1- southeast drainage study-
City Manager Flatley requested Berry & Calvin to report
on their findings of the drainage study for the
Southeast section of the City and present their
analysis on the effects of disconnectlnq the
Meadowbrook Lakes from the city drainage system.
..Iohn Calvin, Berry & Calvin. mentioned that his firm
has conducted a drainage study on an area encompassing
420 acres bounded by Federal Hiqhway and S.E. 5 Avenue
on the west and east, and by Dania Beach Boulevard and
Sheridan Street on the north and south, Mr. Calvin
mentioned that the Southeast section of the city has
low lying elevations making it susceptible to heavy
floodinq during moderate rain storms occurring several
times throughout any given year.
Mr. Calvin nentioned that the governing agencies
regulate drainaqe improvements in this area were
contacted with regards to their findings and that
ideas were well received.
Tim wefsh, Engineer with Berry & Calvin, presented acost analysis of seven options the City could choose
for solving the drainage problem in the Southeastsection of the City.
Severaf cit.izens in the area and from the Meadowbrook
Lakes Condominiums stepped forward to express their
concerns for resolving this drainage problem due to thepollution and algae problems created when the city
draininq system was connected into the Meadowbrook
Lakes.
After hearing from representatives from the Meadowbrook
Condominiums, Mr. Flatley agreed to research and report
back on who gave the City permission to take over the
maintenance contract with Aquatic systems.
Further into the meeting, Mr. Adler was given a
Meadowbrook Lakes Memorandum dated October 27, 1987
from a Mr. Henry Levison, President of the Central
Board. giving permission to the City of Dania to
maintain the fakes at Meadowbrook.

The Commission generally agreed to have the City
Manager and city Engineers look into funding
alternatives and come back with a recommendation on
Hhich option would be the most positive alternative for
solving the drainage problem in the southeast section
and protect t.he residents at MeadoHbrook Lakes
Condominiun.

4. Revieu of l{yatt Study.
Mike Smith. Personnel Director. informed the Commission
of a proposed pension ordinance to aflow uses of
actuarial qains to offset retlree health insurance
premiums and to stabilize costs in the event of an
actuarial 1oss.
Mr. Smith explained that if the City established the
pension rate of contributions at 9.5% for 1990-91 the
result in a reserve fund from actuarial gains uould be
S244,OOO and mentioned that this would a11ow the City
to work withln its existing budget. If the City chose
a 10% rate of contribution the reserve fund Hould be
S328,000 but would require the city to provide an
additional S10,000 from the contingency fund.
Mr. snith stated that Marie .Iabalee, Finance Manager,
and himself have requested the Police & Firefighters
Pension Board and Union to develop language in the
proposed ordinance to ensure the city retains the right
to yearly revlew its option to leave total actuarial
gains in the plan or take the appropriate reduction in
its contribution rate. Mr. Smith stated that they also
covered the situation that should the need for the
reserve fund, namel-y to offset retiree health insurance
premiums. no longer exist at some point in the future,
then said actuarial gains may be used by the City
r^rithout any need for further bargaining.
vice Mayor Mikes expressed his concern that this
program has not been utilized by other cities and felt
it to be irresponsible for the city to be munipulatlnql
pension funds of employees. Vice Mayor Mikes stated
that the City should stay with the more conventional
programs that have been proven.
Mr. Smith stated that slnce the funds still remain in
the cont-rof of the Commissjon, he felt the city
wouldn't be any worse off than they are now.
Vice Mayor Mikes expressed his dissatisfaction with
discussing this issue prior to obtaining state and
agency recommendations and approvals of the program-
Mr. Smith responded to Vice Mayor Mikes' concern by
explaining that he didn't feel it to be cost effective
to obtain written approvals for this program until
after he was sure the Commission agreed with the
concept of the program.

Discussion continued regardi.ng Lhe possibility of
adopting the ordinance on first reading and obtaining a
response from the wyatt Company and the state on how
secure this program is prior to final adoption.
Wanda Muflikin, City C1erk. informed the Commission
that an actuarial study of this ordinance would have to
be obtained from the State prior to adoption on second
reading and that there isn't enough time to obtain all
necessary information and approvals by the october 1
deadl ine .

7. Discussion of Dania's position regarding the south
Runway Expansion at the Airport.
Attorney Curtis representing the City of Dania in the
South RunHay Expansion at the Airport stepped forward
to describe the progress of the negotiations with the
Airport regarding noise mitigation and the types of use
of the new commercial south runway. Mr- Curtis
mentioned that the two areas of concern have been to
assure Dania's tax base is maintained and to protect
the residents from the sound pollution of this
devel-opment.
Mr. Curtis mentioned that the three basic areas for
protection of the sound pollution are west of the south
runway which is the newly annexation area. the
Melaleuca Gardens area and NE Dania off the southeast
end of the diagonal runwaY.
Mr. Curtis reported that two major goals have been
accomplished involvlnq establishing that Federal
nunding Hill be set aside prior to mitlgation occurring
and that the County will only be using stage three
aircraft on the south runway. Mr. Curtis stated that
he has not been able to obtain a commltment from the
county on the number of aircraft that will be used or
on the time restrictions for the runway.
Mr. Curtis mentloned that a meeting wi]1 be held with
the City of Fort Lauderdale and the City of Dania to
attempt to come up with an agreement on a preferred
.unway system which would involve curfew restrictions.
Mr. Curtis explained that Brouard County approved a
Part 150 Study in 1989 which is a noise study on the
impact the airport has on the surrounding neighborhood'
Mr. Curt-is explained that his position is to mitigate
this issue since this study was not considered in the
DRI in 1981 or r^Ihen they expanded the terminal to allow
the increase in operations. Mr. curtis expressed doubt
in obtaining an agreement with the County on t-his
issue.
Mr. Curtis explained that the last area of mitigation
involves the tYpes of easements and restrictions that
will be implied on the inpacted area which can affect
Dania's tax base for revenue. Mr- Curtis menti'oned

that there are three phases set up to negotiate withthe County to determine the financial impact on Dania
and if no agreement is reached after going thru thethree phases, the city will have to file a fawsuit.
Discussion continued on the County involvlng around1,000 people in their Part 150 study and that theadditional residents in the annexation area,anticipated by the year 1995, not being included in
s tudy .

City Manager Flatley expressed his concern on the lackof information being avaifable to the City from the
County on this issue. City Manager Flatley stated thathe is adding a resolution to the next regular
commission meeting requesting to delay the pubLic
hearing process on the Airport south runway expansionuntil current data. updated from 1980, is available.Mr. Flatley mentioned that Dania may still go forwardwith their proposed November 1 public hearing as
scheduled in an effort to give citizens an opportunityto respond on this issue but that it would be conductedon a forum type of meetinq.
After further discussion, it was determined that Mr.Flatley and Mr. Curtis uould present further discussionof this item prior to the adoption of the resolution atthe next regular meeting of September 25. 'L990.

Commission Grace requested the following changes be
made to the fence ordinance:

The Commission agreed that this ordinance
and discussed at the next regular meeting25, 1990.

Vice Mayor Mikes expressed his dissatisfaction for
spending the amount of time the Commission has spent ondiscussing this proposed ordinance when he doesn't feelthere is an overall need to the citizens of the city.
Commissioner Grace expressed her view that this
ordinance is important and l.rilf implement positive
action for Dania citizens.
