Discussion continued with the Commission regarding cost and advantages of using concrete, aluminum or plping for this project. Mike Moskowitz, Attorney for the Cassone property, explained that he has received information from his engineers that this project cannot use pipe larger than 36" in order to instafl the sewer laterals. Mr. Moskowitz advised the Commission that his client is not prepared to pay more than S24,000 as his part to complete this drainage project. After lengthy discussion, it was determlned Catvin woufd come back with the cost figuresinstalling the pipe and specifics on how to sewer laterals for this project. yA eE dler stated that he would research the ast Marsh Drainaqe District. proposed contract with Coastal Tech for related to Dania Fishing Pier Study. d Ci.ty Manager FLatley reminded the Comnission that Coastal Tech had been ranked number one to present proposal on engineering services relati-ve to above/below water inspection of the Dania Fishing Pier. Mr. Harvey Sasso, Vice President, Coastal Technology Corporation. expl"ained the methods that wiIl be used in inspecting the Dania Fishing Pier. Mr. sasso explainedthat after the inspection is completed, he will prepare a report. for the City categorizing the most critical to the least critical repairs that Nill be required and advise of cost. 1WORKSHOP MEETING APRIL 17. 1990 After further discussion, City Manager FIatley stated that thj"s item wj-1l be added to the next regufar meeting agenda for approval. 3. Big Nassau Daddy property. 1506 presently oHned by the city of Dania and no property lease. South Dixie Highway, is with several liens pending to the next City Attorney Adler explained that the City had oriqinally sited the Blg Nassau Daddy property for code enforcement violations and eventually a lien was recorded by the City. The City then filed a foreclosure suit to foreclose on the mortgage and recei-ved a Certificate of Title to the property on a fee simple basis. City Attorney Adler advised that the City owns this property subject to encumbrances of other liens filed by the So. Broward Hospital District, Internal Revenue and back taxes. Due to the encumbrances, City Attorney Ad1er recommended to declare this property surplus and advertise for bids for someone else to buy it. City Attorney Adler felt it r^rould be beneficial to the City to 1et someone else r.Jork out a deal with the So. Broward Hospital District, take over the first mortgage. pay back taxes and pay any other liens that reere filed on the property prior to Dania taking title. The Commission agreed to add this item regular commission meeting. 4- Status report on Chateau DeVille Condoninium. City Attorney Adler explained the details behind the bankruptcy filed since October by the bank that was going to finance the sale of the Chateau DeVilIe Condominiums. Mr. AdIer explained that no certificate of occupancies have been released on the property even though there are purchasers livinq there. These purchasers pay $500 a month to the buifder and that he has advised these purchasers that the buifder has no right to receive their money until the bankruptcy is resolved. Mr. Adler has i-nf ormed these purchasers that they cannot pay their water bills to the city as they are not legally connected to the City water system. City Attorney Adler stated that the certificate of Occupancies on the buildings that were ready to close were sent to the title company handling the closings for Mary DeRosa Realty. The title company is suppose to hold all certificate of occupancies in escrow until the impact and administrative fees are paid to the City before closing on any unit. Mr. Adler said that FPL has also given power to the units even though the certificate of occupancies have not been released. !,!r. Adler is attempting to contact the attorney designated as trustee in an effort to resolve these problems and expects to report back to the Comnission at the nexL regular meeting. 5- Property Standards discussion of ninimum housing and connercial codes. WiIl A11en. Growth Management Director. presented an ordinance creatinq property standards in Dania forresidential and commercial properties that would be a supplement to the South Florida Building Code mandated by the State. Mr. A1l,en stated that these standards would address exterior maintenance and sanitation issues and not just safety of a buitding. Further discussion of authority: a) Revised draft of the L,arge User Agreement pertaining to the Hollywood litigation suit. b) Draft *5 of the proposed legislation establishing a rasteuater authority as well as draft *4 so that one can see the changes made between the two drafts. City Manager Flat1ey submitted a revised draft to the Large User Agreement which is part of the Hollywood litigation suit. Mr. FIatIey stated that he felt the litigation should be settfed wlth Hoflywood by next Tuesday and hopes to recelve a check by then for what is owed back to Dania. 