ROLL CALL The meeting was called to order at approximately 7:00PM by Vice Chair Rimoli. Board Clerk Ibel Larios called the roll. City Attorney Eve Boutsis explained that there was a new Board Member, Deborah Bell, sitting in the audience tonight who was not technically part of the Board yet as she was not sworn in. She was appointed and observing tonight. The City Attorney explained why she felt that the Board should vote on her excusal tonight. Discussions/actions notated were not limited to what was typed. Approval of Minutes of the Planning and Zoning Board / Local Planning Agency from the December 20, 2023 regular meeting. Motion was made by Board Member Hankerson to approve the minutes of the meeting of the Planning and Zoning Board/Local Planning Agency for December 20, 2023 as presented and was seconded by Board Member Stowers. Motion passed 5-0. Planning and Zoning Board/Local Planning Agency Minutes 2 January 17, 2024 III. PUBLIC HEARINGS 1. (Continued to February 21st Meeting) Vice Chair Rimoli read the item into the record and explained that it would be continued to the February 21, 2024 Meeting but as this was a public hearing, he called for public comments. City Attorney Boutsis further explained that this was a Staff request to continue to February 21, 2024. David Reich inquired if the first reading would now be February 21, 2024 as nothing was happening tonight. The City Attorney clarified that it would be the first reading (presentation) in front of the Planning and Zoning Board on February 21, 2024 and then it would go to the City Commission after that. Motion was made by Board Member Stowers to continue this item to the February 21, 2024 Planning and Zoning Board/Local Planning Agency Meeting and was seconded by Board Member Hankerson. Motion passed 5-0. 2. CD-095-23: Consideration to approve and transmit to Broward County and the Florida Department of Commerce the proposed Commerce Evaluation and Appraisal Report (EAR) based amendments and map series to the City’s Comprehensive Plan. Community Development (CD) Deputy Director Lajoie introduced the City’s consultant, Nilsa Zacarias from Chen Moore and Associates, who would give the presentation. She explained that the amendment was based on the attributes of a sustainable community. She reminded that what they were doing was due to a requirement of Florida Statutes and that every seven years the local government had the opportunity to review their comprehensive plan which was their guiding document. While going over the review and approval process, she reminded about the February 27, 2024 City Commission First Reading, and that this whole document would go to State and other agencies to provide compliance with Florida Statutes. She further explained that everything the Board saw which was underlined were new policies and everything with a strikethrough were deleted. Board Member Hankerson asked how long the whole process would take and was given the timetable including receiving the State’s ORC (Objections, Recommendations, and Comments) Report. She spoke about basically six months’ time to adjust the document if there were many “back and forth” with the State. He further asked about Objective 1.2.1, Wildlife Habitats. Board Member Hankerson talked about his concern regarding protecting Wildlife Habitats in the face of development for the future. Ms. Zacarias explained working closely with Deputy Director Comm Dev Lajoie as this was very important. She went over things like Housing and Neighborhoods, Transportation, Infrastructure, Coastal Management, Conservation, Parks and Recreation, Intergovernmental Coordination, Capital Improvements, and Public Schools. Board Member Hankerson asked if the State would assist and lift up or scrutinize the City’s Coastal Management. Ms. Zacarias spoke about the State ensuring that the City was in compliance with Florida Statutes. Vice Chair Rimoli asked in regard to Conservation, why we just did not state “use native plants” and not “we encourage the use of native plants”. She explained that the goal was to conserve and protect while policy used words to encourage and consider. Vice Chair Rimoli asked for clarification that after the second reading, the document went to the State. City Attorney Boutsis clarified that since this would be adopted as an Ordinance, there had to be two City Commission Readings. As there were no further Board questions/comments, the Chair opened the floor to the public. David Reich had three questions. How would the Comprehensive Plan address: Planning and Zoning Board/Local Planning Agency Minutes 3 January 17, 2024 1) protecting the property rights of land owning citizens of Dania Beach from being negatively impacted by nearby local development decision making of the City? 2) protecting against a drop in property values caused by nearby local development decisions made by the City? 3) protecting the neighborhood character and the health, safety and welfare of the citizens of Dania Beach from being negatively impacted by nearby local development decision making of the City? City Attorney Boutsis reminded that the Comp Plan was a visionary document so it had aspirational goals, policies and objectives. They were very broadly written and talked about the balance between sustainability and development. This broad document covered many different issues. It came down to Land Development Regulations and Implementation. We were constantly updating our Code and trying to improve it. Vice Chair Rimoli spoke about how voting elected officials into office made a big difference in the way people see Dania Beach in the future. Policy makers were the elected people. City Staff tried hard to make the right decisions and he felt we were in a good place. They try to balance development with quality of life but not everyone would be pleased. He thanked the public speaker for his good questions. Board Member Hankerson said that the public needed to keep showing up so the Board could hear from them. Board Member Stowers thought they were good, subjective questions and encouraged Mr. Reich to keep coming back. As there were no further questions/comments, the Vice Chair called for a motion. Motion was made by Board Member Hankerson to approve and transmit this agenda item and was seconded by Board Member Granett. Motion passed 5-0. IV. BOARD ITEMS 1. Moody claims that voters will be confused about what a “health-care provider” is, how much power they will have to determine what “health” means, and what consti-tutes “viability.”