HomeMy WebLinkAboutR-2024-074 Turn Two Construction Inc Bid Award for Sale of CRA Property Located at 608 W Dania Beach BlvdRESOLUTION NO.2024-1-L`-1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AUTHORIZING THE SALE OF A CRA-OWNED PROPERTY LOCATED AT 608 WEST DANIA BEACH BOULEVARD, DANIA BEACH, FLORIDA ("PROPERTY") TO TURN TWO CONSTRUCTION, INC., FOR THE PURPOSE OF DEVELOPING THE PROPERTY FOR USE AS FOR -SALE, LOW-INCOME AFFORDABLE HOUSING (80% AMI) PRODUCT; AND IF NOT POSSIBLE AFTER SIX (6) MONTHS OF DILIGENT INQUIRY, TO OBTAIN A PURCHASER AT 80% AMI, TURN TWO CONSTRUCTION, INC, MAY SELL THE TOWNHOMES AS AFFORDABLE/WORKFORCE AFFORDABLE HOUSING PRODUCTS (UP TO 120% AMI); AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE THE DEED, WITH RESTRICTIVE COVENANT REQUIRING 30 YEARS OF AFFORDABLE HOUSING (80% AMI) AND/OR WORKFORCE AFFORDABLE HOUSING (120% AMI) AND RELATED DOCUMENTS FOR THE PARCEL FOR THIS PURPOSE; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the CRA Plan goals include (1) eliminate substandard housing and provide affordable housing alternatives; (2) redevelop the CRA in a manner that is energy efficient and sustainable; and (3) enhance redevelopment activities through an active marketing strategy that supports redevelopment initiatives; and WHEREAS, at the February 13, 2024 CRA Board meeting, the CRA Board directed to initiate a public notice and Request For Proposals (RFP) process for the sale of the property located at 608 West Dania Beach Boulevard (Folio No. 5042 34 01 2520), which is owned by the CRA and which the CRA Board, by motion and consensus, desires to sell the Property for development as a multi -unit housing project as for -sale, low-income affordable housing (80% AMI) and/or workforce affordable housing (120% AMI); and WHEREAS, in accordance with Florida Statutes Section 163.380, the CRA published notice of its interest in selling a CRA-owned property in the Sun Sentinel on February 26, 2024; W WHEREAS, the CRA initiated RFP No. CRA-24-005 on February 23, 2024, and closed the process on March 22, 2024; and WHEREAS, there were two qualified proposals that complied with the CRA's RFP requirements, which proposals came from (1) Turn Two Construction, Inc. and (2) Habitat For Humanity of Broward; and WHEREAS, Turn Two Construction, Inc. has provided good services in the past and has offered the City $80,000 for the lot, and agreeing to selling the two eventually constructed townhomes first to affordable housing purchaser, and if unable to find a qualified purchaser within six months, Turn Two Construction, Inc. can seek to sell the two constructed townhomes to persons with income between 80% AMI and 120% AMI; and WHEREAS, the CRA believes that conveying the CRA-owned Property to one of the qualified respondents will facilitate the development of for -sale housing serving the needs of low- income and/or workforce qualified families; and WHEREAS, the sale will be subject to the execution of a Restrictive Covenant to maintain the townhouses as for -sale, low-income affordable (80% AMI) and/or workforce affordable (120% AMI) housing for thirty (30) years; and WHEREAS, pursuant to Section 163.358(4), Florida Statues, the City Commission is required to approve any sale of CRA land. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the above "WHEREAS" clauses are ratified and confirmed, and they are made a part of and incorporated into this Resolution by this reference. Section 2. That the CRA Board approves the conveyance of the Property, which is legally described in Attachment "A", to Turn Two Construction, Inc. at terms and conditions to be finalized. Section 3. That the City Commission authorizes the proper officials to execute a purchase and sale contract, with associated deed for the Property, in substantially the form approved by the City Attorney. As part of the CRA's conveyance of the Property, the purchaser shall be required to agree to and record a 30-year restrictive covenant requiring the property to be developed as for -sale, low-income affordable (80% AMI) and/or workforce affordable (120% AMI) housing. Turn Two Construction, Inc. agrees to first attempt to sell the townhomes to persons at 80% AMI, and if after six (6) months they fail to find a qualified buyer, they are to notify the CRA, and may then proceed to sell the townhomes to persons qualifying at up to 120% of AMI. Section 4. That the CRA is directed to record in the County public records the deed and shall provide a copy of such recorded instrument to the City Commission within thirty (30) 2 RESOLUTION #2024- QN days of execution and final acceptance. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. That this Resolution shall be in force and take effect in ten (10) days after its passage and adoption. PASSED AND ,, ADOPTED 2024. Ryan IV CITY CLERK APPROVED AS TO FORM AND CORRECTNESS: N RESOLUTION #2024- v 'g Attachment "A" Property located at 608 West Dania Beach Boulevard, Dania Beach, Florida, which is legally described as follows: Lots 21 and 24, Block 17, of the Town of Modelo (now Dania), according to the Plat thereof, recorded in Plat Book B, Page 49, of the Public Records of Dade County, Florida; said lands situated, lying and being in Broward County, Florida; being the same property conveyed to the City of Dania Beach by Certificate of Title, recorded in Official Records Book 44260, Page 204, on June 28, 2007, in the Broward County Official Records.
