AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA,
AMENDING CHAPTER 1, "GENERAL PROVISIONS", SECTION 1-8,
"GENERAL PENALTY; CONTINUING VIOLATIONS; VIOLATION AS
PUBLIC NUISANCE" TO AMEND THE IMPRISONMENT TERM FROM A
PERIOD NOT EXCEEDING NINETY (90) DAYS TO A PERIOD NOT
EXCEEDING SIXTY (60) DAYS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA:
Section 1. That Chapter 1, "General Provisions", Section 1-8, "General Penalty;
continuing violations; violation as public nuisance", of the City Code of Ordinances is amended
to read as follows:
0 Chapter 1. General Provisions.
Section 1-8. General Penalty; continuing violations; violation as public nuisance
Whenever in this Code, or in any ordinance or resolution of the city, or rule, regulation or
order promulgated by any officer or agency of the city under authority duly vested in him or it,
any act is prohibited or is declared to be unlawful, or the doing of any act is required or the
failure to do any act is declared unlawful and no specific penalty is provided for the violation
thereof, the violation of any such provision of this Code or any such ordinance, resolution, rule,
regulation or order shall be punished by a fine of not more than five hundred dollars ($500.00),
or by imprisonment for a period not exceeding ninety (90) sixty (60) days, or by both such fine
and imprisonment. Each day any violation or any provision of this Code or of any such
ordinance, resolution, rule, regulation or order shall continue shall constitute a separate offense.

0 Section 2. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this ordinance.
Section 3. That all ordinances or parts of ordinances in conflict with the provisions of
this Ordinance are repealed.
Section 4. That this Ordinance shall be in force and take effect immediately upon
adoption.

RE: Proposed Amendment to Section 1-8, City Code of Ordinances; Maximum
Imprisoament Term for City Ordinance Violations
In order to avoid any difficulties with a possible legal challenge to the penalty
provisions of the City Code of Ordinances, it is proposed that the maximum imprisonment
term for violation of a City ordinance be reduced from ninety to sixty days. This is advisable
in light of a court ruling we have reviewed.
This is ready for City Commission consideration.
