RESOLUTION NO.2019-018 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE VARIANCE REQUEST (VA-04-19) SUBMITTED BY HOPE W. CALHOUN, ESQ. ON BEHALF OF AMERICAN MARITIME OFFICERS BUILDING OF DANIA BEACH, FOR PROPERTY LOCATED AT 2 WEST DIXIE HIGHWAY, IN THE CITY OF DANIA BEACH, FLORIDA, AS LEGALLY DESCRIBED IN EXHIBIT "A;" PROVIDING FOR CONFLICTS; AND FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 28, the "Land Development Code," Part 6, "Development Review Procedures And Requirements," Article 625, "Variances" of the Land Development Code (the "LDC"), Hope W. Calhoun, Esq. on behalf of American Maritime Officers Building of Dania Beach (the "Applicant"), has applied to the City of Dania Beach (the "City") for approval of a Variance (VA-04-19) for property located at 2 West Dixie Highway (the "Property"), as legally described in Exhibit "A;" and WHEREAS, LDC Section 625-40 states that the City Commission may grant a Variance based on its determination that the Applicant has demonstrated that the criteria identified in the LDC have been satisfied; and WHEREAS, the Applicant has requested a Variance (VA-04-19) to permit a ten (10) foot wall on the Property, where pursuant to LDC Section 235-30, a maximum eight (8) foot wall is permitted; and WHEREAS, the Applicant has provided sufficient justification demonstrating compliance with the approval criteria to meet the requirements of the LDC; and WHEREAS, public notice was provided in accordance with law; and WHEREAS, the City Commission finds that approval of the requested Variance is consistent with the City's Land Development Code and Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this Resolution. Section 2. That pursuant to Chapter 28, the "Land Development Code," Part 6, "Development Review Procedures and Requirements," Article 625, "Variances" the Variance (VA- 04-19), as shown in Exhibit "B" is hereby approved. Section 3. That pursuant to Section 625-50 "Expiration of Variances" of the Land Development Code, the Variance approval shall automatically expire and become null and void unless the Applicant files a complete building permit application with construction drawings within eighteen (18) months from the date of this Resolution. Section 4. That the issuance of a development permit by a municipality does not in any way create any right on the part of an Applicant to obtain a permit from a state or federal agency, and does not create any liability on the part of the municipality for issuance of the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a state or federal agency, or undertakes actions that result in a violation of state or federal law. Section 5. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent of such conflict. Section 6. RESOLUTION #2019-018 EXHIBIT "B" RESOLUTION #2019-018 WALL VARIANCE JUSTIFICAITON American Maritime Officers Building of Dania Beach, LLC ("Owner") owns property located at 2 West Dixie Highway ("Property") in the City of Dania Beach ("City"). Owner has occupied the Property for more than 40 years, and during that time has been a great community partner. The latest plan of improvement for the Property is to utilize an underutilized tennis court and construct upon same a firefighting training facility ("Facility"). In accordance with the attached, the Owner intends to install a 10' wall around the Facility, where the City's Land Development Code ("Code") limits the height of the wall to 8'. Section 235-30, of the Code provides that an 8' wall is the maximum height permitted to be installed on the Property. The Owner is hereby requesting a variance to permit the Constriction of a 10' wall at this location because it is compatible with the area and enhances the safety and welfare of the community. Specifically, the 10' wall is being proposed in consideration of the neighborhood as it will match the height of the existing chain link fence and conceal the firefighting training from the SW 7th Street and Lighthouse Community Church. In supportof the variance request, Owner will demonstrate that: (1) the variance maintains the basic intent and purpose of the subject regulations, particularly as it affects the stability and appearance of the city; (2) the variance is otherwise compatible with the surrounding land uses and would not be detrimental to the community; (3) the variance is consistent with, and in furtherance of, the goals, objectives and policies of the Comprehensive Plan and all other similar plans adopted by the City; (4) the plight of Petitioner is due to unique circumstances of the Property or Petitioner which would render conformity with the strict requirements of the subject regulations unnecessarily burdensome; and (5) the variance requested is the minimum variance that is necessary to afford relief to Petitioner while preserving the character, heath, safety and welfare of the community. Variance Section 625-40, Variance Review Criteria. (1) That the requested variance maintains the basic intent and purpose of the subject regulations, particularly as it affects the stability and appearance of the city; The requested variance maintains the basic intent and purpose of the City's code regulations because as proposed it will match the height of the existing chain link fence surrounding the Property, and it appropriately screens the use behind it from SW 71h Street and the Lighthouse Community Church. In fact, the proposed wall sits on the campus of the American Maritime Officers other buildings, and currently much of the facility is surrounded by a wall, or fence of some type. As such, the proposed buffer serves as an attractive buffer between the street, and the Property. It also serves as a functional barrier which provides a safety feature for the firefighting activities. (3) That the requested variance is consistent with, and in furtherance of, the goals, objectives and policies of the adopted Comprehensive Plan, as amended from time to time, and an other similar plans adopted by the city; The requested variance is consistent with, and in furtherance of, the goals, objectives and policies of the adopted Comprehensive Plan. Specifically, Comprehensive plan Policy 5.12 Dania provides that the City should "...implement regulations which address the potentially adverse impacts of industry..." In this case, the potential adverse impact is a wall that is constructed at 8' instead of 10', will not serve as an adequate safety, or aesthetic barrier from the proposed facility. In most cases, an Applicant requests to provide less than what is required. In this case, the Applicant is asking to provide more. Given the unique use that will be provided on the Property, the Owner feels that from an aesthetic and safety perspective a taller wall would be most appropriate for the area requested. The uses that are provided on the Property are so unique and vital to the community that there is nothing in the area to compare the use to. Given those facts it is important to allow the Owner to operate (as it has been for more than 40 years) as a productive, business partner with the City and construct a 10' wall around the simulator. (5) That the variance requested is the minimum variance that is necessary to afford relief to the petitioner, while preserving the character, health, safety and welfare of the community. In fact, as stated above, the 2' difference would allow for the use of the Property in a manner that is both visually compatible and safe. To provide a wall at 8' instead of 10' would not enhance the area, nor would it benefit the Community Church. In fact, given the use that will take place on the Property, it could be argued that a lower wall would serve as a visual distraction from the street.