“The ballot summary here is part of a … design to lay ticking time bombs that will enable abortion proponents later to argue that the amendment has a much broader meaning than voters would ever have thought,” she argued in a 50-page brief.Floridians Protecting Freedom, supported by other reproductive rights organizations, plan to argue the wording is perfectly clear to voters. “The proposed amendment is clear and precise in limiting government interference with abortion ‘before viability,’” Floridi-ans Protecting Freedom Campaign Director Lauren Brenzel said in an October written statement. “Viability in the abortion context has always meant the stage of fetal development when the life of a fetus is sustainable outside the womb through standard medi-cal measures. Voters know what viability means, and they will see right through this effort to silence their voice.”If Moody prevails and the Flor-ida Supreme Court accepts her argument, the right to decide abor-tion access goes to state lawmakers — at least for now. Already, those lawmakers have voted to restrict abortion in Florida.After the reversal of Roe v Wade in June 2022 gave authority back to individual states to decide abortion limits, Florida lawmakers approved a 15-week ban that was signed into law by Gov. Ron DeSantis effective July 2022. Previously, women in the state could get abortions up until the 24th week of pregnancy. Then, last year, Florida lawmakers approved a six-week ban. That new six-week restriction would take effect if the Florida Supreme Court upholds the 15-week ban, which is being chal-lenged. While the court hasn’t ruled on that yet, five of the seven justices were appointed by Gov. Ron DeSan-tis, who endorses the restrictions.Brenzel says the reason for the proposed 2024 amendment is to give the decision on abortion access back to Floridians. “Florid-ians have shown they want to see this initiative on the ballot,” she said in a written statement. “All Florid-ians deserve the freedom to make personal medical decisions, includ- ing about abortion, free of govern-ment intrusion.”Most polls show that voters support abortion rights regardless of their party.Leading up to the oral argu-ments, both sides of the abortion access debate held media briefings this week to make their voices and perspectives heard.Committee to Protect Health Care assembled doctors via Zoom to support the ballot intiative and publicize their view that “medical decisions are put back in the hands of patients and their physicians.” Florida Voice for the Unborn held a rally in Tallahassee to “demon-strates our united opposition to the abortion industry’s extreme proposal to enshrine the right to abortion (until birth) in our state’s governing document.”A new state report shows Flori-da’s 78,250 recorded abortions last year, a drop of about 4,000 from the previous year. However, 2023 was the first full year with the 15-week ban in effect. Of those, 7,100 women traveled to Florida from another state or country to end their preg-nancies.“A six-week ban in Florida would definitely change the entire ecosys-tem of this work we do,” Christine Montero, a coordinator for Access Reproductive Care-Southeast told the Orlando Sentinel. Vote from Page 1 By Susannah Bryan South Florida Sun Sentinel A green Kawasaki motorcycle was lying in a wreck on a Flor-ida Turnpike exit ramp Thurs-day, but the body of the driver was nowhere to be found.Turns out he’d fallen into a canal below the exit ramp.The body of a 40-year-old Hollywood man was pulled from a Plantation canal near the Turn-pike on Saturday.Two days earlier, the man was heading north on the Turnpike and took the exit ramp to Sunrise Boulevard when he crashed, said Lt. Indiana Miranda, a spokes-person for the Florida Highway Patrol.Rescue workers responded to the scene but could not find the driver. At the time, they did not realize he’d fallen into the canal below, Miranda said.The man’s body was not discov-ered until Saturday.Highway Patrol officials have not released the man’s name. Body found in canal after accident By Jim Saunders News Service of Florida TALLAHASSEE — A federal appeals court Thursday said a Florida law restricting people from China from owning prop-erty in the state likely is trumped by federal law and blocked its enforcement against two plain-tiffs who have been in the midst of real-estate transactions.A three-judge panel of the 11th U.S. Circuit Court of Appeals declined to issue a broader injunction, in part pointing to oral arguments that will be held in the case in April.But the panel said the plain-tiffs “have shown a substantial likelihood of success on their claim” that the Florida law is “preempted” by a federal law known as the Foreign Investment Risk Review Modernization Act of 2018. Generally, federal laws take precedence over state laws if there is a conflict.The federal law includes what is known as the Commit-tee on Foreign Investment in the United States, or CFIUS, which has power to review real-estate transactions involving certain people from other countries.In a November brief, attorneys for the plaintiffs argued the state law “wrests control of foreign affairs from the federal govern-ment and replaces Congress’s carefully crafted approach with the far more draconian regime Florida prefers.”Four individual plaintiffs and a real-estate broker filed the legal challenge last year after Gov. Ron DeSantis and the Repub-lican-controlled Legislature approved the restrictions while citing a need to curb the influence of the Chinese government and the Chinese Communist Party in Florida.The law (SB 264) affects people from what Florida calls “foreign countries of concern” — China, Russia, Iran, North Korea, Cuba, Venezuela and Syria. But the legal battle focuses on specific restric-tions on people from China who are not U.S. citizens or permanent U.S. residents.Those restrictions prevent people “domiciled” in China from purchasing property in Florida, with some exceptions. Such people each would be allowed to purchase one resi-dential property up to two acres if the property is not within five miles of a military base and they have non-tourist visas. Three of the plaintiffs are in the United States on visas, while one is seeking asylum. The real-estate broker, Multi-Choice Realty, serves a large number of Chinese clients.The lawsuit raised a series of arguments, including that the law violates equal-protection rights and the federal Fair Hous- ing Act. But U.S. District Judge Allen Winsor in August denied a request from the plaintiffs for a preliminary injunction, saying they are unlikely to be able to show the law was motivated by discrimination or lacks a “ratio-nal basis.”The plaintiffs took the case to the Atlanta-based appeals court. The panel Thursday approved a partial preliminary injunction that applies to plaintiffs Yifan Shen and Zhimeng Xu.