7 Discussion of sidewalk maintenance and swale rocks. Commissioner Grace expressed her concern for the broken sidewafks in the City and the possibility of the City being sued for persons being injured. Commissioner Grace stated that there must be procedures created to address this problem. City Manager Elatfey explained that with regards to the concept of establishing a new wastewater authority he would Iike to hear responses from our City Engineer. Broward County, and the City of Hallandale and to workshop again next month. City Attorney Adler and City Manager Flatley explained that all sidewalk repairs are the responsibility of the property owner even thouqh the City legaffy o}'rns the sidewalk. City Manager Flatley suggested the possibility of budgeting funds for repair of sider'lalks in an effort to assist property owners like Pembroke Pines has recently done. Discussion of Winn Dixie Shopping Center naintenance- (Commissioner Bertino) comrnissioner Bertino informed the Commission of several complaints that he has received regarding the trash and garbage cfeanup problem at the Winn Dixie Shopping Center. Commissioner Bertino suggested this type of situation be included to the commercial property section of the mj-nimum housinq code beinq discussed at this meeting. CITY AYIORNEY ADLER STATED THAT NO ACTION COUI,D BE TAKEN TONIGHT BUT SINCE THE TENT HAS TO BE CONSTRUCTED ON APRTL 23, PRIOR TO THE REGUI,AR MEETING, HE ASKED THE COMMISSION TO RESPOND. Metrium Realty, was present to represent the shopping center management company and stited that her company has no problem with maintaining the property. Ms. Espinosa inforrned the Commission of othei difficult problems regarding people dumping items behind the shopping center, tenant burglaries, RV camper trailers being parked in the shopping Center and gang related crimes. Ms. Espinosa requested assistance from the City by supplying additional police surveillance. 9. Continued discussion regarding an ordinance as it pertains to sidestreet (Cornmissioner Cook) andto work amendment to the fence sideyard fence heights . Discussion folfowed regarding the Clty Manager Building departments meeting with Ms- Espinosa out the details of these Problems. Will Alfen presented his review of the Dania fence ordinance and reported on his flndings of what other cities are using in relation to this subject. Mr. Allen stated that he feels a 6' fence on the corner sideyard is reasonable and added that regulations coufd be included requiring frame attractiveness. Commissioner Bertino suggested leavlnq the fence request under the variance procedure but no fee be attached as a fence wifl usuaf l-y enhance the area. Several residents were present to express their opposiLion to being required to go thru the variance procedure to obtaln a fence as other residents have been alfowed to construct fences with no restrictions. The Commission generally agreed to consider an amendment to the fence ordinance to allow a 6' fence on side corner and inside fots and to stop it at the front edge of the property where a 4' fence would then be attowed. The ordinance will include specific material standards that will be alfowed and any request for a fence outside the standard would require a variance request. 10. schedule of Arbor Day (Friday, April 20) events at Dania Elementary School and Collins Elementary School . City Manager Flatley requested Commisslon support at the Arbor Day cefebration for Friday. April 20 at 8:00 a.m. at Dania Efementary Schoof. MR- GRAIIA,T' STATED THAT HE WOUI,D DEI,IVER A LETTER TO TIIE CITY IITANAGER THAT IN T[IE EVENT THE TE},IT CONSTRUCTION IS VOTED DOWN ON TUESDAY, IIE WOUI,D REMOVE THE TENT IMMEDIATEI-,Y AND TIIAT IIE TIILL REMOVE THE PERMANENT TENT ALREADY CONSTRUCTED ON THE SITE WITHIN THE NEXT 90 DAYS. Commissioner Bertino informed the Commission of the ongoing rodent., trash, garbage and lack of maintenance problems at the Winn Dixie Shopping Center. Commissioner Bertino suggested that a representative from the shopping center managenent company be present at the next regular commission meeting on April 24 in order to take action on resolving these problems. the Commission a requirement Program. ITY CLERK_AUDITOR that having an Arbor Day celebration was in order to file for the Tree City USA Commissioner Grace explained that at 10:00 a-m. on Friday, Collins Elementary will also be having a celebration for Earth Day and that two trees will be planted in commemoration of Chester A. Byrd and Anita Collins. 11. Discussion regarding Dania Housing Authority- (Mayor Mc Elyea) Mayor Mc E1yea expressed his concern with the manner j.n which the Dania Housing Authority is conducting business. Mayor Mc Elyea mentioned that the courts have ordered his two appointments to be seated on the Housing Authority and that all meetings have been deferred for three nonths by the Chairman of the Housing Authority. Mayor Mc Elyea reminded the Commission of the Housing Authority projects that are in progress at this time with no one overseeing them. Mayor Mc Elyea mentioned that Nancy Preusz has filed a sult against the Housing Authority for discrimination. Mayor Mc Elyea stated that in accordance with state stitute, he has the right Eo ask for a 10 day notice of resi.gnation from Bill Winkelholz, chairman of the Dania Housing Authorj.ty, or to turn this over to the Broward county Housing Authority to solve the problem' Mayor Mc Elyea expressed concern that no one seems to be able to know what is realty going on with the Houslng Authority business. CiEy Attorney Adler said that it is his understandinql ttrat t"ts. Preusz has filed a comptaint with the Human Relations Board for discrimination. Mr. Adler stated that he doesn't quite understand the basis of discrimination since Ms. Preusz has been running the Dania Housing Authority i-n the position of Executive Director. city Attorney Adler stated that the Court Order is not finil until itre :O days for appeal has passed and that he recommends to wait 30 days for the appeal to run out before taking any action. Mr. Adler said that he would speak with the Human Relations Board. Mr. winkelholz' Chairman of the Housing Authority, and HUD to obtain more information for the Commission.
