4.L City Attorney Adler advised the Commission that
Administration has requested continuance to the next regular
meeting of the public hearing of the ordinance rezoning property
focated at 210 & 218 S.w. 9th Street requested by District 2 MEBA
as the representatives from MEBA were unable to attend tonight.
A motion was made by Commissioner Grace, seconded by Vice Mayor
Mlkes to continue, to the regular meeting of May 22nd, the public
hearing on second reading of the ordinance rezoning lots 9, 10.
11 and 12, Block 3, "Amended Plat of Woodhaven-Ho11ywood, Fla."
from present zoning classification to I-G zoning classification
under the provisions of ordinance No. 100 of the City of Dania.

4.2 City Attorney Adler advised the Commission of considerationof proposed changes to a previously approved Development of
Regional Impact for the Design Center of the Americas and readthe title of the ordinance amending the development order for the
Design Center of the Americas.
At this time, Mayor McElyea expressed an apology to the audience
who may have stayed to hear item 4.1 since the Comnission
continued it to the next meeting as he was not aHare that it wasgoing to be pulIed.
Vice Mayor Mikes asked City Attorney Adler to present a 1ega1opinion on the validity of the rezoning request by MEBA on item
il .1 as he is not sure a rezoning is in order for this case.
City Attorney Adler informed the Commission that the rezoningpetition by MEBA is out of order as the rezoning request must bebrought in compliance with the Land Use Plan and the second stepis to then submit the ordinance. City Attorney Adler mentionedthat since this was advertised as a public hearing. the item mustbe continued until the petitioners are available to address theissue.

Gerald Kniqht, attorney for Design Center of the Americas,explained that this request is basically to adjust the phasing
schedule of Phases III & IV to the actual construction scheduleby one or two years and to shift 10.000 square feet from the lastphase of the project to Phase III.
Commissioner Cook confirmed that the square footage forproject is not being increased only adjusted from Phase
Phase fII.

lllifl A1fen, Growth Management Director, clarified the changes
that will be taking pface and confirmed that there is no
substantial deviation per Chapter 380 of the State Statutes that
governs the developments of reqionaf impact.
City Attorney Adler addressed Commissioner Bertino's concern t-hat
the water unit charges per square feet previously paid on Phase
IV wifl be adjusted to Phase III as there is no change in the
total fees because there is no actual increase in square footage.

AT THIS TIME. ITEMS 4.6, 1.7 AND 4.8 RELATING TO THE SAFE
NEIGHBORHOOD PLAN WERE HEARD
4.3 City Attorney Adler advised the Commission of the request by
,John ]-.,iqotti, petitioner and Louis & Dorothy L.,avrich, Owner for a
land use plan change for property located north of Sheridan
street and east of SE 5 Avenue. City Attorney Adler read the
title of the resolution authorizing the transmission of a land
use plan change request to amend the certified land use pfan fron
Estate (1) Residential to Medium (16) Residential .
John Liqotti explained that the concern for approving this land
use plan change was the possibility of setting a precedent for
development along the east side ot sE 5th Street. Mr. Ligotti
confirmed that the County has intentions of purchasing the
remaining property on the east side of SE 5 street for
environmental wetlands. Mr, Ligotti stated that he proposes to
build 80 units at approximately 1400 to 1600 sq. ft. of interior
1lving space per unit. Mr. I-.,igotti stated that he has tried to
be sensitive to the environment of the area as it presently
exlsts.
John Ligotti responded to Commissioner Grace's concern that he
will preserve as many trees as possible in the area.
Mayor McElyea opened the public hearing. Toni Stevens, Vivian
Warman, Morey Shocket, Faye Palmer Bartelmes, Bob Ze1ler, Irving
Warman and Cliff Iacino spoke in opposition of this land use plan
change. LouAnn Parkman stepped forward to express her view that
she hadn't heard any reason why this development should not be
bui It ,
Mr. Ligotti stepped forward to clarify that this fand use plan
change was denied so many times as the Commission did not have
the h'enef it of all information regarding the disposition of the
remainder of the east side of SE 5th Avenue. Mr. Ligotti
confirmed that hls project has not been turned down in the past
by the Commission due to it being a bad project but due to lack
of information on the wetland areas.
After Iengthy discussion. Mayor MCEIyea cfosed the public hearing
and opened to the Commission for possible action.
Commissioner Cook questioned Mr. Ligotti as to i{hether his
property was platted and whether or not approvals have been
obtained from the Army Corps of Engineers and EQCB. Commissioner
Cook reminded Mr. Liqotti that lf the Commission authorizes the
transmission of this land use plan change, he will sti1l have to
go thru procedures with the state, County and City. Commissioner

6.1 Clty Manager Flatley informed the Commission the continuedrequest by Michael Moskowitz for property owned by Michael andNancy Cassone to pay a portion of the drainage cost for propertyin the vicinity of SE 4 Avenue and 3 place with the City alsopaying a port.ion.
Mr. FlatIey mentioned that after the workshop meeting on17, Berry & Calvin. City Engineers, were asked to presentproposal of the costs and size of pipe needed to compfeteproject. Mr. Flatley explained that Berry & Calvin havepresented two alternatives for this project as follows:

problem to other properties in the s'E' section, they should be

commissioner Grace encouraged Dania and the property owners to
come to a resolution for the betterment of all parties concerned-
Commissioner Cook asked City Attorney Adler to clarify who is

City Attorney Adler stated that our City code provides that every
p."i"itv ownir will take care of their own drainage on their
p."p..tv. City Attorney Adler mentioned that the City is

be handling drainage for other properties in the area'

alternatives that could be considered using Westlake or some of
the lake sysLems in the area and that it is just a matter of
working oui arrangements with the various environmental agencies'
Mr. cafvin recommended a study be conducted prior to entering
into an aqreement with any property owner for draining this area'
Commissioner Cook mentioned that a workshop meeting has already

Mctaughlin Engineering to waive replatting requirements and
permission to file a petition to vacate street located in ocean
waterxay Mobile Home Park located on Bryan Road and O1d Griffin
Road .
City Attorney Adfer informed the Commission that this is a
request by Mcl,aughlin Engineering to file a petition to vacate
this streeL in order to go before the Planning and Zoning Board.
Mr. Adler stated that if the Planning and Board approves the
vacation, it will then come back to the commission for final
approval . If the Commission approves the vacalion, the
petitioner is also requesting waiver of the replatting
requirements.

Michael Brandon, Ben Franklin Properties, stepped forward to
request approval of this 90 day extension.

Mr. Brandon explained that the reason for this request was
delays with the Department of Transportation in obtaining

9.1 City Manager Flatley requested the Commission to purchaseone-half acre of School Board property located near the corner of
SW 12 Avenue (E1y Boulevard) and Stirling Road. Mr. Flatleyexplained that Dania uses this property for a lime sludge areabehind the public works garage and explained that he requestedfirst option to purchase this property in the event the SchoolBoard decided to sell.
The Commission generally agreed to direct City Manager Flatley tonegotiate with the School Board for this property and that hewill bring back the final cost figure for Commission approval.
