HomeMy WebLinkAboutO-2024-029 LDC Art. 275 Landscaping Requirement Sec 275-195 Artificial Turf ‌InstallationORDINANCE NO. 2024- AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING CHAPTER 28, "LAND DEVELOPMENT REGULATIONS", ARTICLE 275, "LANDSCAPING REQUIREMENT"; AT SECTION 275-195, "ARTIFICIAL TURF INSTALLATION", OF THE CITY CODE OF ORDINANCES, PROVIDING FOR CONFLICTS; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY, FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Mayor and City Commission desire to amend the Land Development Code in order to provide for standards relating to artificial turf standards and requirements, and to include those standards in the City's Code; and WHEREAS, the City desires to modify Chapter 28 of the Land Development Regulations to amend Article 275, entitled "Landscaping Requirements: in order to include standards for artificial turf. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the preceding "VaIEREAS" clauses are ratified and incorporated as a record of the legislative intent of this Ordinance. Section 2 That Chapter 28 of the City's Code of Ordinances entitled "Land Development Regulations", to amend Article 275, entitled "Landscaping Requirements", to read as follows: CHAPTER 28 LAND DEVELOPMENT REGULATIONS ARTICLE 275 — LANDSCAPING REQUIREMENTS Sec. 275-195. - Artificial turf installation. (A) The following requirements shall govem the installation of artificial turf, (1) A building permit shall be required to install artificial turf. At a minimum, artificial turf must be installed according to the manufacturer's specifications and will be sub*ect to further city stormwater requirements per Section 27-227. (2) Artificial turf must replicate a common species of natural grass utilized in the Florida area such as St. Augustine, Bahia, or Bermuda grass in color and appearance. (3) New total impervious/pervious area calculations to include the artificial turf as pervious shall be submitted with the permit application. (4) Installations are not permitted within e trunk. (B) Maintenance of artiftol turf, The propertV owner shall routinely maintain artificial turf, including cleaning, brushing, debris removal, repairing and replacement. Such maintenance activities shall ensure that ardficial turf continues to function as designed and permitted while maintain aesthetics. Replacement and repairs shall be done with like materials frpm thp qaR;p MRRUfapt-,rpF and done so in a manner that results in a repair that visually blends in with the existing artificial turf. (204 The Property owner's failure to maintain, repair and/or replace artificial turf in compliance with this section, or anV agreement entered into with the city as required herein, shall constitute a violation of this subsection. (3)fQThe artificial turf system shall be lead-free, and use recycled or organic plant -derived materials and natural infill components, including, but not limited to, cork, coconut, cornhusk, rice husk, and sand. The use of crumb rubber and other synthetic materials shall be prohibited in all applications except for sports fields. Documentation must be provided that identifies all recyclable or natural components of the artificial turf system. (4)f54 All artificial turf shall be installed over a subgrade that provides positive drainage and an evenly graded mass of compacted, porous crushed rock aggregate material. Bases maV not be comprised of sand only. Proper drainage shall be provided for all artificial turf installations to prevent runoff or pooling of water. ORDINANCE #2024- 02—'-1 Section 3. That if any section, clause, sentence or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 4. That all ordinances or parts of ordinances in conflict with the provisions of this Ordinance are repealed to the extent of such conflict. Section 5. It is the intention of the Mayor and City Commission of the City of Dania Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of the City of Dania Beach, Florida. The sections of this ordinance may be renumbered or re -lettered to accomplish such intention, and the word "ordinance" may be changed to "section," "article," or other appropriate word. Section 6.
