1. CONSENT AGENDA
Mi nute s1.1 October 23, L990. workshop meeting
Resolutione1.3 City Attorney Adler read the title of the
resolution approving that certain memorandum of
understandinqt between Broward county and the City of
Dania relating to "Project-Impac".
L.4 City Attorney Adler read the title of the
reaolution declaring certain personal property as being
obsolete and surplus and no longer needed for municipal
purposes and further declaring the intent of the Cj,ty
of Dania to seII same.
1.5 City Attorney Adler read the title of the
resolution authorlzinq the city Manaqer to subni-t an
application for funding under the Florida Recreation
Development Assistance Program for Dania Beach Park,
Phase II, designating the City Manager or his designee
as the official liaison agent; conf j-rminq the amount of
funds requested in the grant; confirming the
availability of the required matchinq fundsi confirming
the total cost. of the projecti confirming the City's
responsibilj"ty to develop, operate and maintain theprojecti confirming that the City offered aIl citizens
the opportunity to participate in the planning process
relative to the adoption of the recreation and open
space element; confirming the city's on-going concern
for citizen participation in planning and selection of

City Manager Flatley nentioned that the amounts to
filled in the resoluti.on are $112,462 for the grant

1.6 City AtEorney Adler read the title of theresolution requesting that the U.s. Department of
Housing and Urban Development conduct a complete and
thorough investigation of the Danj-a Housing Authority
including, but not limited to, the financial,
administrative and contractual requirements of the
authority.
City Attorney Adler stated that Chairman of the Danla
Housing Athority, William c. winkelholz, submitted a
letter in response to this resolution that Nl11 be
placed with the records of this meeting by the City
c1erk.

ordinance for first readinq amending Chapter 14 of the
Code of Ordinances of the city of Dania, Florida, by

scout show Day. Mayor McElyea comnented that it is an
honor to adopt this proclamation as his grandson
participates in cub scouts and Commissioner Bertino's

Manaqer for tabulation and calculation and a
recommendation brought back to the next regular meeting
of December 11, 1990.

4.L City Attorney Adler advised the Conmission of a
variance request by R,P. L,egg & Associates, Inc.,Petitioner and iloseph Fedele, oxner, to allow the
addition to a kitchen with a side yard setback 4.93feet (7' set-back is required) . Subject property
located at 40 SE 11 street.
Robert Legg. ilr., R.P. Legg & Associates, stepped
forward to explain that the hardship in this request is
due to the current zoning of RD-6000 being brought into
effect after the structure was constructed and the
owner would nou like to extend the kitchen to meet the
outer most wall of the existing structure.
City Manager Flatley stated that the Planning & Zoning
Board reviexed this item on November 6 and they have
recommended approval due to special conditions aspeculiar to the building. city Manager Flatley
explained that Will A11en, crowth Managenent Director,
is attending a seminar out of town and that he
reconmends approval of this request.
Mayor McElyea opened the public hearing. Hearing no
one speak in favor or opposition, the Mayor closed thepublic hearing.
A motion was made by Comniesioner Cook. seconded by
Comnissioner Grace to grant the variance request (VA-
59-90) as requested by R.P. [.,eqq & Associates to a11owthe addition to a kitchen with a side yard setback 4.93

Mayor McElyea opened the public hearing. Jon Hinden,
Asiistant Town Attorney for Davie, stepped forward to
object to the adoption of this ordinance as the Town of
Davie feels the interest of this property could be
better served by the Town of Davie- Hearing no futher

7.2 Proposal to reopen restaurant at the pier.
City Manager Flatley informed the Commission that iten7.4 Restaurant lease proposal for Dania Pier and 7.2

Mike smith. Personnel Director. explained that the
Commission requested proposals be sent out to reopenthe restaurant portion of the pier after obtaining anopinion from the consulting engineers that therestaurant was safe. Mr. Smith stated that Mr. Phil
Sitzman was the only individual who submitted a
completed RFP back to the City and that his proposal
i-nvolves a S660.00 per month revenue paynent to theCity with the conditions that the city be responsiblefor waste removal, reduce his security deposit andinsurance requirements and discuss free parking spaces.Mr. Smith mentioned that lrr. Sitzman has requested the
removal of the existing storage section on the northsection of the pier and requests all equipment be inHorking order.
City Manager Flatley recommended approval of thisproposal on a short term basis during the time that theCity will be establishlng alternatives to constructinga new pier. Mr, Flatley requested Commission approvalto work with Mr. Sitzman to discuss the detaits of the

Commissi.oner Bertino stated that he has obtained a
number of conplaints relating to the hiqh water bi11sin the City and requeeted City Manager FlatLey to
respond to this issue.
City Manager Flatley explained that the City is not
makingr any money on the increase to trash pick up and
water biIIing. Mr. FIatIey reminded the Commissionthat proposals will be advertised in the spring for a
new sanitation contract in Iiqht of the ReuterRecycling Plant opening in september. Mr, FlatIeynentioned that the revenue flow in the Water Budget for
1989/90 fiscal year went doxn due to the waterrestrictions over the summer. city Manager Flatleystated that citizens can expect an increase in water,
sewer and sanitation as a sign of the times and
mentioned that Dania is actually lower than any other
comnunity in the area.
Commissioner Bertino mentioned that he has recei-ved a
check for $25,000 which is half of the grant money fromthe State of Florida to be used for completion of the
bikepath down Dania Beach Boulevard.
Commissioner Bertino reported that the people from
Westlake will be at the December 11 regular meeting to
make a presentation on the plans that complete the
bikepath over the south side of the bridqe at the canalon Dania Beach Boulevard.

contractor for the city has agreed to instruct his
employees not to danage or throw garbage cans in theCity as this has caused a problem to the residents;especially the elderly.

The Commission generally agreed that they are willingto meet with the residents from the NW section but that
BSO can come to the meetlng if they so choose as the
Commission cannot exclude anyone from public meetings,
The Conmission scheduled a workshop meetj-ng for
November 29 at 8:00 p.m. with residents from the NWsection.
