WHEREAS, the City identified the need to alleviate flooding from rain events on SW 31 st
Avenue , SW 29 th Terrace , SW 29 th Way , SW 29 th Avenue , SW 51 st Street and SW 28 th Terrace , in
the P J Meli Park neighborhood ; and
WHEREAS, the City is requesting authorization to bid the project when the design is
complete; and
WHEREAS, Kimley Hom and Associates ("KHA") was selected as one of fifteen firms
for continuing design/engineering contract services under RFQ No . 20-005 , per the Consultants
Competitive Negotiation Act ("CCNA"), pursuant to Resolution No . 2021-007 , and the City
Administration recommends engaging KHA to conduct design , bid assistance and construction
management services for the Project under the CCNA continuing contract provision; and
WHEREAS, KHA submitted a proposal , which proposal is attached as Exhibit "A" and
incorporated into this Resolution by this reference , for the design, bid assistance and construction
management for the PJ Meli Park Neighborhood Drainage Improvement Project in the amount of
Two Hundred Forty Seven Thousand Three Hundred Forty Dollars ($247 ,340.00) which will require
a budget transfer.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the above "Whereas" clauses are ratified and confirmed, and they are
made a part of and incorporated into this Resolution by this reference.
Section 2. That funding for the Project in the amount of Two Hundred Forty-Seven
Thousand Three Hundred Forty Dollars ($247 ,340.00) will be appropriated within the
Stormwater Infrastructure Improvements other than Bldgs. Account No. 403-38-34-538-63-10
through a transfer from Stormwater Fund Unrestricted Net Assets account no. 403-276-00-00 .
Section 3. That the City is authorized to proceed with bidding for construction of the
project.
Section 4. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 5. That this Resolution shall be effective 10 days after passage.

This is a Work Order, dated ________ , 2024, issued by the City of Dania
Beach, Florida (the "City") to Kimley-Horn and Associates (the "Consultant"), in connection
with an Agreement dated April 2l5t, 2021, existing between the City and the Consultant, which
Agreement is incorporated by this reference.

Scope of Services for Professional Engineering Design Services
Dear Mr. Ozaydin:
Kimley-Horn and Associates, Inc., (hereinafter referred to as "CONSULTANT" or "We"), in
connection with the City of Dania Beach's "Continuing Architectural, Surveying, Landscape
Architecture and Engineering Consulting Services"; RFQ 20-005 is pleased to submit this
proposal to the City of Dania Beach, (hereinafter referred to as "CITY") to provide professional
services. Our project understanding, scope of services, schedule, and fees are below.
SCOPE OF SERVICES
Kimley-Horn will provide the services specifically set forth below.
PROJECT UNDERSTANDING
The project area is bound by Griffin Road to the North, SW 31 st Avenue to the West, SW 28th
Terrace to the east and SW 51 st Street/SW 52 nd Street to the south, displayed in the image
below. The neighborhood is comprised of residential single-family homes with limited existing
drainage infrastructure that appears to have no offsite discharge. Portion of the roadway are low
lying and are not interconnected to any existing drainage system. The CITY has received
resident complaints of flooding throughout the corridor.
CONSUL TANT will prepare construction documents for recommended improvements for this
project area. CONSULTANT will proceed with the construction design documents, regulatory
permitting assistance, bidding assistance and limited construction phase services for the
recommended stormwater improvements according to the scope of services outlines within the
following sections.

Scope of Services
Task 1 -Site Investigation Task
Task 1.1 -Topographic Survey
The CONSUL TANT will engage a sub-consultant (licensed surveyor) to prepare a topographic
survey for approximately ±7,500 feet x 50 feet wide along SW 31 st Avenue, SW 29 Terrace, SW
29 th Way , SW 29 th Avenue, SW 28 th Terrace and portion of SW 51 st Street located south of
Griffin Road. The survey will include the following:
• Obtain sufficient control monumentation, if available, to graphically depict limits of
property. This is not a boundary survey.
• Locate above ground improvements include pavement, curbs, sidewalk, swales, berms,
retention areas and above ground evidence of utilities . Obtain rim elevations and inverts
of sewer and drainage structures. Utility locations will include fire hydrants, water valves ,
meter boxes, vaults and main irrigation valves. Individual sprinkler heads are not
included.
• Obtain spot elevations on points of location and on approximate SO-foot grid with high
and low points extending 5 feet east and west of existing walks within the limits.
The topographic survey will be in accordance with Standard of Practice as set forth in Chapter

