FLORIDA. APPROVING THE SITE PLAN (SP-087.23) SUBMITTED BY RUMUR PROPERTIES LTD. FOR PROPERTY LOCATED AT 2555 W STATE ROAD 84. WITHIN THE CITY OF DANIA BEACH. FLORIDA. PROVIDING FOR CONDITIONS: PROVIDING FOR CONFLICTS: FURTHER. PROVIDING FOR AN EFFECTIVE DATE. WIIEREAS, the City Code of Ordinances. Chapter 28, entitled "Land Development Code" ("LDC"), Part 6. entitled "Development Review Procedures and Requirements." Article 635. entitled "Site Plans," provides that site plan approval is required as a condition to the issuance of a building permit and prior to the commencemenl of construction: and WHEREAS, Peacock Architects, on behalf of Rumur Properties LTD, (the "Appticant") is requesting Site Plan approval (SP-087-23) to permit the construction ofa new 5,000-square-foot warehouse north ofan existing warehouse. on Prope(y in the City of Dania Beach. located on the north side of State Road 84 and west side of SW 25h Terrace. bearing the address 2555 W State Road 84, as legally described in Exhibit "A", a copy of which is made a part ofand incorporated into this resolution: and WHEREAS, the Applicant is requesting approval of the proposed Site Plan (SP-087-23) to permit the future development of the subject property pursuant to and consistent with the attached site plan provided as Exhibit "8": and WHEREAS, the City Commission conducted a duly noticed public hearing in accordance with Chapter 28, Part 6 of the LDC. Article 610; and WHEREAS, the Applicant has provided sufficient justification demonstrating compliance with the approval criteria to meet the requirements of the Codel and WHEREAS. the City Commission finds that the approval of the proposed Site Plan (SP- 087-23) is consistent with the Ciry-'s Land Development Code and Comprehensive PIan and wilt protect the public health. safety, and welfare ofthe residents ofthe City, and furthers the purpose. goals. objectives and policies ofthe Comprehensive Plan: and WHEREAS. the Cit)' Commission finds that the approval of the Site PIan (SP-087-23) request is consistent with the City's Comprehensive Plan and Land Development Regulations. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section l. That the above "Whereas" clauses are ratified and confirmed, and they are made a part ofand incorporated into this Resolution by this reference. Section 2. That pursuant to Chapter 28, Land Development Code. Part 6. "Development Review Procedures and Requirements", A(icle 635. "Site Plan", the lollowing Site Plan (SP-087-23). attached as Exhibit "B". w'hich is made a part of and incorporated into this Resolution by reference. is approved. Section 3. That the approval granted by this Resolution is subject to the Applicant's compliance with the follorling conditions: l. In the event that the proposed construction causes adverse drainage effects to the surrounding areas, it is the responsibility of the owner of the development to address the concems of the neighbors and provide a solution at the owner's expense. (Engineering) 2. The site has existing offsite drainage connections to the West parcel. The connections shall be reviewed and approved by Broward County (BC) at the time olthe submittal to obtain the BC SWM license. (Engineering) 3. The South invert lor the connection of the drain shall be included to the manhole callout located at the SW comer of the site improvements. (Engineering) 4. The design plans shall be revised to show that the ADA parking spaces and aisle shall be resurlaced and regraded to meet ADA standards. Proposed elevations shall be added to CS-03 demonstrating that the neu'parking spaces and aisle are sloped no greater than 27o in any direction. The existing ADA parking space and aisle shall be examined, and improvements made to ensure the area is ADA-compliant, as applicable. (Engineering) 5. Call out the proposed curb along SR-84 on CS-03 where the driveway accesses are to be closed. (Engineering) 6. A root banier between the landscaping in the retention area and the exfiltration trench shall be provided. (Engineering) 7. Provide the Brou,ard County Water and Waste$'ater letter of availability. (Engineering) 8. Provide the FDOT Pre-Application letter. (Engineering) 9. Additional comments may apply at the time of building and ROW permitting. (Engineering) 10. Provide regulatory agencies' approval documentation and Permits/Licenses (as applicable) as part ofthe final submittal. prior to issuance ofthe Building Permit (South Florida Water Management District (SFWMD). Broward County Surface Water License, Broward County EPGMD Wastewater Permit / BC Water and Wastew-ater Approval. Florida Department of Environmental Protection. FDOT. BC Environmental. The developer is required to pafticipate in the City's Public Art program. as delineated in Article 811, of the Land Development Code, by payment into the City's Public Art fund or through payment and installation of public art. The amount of the Public Art Fund contribution is dependent on the value of the construction which will be established at the time of building permit submittal (Planning). I 3. Per O-2017-027 & C.2018-019. Commercial properties under construction are required to provide security to fencing with screening showing project rendering covering at least 750% of the length of the fence along an arterial or state right-of-way & 25Yo for local roads and must include the name and intended use ofthe project, project rendering. proj ect website address. and ow-ner or agent, the telephone number for the o\.\'ner or agent. and the name and an emergenc,v contact telephone number ol the general contractor. Provide screen detaits with the next submittal. The City Commission must approve the use of the City Logo. (Planning). 14. For all projects resulting in the buildout ofthe site, such that construction staging cannot occur on-site. must obtain Staging Plan approval by the Community Development Director prior to issuance of a building permit. The Staging Plan must include but is not limited to, the location of equipment and material during construction. (Planning). 15. For all projects resulting in the buildout ofthe site. such that construction staging cannot occur on-site, the applicant must obtain Maintenance of Traffrc Plan approval by the City Engineer lor the period ofconstruction prior to issuance ofa building permit. (Planningl. Section 4. That pursuant to Chapter 28, Part 6 of the LDC. Article 635, Section 635- 100 entitled "expiration ol site plans; procedure lbr extension," the site plan approval shall automatically expire and become null and void unless the applicant files a complete building permit application with construction draw-ings for the improvements sho$.rr on the site plan, within eighteen ( I 8) months from the date of this resolution. Section 5. Such application must be reviewed by the Broward County Aviation Department; the point of contact is Mlliam Castillo, Airport Planner, located at 220 SW 45 Street. Suite 101, Dania Beach. Provide a cross-access agreement between" S.S Rocks, LLC and City of Dania Beach that identilies perpetual access easement for vehicular and pedestrian access. ingress. and egress over and across that 50-foot \4,ide eastem portion for full access and use ofthe Fire Hydrant for the City Attomey review. It must be recorded before issuance of the Certificate of Occupancy. (Planning) Section 6. That the issuance ofa development permit by a municipality does not in any '*av create an1'right on the part ofan Applicant to obtain a permit from a State or Federal agency and does not create any tiability on the part of the municipality for issuance ol the permit if the Applicant fails to obtain requisite approvals or does not fulfill the obligations imposed by a State or Federal agency, or undertakes actions that result in a violation olState or Federal lau'. Section 7. That the associated Planning & Zoning Division StafT Report prepared for the above application(s) is incorporated into this resolution as findings of thct. Section 8. That all resolutions or parts of resolutions in conflict with this Resolution are repealed to the extent olsuch conflict. Section 9. That this Resolution shall be l0 days after passage.
