JOINING WITH THE AMERICAN FEDERATION OF STATE" COUNTY AND MLINICIPAL EMPLOYEES (.AFSCME'') UNION IN WAIVING COLLECTIVE BARGAINING OVER THE ADDITION OF A NEW MENTAL HEALTH BENEFIT FOR ELIGIBLE EMPLOYEES WHOSE POSITIONS ARE COVERID BY THE BARGAINIGN L]NIT; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City and AFSCME are parties to a Collective Bargaining Agreement AFSCME for employees whose classifications are covered by the bargaining unit; and WHEREAS, the Collective Bargaining Agreement provides for health insurance benefits; and WHEREAS, the City and the Union met to discuss the opportunity to allow eligible bargaining unit employees the opportunity to participate in the new mental health benefit for the 202412025 Fiscal Year, but cannot unilaterally provide the same benehts to employees whose positions are covered by AFSCME; and WHEREAS, atthough the City Commission finds it better practice to negotiate benefit issues. such as health insurance in combination with all other wage and benefit issues when collective bargaining occurs in full, the City CoryLmission also finds that allowing additional employees to participate in the new mental health benefit will not adversely affect future collective bargaining; and WHEREAS, the City and Union have entered into a memorandum of understanding C'MOU") providing all eligible employees in the bargaining unit with the new mental health benefit. NOW, THEREFOR-E, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section l. That the foregoing "Whereas" clauses are ratified and confirmed to be true and correct and they are made a part ofand are incorporated into this Resolution by this reference. Section 2. That the MOU between the City and Union are attached hereto as Exhibit A. The MOU provides full-time employees whose positions are in the bargaining unit the new mental health benefit when it becomes available in 202412025 Fiscal Year. That this Resolution shall be effective l0 days after passage. lJn i^ru" / Yes No ro5 MEMORANDTIM OF TINDERSTANDING BE'I'WE[,N THT] (]ITY OF DANIA BEACH ANI) AFSCME FI,ORIDA COT]NCIL 79, AFL-CIO LOCAI,3535 This Memorandum of Understanding ("MOU" or "Agreement") is entered into by the CITY OF DANIA BEACH (the "City") and AFSCME FLORIDA COUNCIL 79, AFL-CIO LOCAL 3535 (he "Union"). The City and the Union are collectively refened to herein as the "Parties." WHEREAS, the City and Union entered into a Collective Bargaining Agreement covering the period October 1, 2022, through September 30, 2025 (the "CBA"); WHEREAS, the CBA sets forth certain benelits for bargaining unil employees; WHEREAS. the Parties have met regarding a mental health benefit that the City would like to extend to all eligible bargaining unit members; and, WHEREAS, the Parties have met and reached agreement on implementation of this Agreement to the bargaining unit. NOW, THEREFOR-E, the City and the Union agree as follows: 1. The above information is true and correct and is incorporated herein by reference. 2. All eligible bargaining unit employees will have a mental health benefit offered to them by the City as ofOctober l, 2024. The benefit is called Headspace. lt is an online/mobile resource that provides courses and expert-led guided sessions for topics such as stress, anxiety, mediation, exercise, relaxation, and s1eep. More information will be provided by the provider prior to implementation. 3. The Parties agree that paragraph 2 ofthis MOU represent the Parties' entire agreement as to the iterns related to implementation of the benefit described herein. It is understood that this MOU sets no precedent for any future situations. Page I of2 4. The Parties agree that this MOU cannot be amended or modified without the express written consent of the Parties. 5. The Parties have had the opportunity to consult with legal counsel of their choosing prior to executing this MOU. 6. The elfective date of this MOU is as of the date it is ratified by both Parties. Implementation ofthe benefits described herein will be as of the dates indicated in pmagraphs 2 and 3 of this MOU. 7. This MOU automatically expires on September 30, 2025, and will not thereafter apply unless specifically agreed to in writing by the Partics. DATED this _ day of 2024.