The CONSUL TANT will coordinate directly with the surveyor to ensure the appropriate data is
gathered during the completion of the topographic survey. CONSUL TANT will review
topographic data upon completion of the survey and provide the comments to the surveyor, if
necessary. CONSULTANT will utilize the AutoCAD version of the topographic survey and
establish the base plans for the project. This task will be completed within 120 calendar days
from the issuance of the Notice to Proceed by the CITY. All work under this task will be billed on
a lump sum basis.
Task 1.2 -Subsurface Utility Verification
The CONSUL TANT will retain a subsurface utility engineering consultant to conduct up to 20
utility testholes to confirm the location of any existing underground utilities within the project
limits. The completion of utility testholes will be necessary to avoid conflicts between the
proposed underground improvements and existing underground utility infrastructure within the
public right of way. CONSUL TANT will review the utility testhole report upon completion and
provide any comments to the subsurface utility engineering consultant, if necessary.
CONSUL TANT will incorporate the existing underground utilities into the base plans for the
project based on the information included within the utility testhole reports. CONSUL TANT will
complete this task within 120 calendar days from the issuance of the Notice to Proceed by the
CITY. All work under this task will be billed on a lump sum basis.
Task 1.3 -Geotechnical Investigation
The CONSULT ANT will retain a geotechnical engineering firm to acquire the soil information to
estimate subsurface soil conditions, soil infiltration rates, and soil permeability. This task
includes the completion of five (5) Standard Penetration Test (SPT) soil borings with a depth of
10 feet to verify the subsurface soil conditions and two (2) exfiltration tests to a depth of six (6)
feet within the project area. CONSUL TANT will complete this task within 120 calendar days
from the issuance of the Notice to Proceed by the CITY. All work under this task will be billed on
a lump sum basis.
Task 1.4-Document Research/Review
The CONSULT ANT will review readily available topographic surveys, atlas/as-built drawings,
design drawings, record drawings, permit documents and/or master plans relevant to the project
limits. CONSULTANT will use this information to determine and verify the configuration of
existing conditions along with limitations on the proposed improvements. CONSUL TANT will
also review plat maps for the project areas to confirm the presence of utility easements.
CONSULTANT will contact the Sunshine State One Call Service to determine the existing
utilities which are located in the project area. As necessary, CONSULTANT will coordinate
directly with the utility providers with existing infrastructure within the project area to obtain any
available system maps. CONSULT ANT will incorporate the approximate location of the existing
underground utilities into the design plans based on readily available drawings. CONSUL TANT
will complete this task within 60 calendar days from the issuance of the Notice to Proceed by
the CITY. All work under this task will be billed on a lump sum basis.

Task 1.5 -Project Site Visits
CONSUL TANT will perform necessary site visits to the project area to verify the impact of the
existing conditions on the configuration of the proposed improvements. CONSUL TANT will walk
the entire site within the project limits and obtain photographs of potential obstruction and
encroachments that may impact the proposed improvements. CONSUL TANT will conduct site
visits to confirm the accuracy of the topographic survey and to identify potential impacts on the
proposed improvements. As necessary, CONSUL TANT will conduct site visits throughout the
design process to review the existing conditions . All work under this task will be billed on a lump
sum basis.
Task 2 -60% Design Documents
CONSUL TANT will prepare and submit 60% design documents for SW 29 th Terrace Stormwater
Improvements to the CITY for review and approval. All work under this task will be billed on a
lump sum basis. The design documents for this task will include the following items:
• Existing Condition Plans
• Stormwater Plans (plan view only)
• Paving and Grading Plans
• Pavement Markings and Signage Plans
• Relevant Detail Plans
• Opinion of Probable Cost
CONSUL TANT will develop an ICPR stormwater model to conduct a detailed analysis of the
project area. CONSUL TANT will subdivide the project area into multiple drainage basins to
allow for the more detailed analysis of the project area. CONSUL TANT will tabulate the model
parameters of the relevant nodes and links within the stormwater model to reflect the basin
boundaries within the project area. CONSUL TANT will run the stormwater model to obtain peak
flood stages, flood durations, and peak discharges for the existing conditions within the project
area. CONSUL TANT will also utilize the stormwater model to assess the effectiveness of the
potential system improvement. CONSUL TANT will utilize this stormwater model during the
permitting phase of the project.
CONSUL TANT will coordinate with the Florida Department of Transportation (FOOT) during this
task to collect relevant data about their drainage system. CONSUL TANT will model the
proposed flow and impact to the FOOT drainage system within the project limits. This
stormwater model will be required prior to the permitting phase to justify this connection to
FDOT's system.
CONSUL TANT will submit the 60% Design Documents within 60 calendar days from the
completion of Task 1-Site Investigation.
Task 3 -90% Design Documents
CONSUL TANT will prepare and submit 90% design documents for SW 29 th Terrace Stormwater
Improvements to the CITY for review and approval. All work under this task will be billed on a
lump sum basis. The design documents for this task will include the following items:

