" of such an
approval be reduced from 18 months to 12 months (i.e., if building permits are not issued
before the time period expires, the approval expires).

ADOPTION OF THE FOLLOWING PROPOSED ORDINANCES:
NOTICE IS GIVEN that on October 25, 2005, at 7:00 p.m. or as soon thereafter as the matter
may be heard, the City Commission of the City of Dania Beach, Florida, will conduct a public
hearing in the Commission Chamber at Dania Beach City Hall, 100 West Dania Beach
Boulevard, Dania Beach, Florida, to consider the proposed adoption of the following Ordinances:

AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA
PERTAINING TO FLOOD DAMAGE PREVENTION; AMENDING
CHAPTER 12, ENTITLED "FLOOD DAMAGE PREVENTION", ARTICLE 1,
ENTITLED "fN GENERAL", TO PROVIDE THAT CITY FLOOD
ELEVATIONS FOR BOTH RESIDENTIAL AND NON-RESIDENTIAL
CONSTRUCTION SIIALL MEET THE BASE FLOOD ELEVATION AS
SPECIFIED ON THE FLOOD INSURANCE REQUIREMENTS OF THE

Copies of the proposed Ordinances are on file in the Office of the City Clerk, City Hall, 100 West
Dania Beach Boulevard, Dania Beach, Florida, and may be Inspectedby the public during normal
business hours.
Interested parties may appear at the aforesaid meeting and be heard with respect to the proposed.
Any person who decides to appeal any decision made with respect to any matter considered at
this hearing will need a record of the proceedings and for such purpose may need to ensure that a
verbatim record of the proceedings is made, which record includes the testimony and evidence
upon which the appeal is to be based.
In accordance with tile American with Disabilities Act, persons needing assistance to participate
in any of the proceedings should contact the City Clerk's Office, 100 West Dania Beach
Boulevard, Dania Beach, Florida 33004, (954) 924-3622 at least 48 hours prior to the meeting.
