A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA, PURSUANT TO THE REQUIREMENTS OF FLORIDA
STATUTES SECTION 255.065, AFTER HOLDING THE SECOND OF TWO
PUBLIC HEARINGS, ACCEPTS AN UNSOLICITED PROPOSAL BY RITA
CROCKETT BEACH SPORTS ACADEMY (RCBSA) FOR A QUALIFIED
PROJECT FOR "THE PIT'" A BEACH SPORTS FACILITY AT FROST PARK;
AND MAKING A DETERMINATION THAT IT IS IN THE PUBLIC'S
INTEREST TO PROCEED WITH THE UNSOLICITED PROPOSAL;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Rita Crockett Beach Sports Academy'RCBSA" is a 501 3c that has issued
an unsolicited proposal to develop a unique multisport beach facility in Dania Beach, Florida that
caters to all age groups and their needs for recreational outdoor activities; and
WHEREAS, RCBSA desires to develop the "The PIT" at Frost Park, as a Beach sport
Complex that offers a variety of lifestyle beach sports ranging from beach volleyball, fooWolley,
beach tennis, beach flag football and more, and locating six (6) lighted courts with a sitting area
and concession stand at Frost Park; and
wHEREAS, "The PIT', will offer leagues, vacation training packages, local, national, and
international toumaments to bring visitors to the City; and
WHEREAS, in receiving an unsolicited proposal the city can select to advertise and issue
a bid to obtain other proposals, or it can select to proceed with the unsolicited proposal, provided
it first holds a duly noticed public hearing at which the proposal is presented and affected public
entities and members ofthe public are able to provide comment and at a second duly noticed public
meeting determines that the proposal is in the public's interest; and
WHEREAS, the City held its first public hearing on August 27, 2024; and
wHEREAS, on September 12,2024 the City held its second public hearing and found that
the proposal meets a public need as required under Florida Statute Section 255.065.
WHEREAS, the Ciry Commission has reviewed the following factors to determine that
the project is in the public interest and makes findings of fact regarding same under Exhibit A'
attached and incorporated by this reference to this Resolution:
l. The benefits to the Public.
2- The financial structure of and the economic efficiencies achieved by the
ProPosal.
J The qualifications and experience of the private entity that submitted the
propoial and such entity's ability to perform the project'
The project's compatibility with regional infrastmcture plans'
Public comments submitted at the meeting' The responsible public entity
must provide a statement that explains why the proposal should proceed and
addresses such comments.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section l. That the above "Whereas" clauses are ratified and confirmed, and they are
made a part ofand incorporated into this Resolution by this reference'
Section 2. That the city commission has held the two public hearings required
pursuant to Florida Statutes Section 255.065 and made the finding ofnecessiry for the unsolicited
proposal, as identified in the attached Exhibit A
Section 3. Pursuant to Florida Statutes Section 255.065(d), as the Ciry decides to
proceed with an unsolicited proposal without engaging in a public bidding process, the city shall
publish in the Florida Administrative Register for at least 7 days a report that includes all of the
following: (l) The public interest determination identified in Exhibit A, and (2) identifies the
factors considered in making the public interest determination.
section 4. That all resolutions or parts of resolutions in conflict with this Resolution
are repealed to the extent of such conflict.
Section 5. That this Resolution shall become effective immediately'