CONSULT ANT will submit the 90% Design Documents within 30 calendar days upon the receipt
of the CITY review comments on the 60% Design Documents.
Task 4 -Regulatory Permitting Assistance
KHA will prepare permit applications with supporting documentation to the following jurisdictional
regulatory agencies. KHA will address up to two (2) rounds of comments for the regulatory agency
submittals identified below. Any plan revisions or comments that are required due to a significant
design change by the CITY shall result in an additional service.
1. South Florida Water Management District (SFWMD)-Environmental Resource
Permit (if required)
2. Broward County Environmental Protection and Growth Management Department
(BCEPGMD)-Surface Water License
3. Broward County Traffic Engineering Division-pavement marking and signage
4. SFWMD/BCEPGMD-Water Use Dewatering
5. FOOT-Drainage connection
6. City of Dania Beach-impact to existing trees
The regulatory agencies typically complete their initial review within 30 calendar days after the
permit submittal. The required permit approvals must be obtained from the regulatory agencies
prior to submitting the 100% Design Documents to the CITY. All work under this task will be
billed on a lump sum basis.
No other agency approvals are included in this scope of services other than those identified
above. KHA does not guarantee the issuance of permits or approvals. If permits are issued for
this project, the conditions and expiration dates are the sole responsibility of the CITY. KHA is not
responsible for extending time limited entitlements or permits. KHA can provide hourly additional
services to file for extensions, if applicable, provided the CITY issues a direct written request for
each requested entitlement, prior to the dates of expiration. The CITY shall provide all permit fees.
Task 5-100% Design Documents
CONSULTANT will prepare and submit 100% design documents for SW 29th Terrace
Stormwater Improvements to the CITY for review and approval. All work under this task will be
billed on a lump sum basis. The design documents for this task will include the following items:
• Existing Condition Plans
• Stormwater Plans

• Technical Specifications
• Opinion of Probable Cost
• Bid Schedule
CONSUL TANT will submit the 100% Design Documents to the CITY for incorporation into the
bidding documents within 30 calendar days from the receipt of all permit approvals.
Task 6 -Bidding Assistance
CONSUL TANT will assist the CITY with the preparation of the bid advertisement and bid
documents for SW 29 th Terrace Stormwater Improvements. CONSUL TANT will attend the Pre-
BID Meeting and will answer questions and clarifications from potential bidders that are
technical in nature. CONSUL TANT will respond to written questions requesting clarification of
the technical documents for this project. The CITY shall be responsible for bid advertisement,
distribution of bid documents to interested bidders , processing all bid submittals, and verification
that each bid submittal meets all Purchasing related requirements. CONSUL TANT will complete
this task according to the schedule defined by the CITY for the bidding process.
CONSUL TANT will review the final bid results and make a recommendation for bid award.
CONSUL TANT will evaluate the qualification and prior project conformance of the low bidder .
CONSUL TANT will prepare and submit a bid recommendation letter to the CITY .
CONSUL TANT will complete this task according to the schedule defined by the CITY for the
bidding process.
Task 7 -Limited Construction Phase Services
The following scope is based on a six (6) month construction duration and on the post design
hours shown below for this task.
• The CONSUL TANT will attend and prepare minutes for a pre-construction meeting. One
meeting will be scheduled for the project.
• The CONSULTANT will review shop drawings , and submittals to determine compliance
with the drawings and specifications and recommend submittal action to the CITY.
• The CONSUL TANT shall make periodic site visits for the purpose of determining general
compliance with the approved project drawings, plans, and specifications. Site visits will
be performed by the CONSUL TANT's inspector. Two (2) site visit per month estimated at
three (3) hours per visit. Assume twelve (12) site visits. The CONSUL TANT will provide
site reports for each visit.
• The CONSUL TANT shall provide written responses to RFls. Assumes 1 RFI per month.
• The CONSUL TANT shall assist the CITY with review of the Contractor's request for
payments and provide comments and/or recommendations. Assume 6 request for
payment packages. This scope of work does not include assisting the CITY with
preparation or subm ittal of reimbursement packages associated with the Hazard Mitigation
Grant Program (HMGP) DR-4337-334 -R, the Florida Division of Emergency Management,
or the Federal Emergency Management Agency (FEMA).

