HomeMy WebLinkAboutO-2024-022 Amend Chap 21 Sales and Auctions Garage Sales Sec. 21-44ORDINANCE NO.: 2024- o a a AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 21 "SALES AND AUCTIONS", ARTICLE III, "GARAGE SALES" AT SECTION 21-44, "INFORMATION TO BE FILED", TO REMOVE REFERENCE TO FILING INFORMATION WITH THE CITY CLERK AND REPLACING THE REFERENCE WITH CODE COMPLIANCE; PROVIDING FOR CONFLICTS; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Code has a specific reference to the City Clerk in relation to the issuance of Garage Sale permits; and and WHEREAS, all Garage Sale permits are issued by the Department of Code Compliance; WHEREAS, the City Code should be modified to correctly reflect the department in charge of garage sales. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the preceding "WHEREAS" clauses are ratified and incorporated as a record of the legislative intent of this Ordinance. Section 2. That Chapter 21, entitled "Sales and Auctions" of the City's Code of Ordinances, is amended to read as follows: Chapter 21- SALES AND AUCTIONS ARTICLE III. - GARAGE SALES Sec. 21-44. Information to be filed. The following information shall be filed with the Code Compliance Department eity-elerk on application forms provided by the city, pursuant to this article: (a) Name of person, firm, group, corporation, association, or organization conducting said sale; (b) Name of owner, association or management company of the property on which said sale is to be conducted, and consent of same if applicant is other than owner; (c) Location at which sale it so be conducted; (d) Number of days of sale; (e) Date, nature of any past sales conducted by the application or at the location; (f) Relationship or connection, if any, between the applicant and any other person, firm, group, organization, association, or corporation conducting said sale and the date or dates of such sale; (g) Whether or not applicant has been issued any other vendor's license by any local, state or federal agency; (h) Sworn statement or affirmation by the person signing that the information therein given is complete and true and known to him or her to be so. Section 3. That all ordinances or part of ordinances in conflict with the provisions of the Ordinance are repealed. Section 4. It is the intention of the Mayor and City Commission of the City of Dania Beach, and it is ordained that the provisions of this ordinance shall become and be made a part of the Code of the City of Dania Beach, Florida and codified by the City. The sections of this ordinance may be renumbered or re -lettered to accomplish such intention, and the word "ordinance" may be changed to "section," "article," or other appropriate word. Section 5.
