1 Proposed water and Sewer Ordinance.
,.lohn Calvin, City Engineer, presented draf ts of aresolution he has prepared for the Town of Davie forthe City to review in an effort to update their water
and sehrer ordinance covering charges and procedures.
After further discussion. the Commission agreed to
address this proposed ordinance after the UtitityDirector has been hired and had an opportunity toinclude his ideas.
L,arge User Wasteirater Agreement and General Release relatingto the Hollyrood/Dania litigation.
City Manaqer Flatley mentioned that this new agreementwilf replace |-he 1972 agreement with Hollywood. Healso addressed the issue of signing a General ReLeaseon the settlement. between Dania and Hollywood.
City Attorney Adler explained that this agreementrelates to the 201 Program established some years agofor wastewater service operated by Hollywood. Mr.Adler mentioned that each city using the plant paid
fees to Hollyl,ood and that the fees were determined byHollywood. Mr. Adler mentioned that each city hadreserve capacities and when these ran out that Daniapurchased from Hallandale. Mr. Adler stated that it
was determined that Holfywood was using other city's
reserve capacities that Here not as yet being used andthat this was unfair which was the basis of thelawsuit.
Mr. Adfer informed the Commission that the new
agreement stiIl designates Hoffywood as the operatorbut that all cities, including Hollywood, pay based onusage. Mr. Adl-er explained that if a city expands and
needs additional capacity in the future, they will beresponsible for all costs of the expansion that takesplace for the plant to service them and that othercities will not be penalized. Mr. Ad1er added thatthere is an Advisory Board established to makesuggestions to get people to work together but thatthey do not set rates- Mr. Adler stated that there has
been a substantial savi"ngs to each city. Mr. Adler
encouraged approval of this agreement in order to

Commissioner Grace mentioned that she has no problem
with the commercial fence ordinance but requested the
Commission to revisit the negative points of the
residentiaf fence ordinance that was recently denied.
Commissioner Grace felt that there are many positive
aspects to the ordinance that need to be implemented in
the city and requested Commission opinion.
Vice Mayor Mikes stated that he felt there was no
problem with the l foot setback as there will alrvays be

Commissioner Cook mentioned that several citizens
expressed their opposition at the regular meeting
August 14 to the l foot setback in the ordinance

Vice Mayor Mikes mentioned that he fett the ordinance
should include a requirement on whether the structuraf
side or decorative side of a fence should shou towards
the street.
Commissioner Cook mentioned that the fence size
inconsistencies within the city have caused a lot of
controversy as some citizens have received 6' fences
without a varlance or permiE and other citizen's
requests have been rejected.
Discussion contj-nued regarding the different fot levels
in the City and the need to leave the fence requests
under the variance procedure as it would be difficult
to adopt an ordinance to address the various property
differences in the CitY.
4.Proposed I-T. Parker Community Center fee structure-
Commissioner Bertino explained that he has met with the
I.T. Parker Committee in an effort to increase the fee
structure for leasinq the center. Commissioner Bertino
expressed his concern that the costs to operate and
maintain this huge building supersede the revenue
coming in from leasingi the building for special events.
Commissioner Bertino expressed the need to prepare a
repair and replacement fund to cover future repairs and
replacement of furniture, flooring and roofing-
The commission reviewed the charges for usage and clean
up of the comnunity center to be implemented for
employee, resident and civic groups compared to charges
required for outside individuals.
The Commission agreed to continue to have City l'lanager
Flatley negotiate with individuals who request to use
the faaility for a few days at a time and to place this

5. Discussion of revised political sign ordi,nance.
The Commission reviewed the revised ordinance regardlng
the amount of bond required. the time limits for
erections of poIltica1 signs, the maximum size of
signs, and the placement of siqns in residential,
commercial and vacant commercial lot areas.
6. Revisit of the alarm ordinance-
Commissioner Bertino mentioned the need for an alarm
ordinance to be implemented in the City in order to
require commercial property owners to be responsible
for turning off false alarms as they happen in the
City.
City Attorney Adler suggested addlng a provision in
ordinance making it unlawful to instalf an alarm in
buslness that doesn't automatically shut itself off
after 30 minutes.

City Attorney Adler ment j-oned that he would also
include the requirement that if a fafse alarm does not

7.B. S. O. contract
The Conmission reviewed the operating costs relating to
the contract and determined the L990/9L contract total
to be 52,528,07O. City Manager Flatley mentioned that
thj.s gives the city the same manpower and basic
contract as last year with the exception of three
additional road patrol deputies.
City Manager Flatley stated that he woufd obtain a
revised letter agreement from the County and place this
on the agenda for the next regular rneeting of August
28, 1,990.
At this time, discussion continued regarding State
statute requirements on the disposition of abandoned
vehicles by the City and property owners.

City Manager Flatley mentioned that he has resolved
several issues with the Sheriff's Office regarding
contract neqotiations. Mr. Flatley expressed his
concern that the City has yet to receive a report of
Lau Enforcement forfeiture funds for confiscated items
for the Ci-ty of Dania in accordance with the contract
since October 1988. Mr. Flatley rereninded the
Commission that the City's previous Law EnforcementTrust Fund Account started with S80,000 and, at this
time, the balance is 588,000. Mr. Flatley mentioned
that he expects to receive 526,000 shortly as a
reimbursement for equipment the city purchased for BSO.

vice Mayor Mikes mentioned that the lanquage under
Section 1in the indented paragraph of the proposed
ordinance clarify "elevations" as "elevation views" and
change the word "picture" to "illustration" and include
"and landscaping" to go along with "al1 structures" on
line 5 of the paraqraph.
At this time. Commissioner Bertino mentioned that
Broward County is coming out with a grant situation
whereby any project that will benefit school children
and a community, the City would only pay one-thlrd of
the cost. Commi.ssioner Bertino stated that the
additional t!,o-thirds would be paid from Broward County
and out of another fund for the school system involved.
Commissioner Bertino mentioned that since there is
going to be a new olsen Middle school built to apply
for this qrant to include the construction of a
swimming pool at a cost of around S415,000.
Commissioner Bertino informed the Commission that the
cost to Dania would be estimated at S138,000. The
Commission generally agreed that this would be a good
benefit to Dania if financially feasible.
Mike Smith, Personnel Director, requested direction
from the Commission on how he should charge the people
who have reserved the civic center in advance since
they have revised the fee schedule for the I.T. Parker
Community Center. The commission generally agreed that
these persong should be adviged that the fees have
increased and that they have the option to cancel.
Commissioner cook commented on the need to cuE back on
expenditures in the City since revenues have decreased.
City Manager Flatley reassured Commissioner cook that
he is aware of the serious economic crisis in the
country and that he wi,tL continue to be conservative in
his spending.