• Once the Contractors advise that their project is substantially complete, the
CONSUL TANT will participate in a substantial completion walk through and prepare a
project punch list.
• Once the Contractors advise that the project punch list is complete, the CONSUL TANT
will participate in a final completion walk through to confirm items have been addressed.
• The CONSUL TANT will coordinate permit closeout processes for the agencies list in Task
4 above.
The CONSULT ANT shall not be responsible for the acts or omissions of any Contractor or
subcontractor, any of the Contractor(s)' or subcontractor(s)' agents or employees, or any other
persons (except the CONSULTANT's own employees and agents) at the site or otherwise
performing any of the Contractor(s)' work.
All work under this task will be billed on a lump sum basis.
Task 8 -Reimbursable Expenses-Document Reproduction
CONSULTANT will provide document reproduction required for each project deliverable to the
CITY and regulatory agencies as defined within the scope. All printing costs for deliverable will
be reimbursed by the CITY at cost.
Task 9 -Miscellaneous Services
Miscellaneous services as requested by the CITY outside of items defined within the scope
above, including but not limited to additional engineering services, geotechnical services,
environmental services, permitting and additional construction phase services. All work under
this task will be billed on an hourly not to exceed basis.
Deliverables
CONSUL TANT will provide the following deliverables at each submittal:
Design Documents:
• Three (3) half size (11" x 17") at each submittal
• One (1) digital copy (AutoCAD format) at each submittal
• One (1) digital copy (PDF format) at each submittal
Technical Specifications:
• One (1) hard copy at each relevant submittal
• One (1) digital copy (PDF format) at each relevant submittal
Project Assumptions
• The CITY will provide all available topographic surveys, atlas/as-builts, record drawings,
permit documents, reports and/or master plans relevant to the project area.
• This scope does not include any services required for easement or right-of-way
acquisitions.

• Drainage Well (Gravity or Pressurized) or stormwater pump station design is not included
in scope of seNices.
• Raising existing roadway elevations is not included in the scope of seNices.
• Drainage modeling will only be provided for the areas within the Project limits.
• The CITY will provide all required permit fees .
• The selected contractor will be responsible for obtaining any City of Dania Beach Building
Permit required for this project along with all related coordination and preparation of any
backup documentation required for the City of Dania Beach Building Permit.
CONSUL TANT will only be responsible for reasonable revisions requested by the City of
Dania Beach Building Department.
• The CITY will provide timely responses to information included within each submittal.
• The CITY shall be responsible for bid advertisement, distribution of bid documents to
interested bidders , processing all bid submittals, and verification that each bid submittal
meets all Purchasing related requirements .
• CONSUL TANT will submit monthly invoices, which will be payable by CITY within 25 days.
• The CITY will reimburse CONSUL TANT for any document reproduction costs for all
submittals to regulatory agencies.
• Reimbursable expenses for mileage for any site visits have been included in the lump sum
fees.
• Add itional reimbursable expense requested by the CITY outside of the items defined
within scope , such as additional land suNeying, geotechnical testing, utility testholes,
laboratory testing, permit fees , shall be invoices as defined in our contract agreement with
the CITY.

The terms and conditions of the City of Dania Beach Request for Qualifications (RFQ) No. 20-
005, City of Dania Beach's "Continuing Architectural, Surveying, Landscape Architecture and
Engineering Consulting Services"; shall govern this scope of services.
If you concur with the foregoing and w ish to direct us to proceed with the aforementioned
services , please issue a Notice to Proceed in writing to the CONSUL TANT. Fees and time
stated in this agreement are valid for sixty (60) days after the date of issuance by the
CONSUL TANT.
